PURPOSE: APPROVAL OF AMENDMENT TO ENGINEERING SERVICES
AGREEMENT WITH STRAND ASSOCIATES, INC. FOR
CONSTRUCTION MANAGEMENT SERVICES FOR THE JAMES
ROAD AREA STORMWATER DETENTION BASIN IN THE AMOUNT
OF $50,000.00
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City and Strand Associates, Inc. previously entered into a
professional services agreement in which they would provide the City with services related
to the construction of the James Road Area Storm Water Detention Basin; and
WHEREAS, due to additional wetland mitigation assistance, revising the mitigation
plan to take advantage of a newly-opening wetland mitigation bank, and additional site
work due to contractor errors, additional services are required.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-
16 of the Municipal Code to enter into an amended agreement with Strand Associates, Inc.
BE IT FURTHER RESOLVED that said City officials are authorized and directed to
take those steps necessary to implement the terms and conditions of the final agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

RE: Amendment to Agreement for Engineering Services for Construction Management of the
James Road Area Storm Water Detention Basin—Strand Associates ($50,000)
BACKGROUND
The Department of Public Works contracted with Strand Associates (Strand) to provide construction-
related services associated with the construction of the James Road Area Storm Water Detention Basin.
Due to additional wetland mitigation assistance, revising the mitigation plan to take advantage of a newly-
opening wetland mitigation bank, and site re-work due to contractor errors, additional services are
required. These services include assistance with construction contract change order reviews, site visits
and attendance at progress meetings, assistance with reviewing the contractor's installation of the
Articulated Concrete Block Mat System (ACB), review repair submittals for the ACB reinstallation,
assistance with the Wisconsin Department of Natural Resources (WDNR) and the United States Army
Corps of Engineers (USACE)to include the Armory Area Detention Basin wetland mitigation requirements
into the James Road Area Detention Basin compensation site plan, and assistance with the WDNR and
USACE permit amendment for the City to be able to purchase wetland credits from a wetland mitigation
bank for both the James Road Area Detention Basin and the Armory Area Detention Basin.
ANALYSIS
Strand was chosen due to their experience with the Sawyer Creek Watershed and the design of the
James Road Area Storm Water Detention Basin project.
FISCAL IMPACT
Staff has reviewed the amendment and costs. The proposed fee for this amendment is estimated not to
exceed $50,000 for a total contract amount of$131,000. Funding for these services was accounted for in
the Storm Water Utility 2013 CIP bond borrowing, and is available in the Storm Water Utility.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature, including engineering services, may be procured without the use of formal, sealed
quotes. I have reviewed this amendment and in accordance with Section 12-16 of the Code, I am hereby
recommending that the Common Council approve the award of this engineering services agreement.
