O.IHKOIH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: July 18, 2013 RE: Approve Conditional Use Permit for Telecommunication Equipment on Rooftop at Mainview Apartments / 522-530 North Main Street (Plan Commission recommends approval) BACKGROUND The subject building, located at 522-530 North Main Street, is a 10-story multiple-family brick apartment building constructed in 1927/1928 with approximately 110 rental units and commercial/service space on the ground floor. The structure is included in the North Main Street Historic District and was originally developed as a hotel and subsequently adaptively reused for public housing. The existing rooftop and wall structures at the roofline are dominated by a number of legal nonconforming antenna facilities. ANALYSIS In December of 2011, the Common Council approved a conditional use permit to allow the installation of three additional cellular antennae on the rooftop of 522-530 North Main Street with specific conditions including that"Plans and building permits for the roof rehabilitation and equipment concealment are provided by December of 2012 or the conditional use permit be considered null and void and the three antennae included within this petition be removed". The petitioner returned to the Plan Commission for an extension on the time period and for direction on the preferred stealth technique options. The Plan Commission approved the extension and held a workshop at which time they recommended that the petitioner follow a stealth approach that would locate the antennae below the existing rooftop or parapet and be painted to match the building and as flush mounted as possible. The petitioner has reached an agreement with all involved parties and finalized the stealth plan which requires approval by the Common Council prior to permits being issued. Unused equipment will be removed from the rooftop in coordination with the stealth installation. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its July 16, 2013 meeting. Approved, City Manager ITEM: CONDITIONAL USE PERMIT FOR PLACEMENT OF TELECOMMUNICATION EQUIPMENT ON THE ROOFTOP OF MAINVIEW APARTMENTS AT 522-530 NORTH MAIN STREET Plan Commission meeting of July 16, 2013 GENERAL INFORMATION Petitioner/Owner: Oshkosh Housing Authority Action(s) Requested: The Oshkosh Housing Authority is requesting approval of a Conditional Use Permit (CUP) for placement of multiple telecommunication/cellular antennae on the rooftop of the building known as Mainview Apartments (formerly the Raulf Hotel) at 530 North Main Street. Applicable Ordinance Provisions: Wireless telecommunication facilities, including antennae, are regulated in Section 30-35(J) of the Zoning Ordinance requiring all towers/antennae proposed to be constructed in commercial zoning districts receive a Conditional Use Permit. Property Location and Type: The subject building, located at 522-530 North Main Street, is a 10-story multiple-family brick apartment building constructed in 1927/1928 with approximately 110 rental units and commercial/service space on the ground floor. Main C-3D0 West St.) Comprehensive Plan Land Use Recommendation Land Use 10 Year Land Use Recommendation Mixed Downtown Development 20 Year Land Use Recommendation Mixed Downtown Development ANALYSIS In December of 2011, Resolution 11-543 was approved issuing a Conditional Use Permit to allow the installation of additional telecommunication equipment/three cellular antennae on the rooftop of 522-530 North Main Street(Mainview Apartments) with certain conditions including that "Plans and building permits for the roof rehabilitation and equipment concealment are provided by December of 2012 or the Conditional Use Permit be considered null and void and the three antennae included within this petition be removed". The petitioner returned to the Plan Commission in December of 2012 to provide an update on progress of stealth planning efforts and to request a six month extension to the CUP but also to receive direction from the Plan Commission on preferred stealth technique options including: 1. Stealth façade or screen wall matching the building behind which antennae are located. 2. Stealth antenna cover painted to match the building behind which antennae are located. 3. Antennae located below the existing rooftop (or parapet)painted or wrapped to match the building. Flush mounted to the greatest extent possible to reduce profile. 4. Partial option of antennae located behind, or incorporated in, a sign that might be included in a future Planned Development proposal. The Plan Commission approved the extension with the condition that plans and building permits for the roof rehabilitation and equipment concealment are provided no later than July of 2013 and requested that a workshop take place to go over the various options. A workshop was held in January of 2013 and the Plan Commission recommended that the petitioner follow the stealth approach 3 —locating the antennae below the existing rooftop or parapet painted to match the building and as flush mounted as possible. The petitioner has reached agreement on the design between all involved parties (Housing Authority, three carriers/antenna lessees and the State of Wisconsin Historic Preservation Office), finalized the stealth plan and is now prepared for permit application and construction following approval of the CUP by Plan Commission and Common Council. '�.�C` vµ `fir- s, ea., In addition to the 30 antennae included in the stealth plan, the existing rooftop and wall structures include 7 unused antennae mounts, 7-10 whip antennae, an outdated warning siren, multiple unidentified mounts and extensive cabling. These are depicted on the plans but not depicted on the rendering images. The petitioner has indicated that they will all be removed from the rooftop in coordination with the stealth installation. RECOMMENDATION/CONDITIONS Staff recommends approval of a Conditional Use Permit (CUP) for placement of multiple telecommunication equipment/cellular antennae, as proposed in the stealth plan with the following condition: 1. Unused antennae mounts, whip antennae, warning siren, and unidentified mounts are removed from the rooftop in coordination with the stealth installation. The Plan Commission approved of the conditional use permit for placement of multiple telecommunication equipment/cellular antennae as proposed in the stealth plan as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in said area. He reviewed the history of the conditional use permit and stated that the stealth plan that was a condition of approval for additional antennae previously approved had been completed. He reviewed the existing conditions and the proposed site plans and building profile with the stealth plan implemented. He stated that all parties involved were in agreement with the proposal and reviewed colored renderings of the antennae mounts after the plan is implemented. He reviewed the conditions for the request which entailed the removal of any unused equipment from the rooftop. Item—522-530 N Main/Mainview_CUP stealth plan 3 Ms. Propp commented that she felt the proposed stealth plan looked splendid and was very satisfied with the results. Motion by Vajgrt to approve the conditional use permit for placement of telecommunication equipment on the rooftop of Mainview Apartments at 522-530 North Main Street with the following condition: 1. Unused antennae mounts, whip antennae, warning siren, and unidentified mounts are removed from the rooftop in coordination with the stealth installation. Seconded by Bowen. Motion carried 9-0.
