CONSENT
WHEREAS, the City of Oshkosh is constructing a transit center on
property fronting Market Street and Pearl Avenue, and
WHEREAS, as part of the project, it will be necessary for the City
to construct a retaining wall on the property line abutting 103 High Avenue
which requires damp proofing a portion of the rear wall and brick infill of
the existing basement windows on the rear wall of 103 High Avenue at City
expense,
NOW, THEREFORE, MRI Development Corp. , owner of 103 High Avenue,
Oshkosh, Wisconsin, hereby consents to the City of Oshkosh performing the
following work at no expense to the Corporation:
1. Brick infill to the existing basement windows along the
rear wall of 103 High Avenue, prior to damp proofing as
outlined below, using suitably matching materials.
2. Damp proofing a portion of the rear wall of 103 High Avenue
to a height commensurate with the height of the City' s
retaining wall to be constructed as part of the Oshkosh
Transit Center.
