Gohde, Assistant Director of Public Works DATE: September 5, 2013 RE: Approve and Accept Waivers of Special Assessment Notices and Hearing relating to Various Utilities&Asphalt Paving on Adams Avenue BACKGROUND In December 2010, the Common Council passed Resolution No. 10-382 to approve an amendment to a previously-approved Residential Planned Development parcel into multiple parcels for a portion of the Harbor Way Condominiums at 881-916 Adams Avenue. A condition of the resolution was that a cul-de- sac or turn-around be designed and constructed by the Department of Public Works, with any and all expenses associated with the construction of the cul-de-sac borne by the subject property owners with a signed waiver of assessment. The owners of the properties impacted by this construction have signed and submitted waivers for special assessment notices and public hearing for this construction. ANALYSIS The resolution records and accepts the waivers to a Public Hearing for the proposed assessments. FISCAL IMPACT The Waivers of Special Assessment Notices and Hearing ensures the City can special assess these improvements to these property owners. There is no cost to the City. RECOMMENDATIONS I recommend acceptance of the Waivers of Special Assessment Notice and Hearing. Approved: Mark A.
