HomeMy WebLinkAbout07. 13-340 JULY 23, 2013 13-340 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVAL OF VARIANCE FOR CLOSURE OF MAIN STREET / CANADIAN NATIONAL RAILROAD FOR NEW RAIL INSTALLATION / AUGUST 2013 INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, CN Railroad is upgrading the rail through Oshkosh, which includes th several crossings, one being Main Street south of the 24 Avenue intersection; and WHEREAS, CN Railroad requests a variance to Section 25-23 of the Municipal Code which requires State, County, and certain other roads to maintain a passageway open to traffic during construction work; and WHEREAS, Main Street/State Highway 45 is required to retain a passageway open to traffic during construction; and WHEREAS, maintaining an open passageway for traffic while installing rail would not be possible; and WHEREAS, they will be coordinating with the Department of Transportation for an acceptable detour route and providing the required message boards posted a week prior to the closure along with approved detour routes. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that a variance from Section 25-23 of the Oshkosh Municipal Code is granted allowing the closure of Main Street/State Highway 45 from August 5 through August 7, 2013. 1 • Engineering department CP11444/ 1607 West 2nd St. Appleton,WI 54914 July 18, 2013 Mr. Pete Gulbronson, P.E., C.D.T. Civil Engineer Supervisor Direct Line (920) 236-5063 RE: Permission to close Main Street for Railroad crossing improvements Dear Mr. Gulbronson, CN Railroad (CN) is requesting that the City of Oshkosh grant a `variance to close' State Hwy 45 (Main Street) on the south side of Oshkosh during the dates of Aug 5 through Aug 7. The finish date is contingent on track availability and production scheduling, but our goal is to finish on time. CN agrees to work between the hours of 07:00 and 22:00 (no earlier, no later as required by the City) each day until the project is complete. The reason for this closure is so CN can upgrade the rail through town, which includes several crossings, one being Main Street. Since this is a US Highway, CN will be using the services of `Warning Lites' (Lance Mauel 920.378.0048). They'll be responsible for coordinating with the DOT (Jared Kinziger 920.492.771 3) and providing the required message boards posted a week prior to the closure. Also, they will design an acceptable detour route approved by the DOT. We are in conversation with Mr. Kinziger at the moment regarding permit requirements (if any).
