Box 1130 Oshkosh, WI 54902-1130 RE: Manufacturers Marketplace--Oshkosh, Wisconsin Dear Bill: This will follow up the several conversations we've had concerning various offsite improvements needed in connection with the Manufacturers Marketplace. This letter is intended to summarize our understanding as follows: 1. We have agreed to expand the area between the two phases of our project to a distance of not less than 100 ' to accommodate a 48 foot drive connecting to a public road to be constructed by the city at the west edge of our property line. The city has agreed to construct the public road at no expense to us. 2 . We have agreed to reimburse the city should we elect to exercise our option at a rate of $21. 20 a lineal foot toward the cost of these road improvements. The city has agreed to cooperate toward the vacation of the road should we elect to exercise. 3 . The city has also agreed to extend the sanitary sewer at no cost to us from 44th to our site along Washburn Blvd. It is my understanding that this contribution will approach $81, 000. 00. Bill, if this letter meets with your understanding of the essential terms and conditions we have discussed, kindly acknowledge by signing and dating below. Waterfront Centre • P.O.
