BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit to allow a Hertz automobile rental business within the strip mall at
1684-1694 South Koeller Street, per the attached, is hereby approved with the following
condition:
1) No more than 6 parking stalls on the lot are utilized for rental vehicle parking.

BACKGROUND
The subject property is a 1.4-acre/61,300 square foot parcel of land and is located at the
northeast corner of South Koeller Street and Osborn Avenue within the Highway
41 commercial corridor. The site is currently improved/developed with a 14,500 square foot
commercial strip center and 72 stall parking lot housing multiple retail and service business
tenants.
ANALYSIS
The petitioner is proposing to establish an automobile rental business including 1,200 square
feet of rental office within one of the tenant spaces of the strip center and minimal rental
vehicle storage within the parking lot. This business will be a satellite location for the existing
Hertz Rental business located at Wittman Airfield and with the exception of wall and existing
ground sign changes, no alterations to the site from its current condition are planned. It is
anticipated that the business will have up to five employees and 10-20 customers per day
requiring a minimum of four parking stalls to be dedicated on the site for their use. The
petitioner has indicated that there will be ten stalls dedicated for their business leaving 62
stalls remaining on site which is sufficient to handle overall parking requirements for the strip
center. The proposed use will not change the essential character of the area or have a
negative impact on the adjacent uses.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its September 17, 2013 meeting.

GENERAL INFORMATION

The applicant is requesting approval of a conditional use permit to allow the operation of an
automobile rental business.
Applicable Ordinance Provisions:
Vehicle sales/rental uses are permitted only through the approval of a conditional use permit
within the C-2 General Commercial Zoning District. The Zoning Ordinance establishes criteria
and guidelines for establishment of a Conditional Use Permit in Section 30-11 (D).
Background Information Property Location and Type:

ANALYSIS
The subject property contains an approximately 14,500 square foot five-tenant commercial strip
center and associated parking lot. The petitioner is proposing to establish an automobile rental
business including 1,200 square foot rental office within one of the tenant spaces of the strip center
and minimal rental vehicle storage within the parking lot. This business will be a satellite location.
for the existing Hertz Rental business located at Wittman Airfield. With the exception of wall and
existing ground sign changes, no improvements/alterations to the site from its current condition are
planned.
The existing site layout contains 72 parking stalls located on all sides of the building. It is
anticipated that the business will have up to five employees and 10-20 customers per day. The
Zoning Ordinance requires automobile rental businesses to provide 1 stall per 300 square feet plus
adequate storage for rental vehicles therefore requiring four stalls to be dedicated on the site for
employee and customer use. The petitioner has indicated that there will be ten stalls dedicated for
their use (four stalls in front of the building and six stalls in the back of the building) thereby
allowing six of the dedicated stalls to be utilized as rental vehicle storage/parking. Staff has
analyzed the existing and potential tenants of the strip center and is confident that the 62 stalls
remaining on-site are sufficient to handle overall parking requirements for the strip center.
It does not appear that the proposed automobile rental use will change the essential character of the
corridors current retail, service and restaurant uses and will not have a negative impact to the area.
RECOMMENDATION/CONDITIONS
Staff recommends a finding that the proposed conditional use permit request is consistent with
Sections 30-11(D) of the Zoning Ordinance and be approved with the following condition:
1) No more than six parking stalls on the lot are utilized for rental vehicle storage.
The Plan Commission approved of the conditional use permit as requested with revised conditions.
The following is the Plan Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area and explained that Hertz
was intending to use this business as a satellite location as their main operation would remain at
the airport. He further explained that there would be no changes to the site except for signage and
discussed the number of parking stalls surrounding the building of which ten would be dedicated
to this use with six for rental car storage. He stated that the remaining 62 stalls on the site appear
to be adequate for the other tenants in the strip center and reviewed the condition recommended for
this request.
Mr. Bowen questioned how we define vehicle storage.
Mr. Buck responded that the rental cars would not be differentiated from other cars on the site but
they would be limited to six stalls for storing them at this location.
Mr. Bowen commented that he had concerns about the vehicle storage on the site.

