PURPOSE: WAIVE REQUIREMENT THAT PURCHASE OF USED MATERIALS
BE FROM FEDERAL STATE OR LOCAL GOVERNMENT &
APPROVE PURCHASE OF USED SEMI-TRACTOR FOR STREET
DIVISION TO JX PETERBILT ($68,500.00)
INITIATED BY: PURCHASING DEPARTMENT
WHEREAS, the Public Works Department is replacing a semi-tractor/trailer for the
Street Division that is used to transport city equipment to various city project sites; and
WHEREAS, city staff believes that a used tractor/trailer would most be most the
most cost effective means of meeting the needs of the City for this unit; and
WHEREAS, section 12-13 of the Oshkosh Municipal Code allows the City to
purchase used or excess equipment, material or supplies from the federal, state or another
local government when it is in the best interest of the City of Oshkosh; and
WHEREAS, staff was unable to identify suitable equipment available from another
governmental entity but was able to identify a used semi-tractor/trailer which meets the
needs of the City from a private dealer; and
WHEREAS, it is therefore necessary to waive the requirement of section 12-13 that
the purchase be made from another governmental entity.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the requirement that this purchase be made from another governmental
entity is hereby waived and the proper City officials are hereby authorized and directed
pursuant to section 12-13 of the Oshkosh Municipal Code to purchase a used semi-
tractor/trailer:

BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to enter into an appropriate agreement for the purpose of same. Money for
this purpose is hereby appropriated from:

RE: Approve Purchase of Semi Tractor for Public Works
BACKGROUND
The Common Council allocated $68,500 in the 2013 Major Equipment CIP for the Public Works
Department to purchase a used semi tractor/trailer for the Streets Division. The Streets Division
uses this tractor/trailer to transport city equipment to various city project sites. The current
tractor/trailer is a 1996 unit that now requires maintenance and repairs that exceed its street value.
Given its intended use city staff felt a used tractor/trailer would address the needs of this unit.
ANALYSIS
Working with Purchasing, Streets Division staff found a used tractor/trailer that will meet the
city's needs. The used unit is a 2008 Peterbilt 367 found through JX Peterbilt in DePere, WI.
FISCAL IMPACT
With trade the total fiscal impact of this unit is$68,500. The Common Council allocated $68,500
for this unit in the 2013 Major Equipment CIP. Funding for this unit will be from A/N#: 323-
0430-7210-06325.
RECOMMENDATION
Section 12-13 of the Municipal Code provides that subject to approval of the City Manager, the
city may acquire any used or surplus or excess equipment, materials or supplies from a federal,
state or local government without following a competitive bidding or quotation process if the
Purchasing Authority in consultation with the appropriate department head, determines that such
acquisition is in the best interest of the City. However, as no used semi tractors could be found
from federal, state or local government sources our search turned to private dealer sources which
then yielded this unit. In consideration of this and the limited used market for these types of
vehicles we are requesting the Common Council waive the federal, state or local government
source requirement of Section 12-13 and recommend the Common Council approve the purchase
of this used 2006 Peterbilt 367 for$68,500 from JX Peterbilt in DePere, WI.
