HomeMy WebLinkAbout07. 13-329 JULY 9, 2013 13-329 RESOLUTION (CARRIED__7-0_____ LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: AUTHORIZE JURISDICTIONAL OFFERS FOR THE UPGRADE TO THE PUBLIC WORKS FIELD OPERATIONS FACILITY IN THE AMOUNT OF $533,450.00 INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the Common Council of the City of Oshkosh has determined it is necessary to acquire certain land for the Public Works Field Operations Facility pursuant to authority granted under Section 32.05, 32.06, 32.07, and 62.22, Wisconsin Statutes. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to issue Jurisdictional Offers and Awards of Damage (if necessary), as follows: Parcel 1: 702 W. 3 Ave. - $61,000; August Pitz & Sons; fee rd Parcel 2: 248 Dakota St. - $120,000; Thomas G. & Diane V. Ruck; fee Parcel 3: 250 Dakota St. - $83,100; Mary Ellen Salzseider; fee Parcel 4: 690 W. 3 Ave. - $90,000; Thomas G. & Diane V. Ruck, West Point rd Bank; fee Parcel 6: 680 W. 3 Ave. - $127,000; DRH, LLC, Associated Bank NA; fee rd Parcel 7: 676 W. 3 Ave. - $52,350; DRH, LLC; fee rd BE IT FURTHER RESOLVED that the proper City officials are further authorized and directed to sign any documents and take any and all other actions necessary to accomplish this purpose. Patek, Director of Public Works TcP DATE: July 2, 2013 RE: Approval of Jurisdictional Offers for the Upgrade to the Public Works Field Operations Facility BACKGROUND On July 10, 2012, the Common Council approved a relocation order relating to the purchase of property located adjacent to the existing Central Garage at 639 Witzel Avenue. The upgrade to this facility requires the acquisition of adjoining properties located on West 3rd Avenue and South Campbell Road. ANALYSIS Our right-of-way acquisition consultant has reviewed the property values for these parcels with the property owners. At this time, the property owners are not willing to sell their properties for the price offered by the City of Oshkosh. Per State Statutes, the next step in the eminent domain process is for the City of Oshkosh to send each of the property owners a jurisdictional offer to purchase. When a jurisdictional offer is made, the City provides the property owners with the funds for the purchase price (i.e. revised offer) we feel is appropriate and in accordance with the Statutes. The City then assumes ownership of the properties. The owners may challenge this purchase price in circuit court should they so choose. RECOMMENDATIONS I recommend approval of these jurisdictional offers.