Mr. Buck reiterated that the business would have ten dedicated stalls, six to be used for rental car
storage and four for customers and/or employees.
Mr. Thoms also voiced his concerns with the definition of storage and if the business would utilize
more than their six stalls, it could negatively impact the other businesses in the strip center. He felt
the condition should state that only six rental vehicles would be allowed on the site at a time and
the word storage should be removed.
Mr. Hinz commented that the petitioner had indicated that their main location was to remain at the
airport and that this was a satellite office only so the storage of vehicles on site should not be an
issue.
Jeremy Hanson, representing Hertz Corporation, 525 W. 20th Avenue, stated that they would still
continue to work out of the airport location and will never be utilizing more than six stalls at this
location. They would rent out and replace vehicles at this location but most of the vehicles would
remain at the airport.
Mr. Thorns questioned if this site would handle pickups and drop offs.
Mr. Hanson replied that this location would handle both but at the end of the business day, any
excess cars would be moved to the airport.
Mr. Borsuk questioned if the petitioner was satisfied with having no more than six rental cars on
site at a time.
Mr. Hanson responded affirmatively.
Commission members determined that the wording of the condition should be altered from "No
more than six parking stalls on the lot are utilized for rental vehicle storage"to "No more than six
parking stalls on the lot are utilized for rental vehicle parking".
Motion by Vajgrt to approve the conditional use permit to establish an automobile rental
business at 1684-1694 South Koeller Street with the following condition:
1) No more than six parking stalls on the lot are utilized for rental vehicle parking.
Seconded by Cummings. Motion carried 9-0.

Narrative for Conditional Use Permit
Introduction
This narrative is to serve as supplementary information related to the conditional use permit
application submitted to conduct car rental business at Koeller Plaza at 1690 S. Koeller Street
Oshkosh, WI. The applicant is Hertz Corporation. Jeremy Hanson is the petitioner for the Hertz
Corporation concerning this application
Summary of Project
Hertz is proposing to utilize the property, located at 1690 S. Koeller Street Oshkosh, for general
car rental business and related activities, including weekend business.
Following is a brief narrative addressing specific requests outlined in the application for a
conditional use permit with the City of Oshkosh.
• Existing and proposed use of the property.
Currently the property that we are planning to relocate to is vacant. However, the
lot itself also has a Mattress Plus and PLS Loans located on the property. The
proposed use of the property is to handle day to day rental business for the Hertz
Corporation.
• Identification of all structures (including paving, signage, etc.) on the property and
discussion of their relation to the project.
The layout is typical of a business plaza. The lot is paved with 72 parking stalls
surrounding the building. There are dumpsters located in the back of the building
as well as a dumpster enclosure. Each business currently located at the plaza has
signage both on the building itself as well as on a stand-alone sign. Hertz would
be looking to follow a similar model with signage on the building and also joined
with the other businesses on the stand-alone sign. We believe this help to make
our business more viewable from both Koeller Street and highway 41. Parking on
site will be 4 designated parking spots in the front of the building and 6 more at
the back. Any extra cars will be stored at Wittman airfield where we are currently
located. We will be renting and working out of both locations.
• Projected number of residents, employees, and/or daily customers.

Daily employee staffing will remain below 5 people. Customers coming in and
out of the business are anticipated to be between 10-20 people in the entire
business day.
• Proposed amount of dwelling units, floor area, landscape area, and parking area
expressed in square feet and acreage to the nearest one hundredth of an acre.
The site plan we are looking to have is going to be 1200 sq. ft. within the building
for operation of the business. Outside the building we are looking to have some
parking stalls specifically labeled for Hertz vehicles.
• Effects on adjoining properties to include: noise, hours of operation, glare, odor,
fumes,vibration, etc...
The operations of the car rental business will not produce any noise, or any other
distraction to the surrounding areas. Hours of operation or intended to be from
lam to 5pm Monday thru Friday and 9am to 12pm on Saturdays.
• Compatibility of the proposed use with adjacent and other properties in the area.
We will be maintaining a professional and business like atmosphere similar to the
integrity of the surrounding companies.
• Traffic Generation (anticipated number of customers, deliveries, employee shift
changes etc...)
The number of customers anticipated has been previously listed at around 10-20
people on a daily basis. Deliveries are not expected to exceed normal business
use of general mail and generally low Fed Ex deliveries. Employees shift change
will be minimal as our hours of operation are of a single shift.
• Any other pertinent information to properly understand the intended use/plan and
its relation to nearby properties and the community as a whole.
Hertz has been a part of the Oshkosh community for a long time and we are
merely looking to extend our business to a more popular and mainstream location.
General business ethics and procedures apply to maintain a professional and
welcoming experience for all parties involved.
Conclusion
We respectfully request approval of the conditional use permit based upon the facts presented
herein. The relocation of the Hertz Corporation will not only enhance the properties and
businesses nearby but help to service the needs of the Oshkosh community.
