PURPOSE: APPROVE EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE
GRANT (JAG) FOR POLICE DEPARTMENT IN THE AMOUNT OF
$25,079.00
INITIATED BY: OSHKOSH POLICE DEPARTMENT
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to approve application for a grant
agreement with U.S. Department of Justice for the Edward Byrne Memorial Justice
Assistance Grant to purchase equipment for the Oshkosh Police Department and an
additional K-9 for the Winnebago County Sherriff’s Department.
BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to execute any and all documents required by the U.S. Department of Justice,
Office of Justice Programs, Bureau of Justice Assistance for the purposes of same, and
are further authorized and directed, if said grant is awarded, to accept such funds pursuant
to the terms of the grant application and to purchase needed equipment with grant funds.

RE: Acceptance of Edward Byrne Memorial Justice Assistance Grant
BACKGROUND
The Oshkosh Police Department has been notified that we are eligible to receive a federal
grant through the Edward Byrne Memorial Justice Assistance Grant (JAG) program.
Program guidelines require that the application be available for review by the governing
body of the unit of local government prior to submitting the application to the Bureau of
Justice Assistance. Grant fund eligibility and dollar amount allocation to local
governments are determined by a formula based on the share of total violent crime
reported within the state, and the city of Oshkosh, as indicated in the annual Uniform
Crime Report (UCR) that we are required to submit. The grant can be used to purchase
equipment needed to support public safety services. The JAG grant application deadline
is July 9, 2013.
The eligible allocation to the city of Oshkosh under the 2013 Byrne JAG Grant is
$25,079. The Oshkosh Police Department is the only eligible law enforcement agency in
Winnebago County to receive the grant, which creates a disparate allocation of funds
requiring a Memorandum of Understanding (MOU) to be signed with Winnebago County
officials indicating how the grant will be utilized. However, because our agencies both
have operational needs, this grant will be shared with the Winnebago County Sheriff'=s
Office. The City of Oshkosh will act as the fiscal agent for this grant, and the grant will
be administered by the Oshkosh Police Department.

The Oshkosh Police Department intends to utilize the grant funds to purchase additional
rifle and pistol ammunition and magazines, as well as Tactical "Go Bags" to carry the
ammo magazines to be deployed in thirty -eight (3 8) OPD vehicles, including all of our
marked vehicles and most of our detective unmarked vehicles. Twenty -eight (28)
marked and ten (10) unmarked police vehicles will each have four extra rifle and four
extra pistol magazines carrying approximately 100 -120 extra rounds of each type of
ammunition in each vehicle. The additional ammunition will supplement the tactical
protective equipment that is deployed in our daily use vehicles, and that was purchased
through a JAG grant in 2011 to further protect our officers during weapons and other
known high risk calls or incidents.
Furthermore, we will equip each of the twenty -eight (28) marked police vehicles with a
portable Rescue Individual Patrol Kit (IPOK) that would enable an officer to administer
immediate emergency quick clot first aid to an officer or citizen that has life threatening
injuries resulting from gunshot or other traumatic injuries during a critical incident until
more advanced life support services arrive. The cost of the ammunition, magazines, "Go-
Bags" and trauma hits is approximately $15,000.
The decision to equip our vehicles with additional protection for officers, additional
ammunition capability, and emergency first aid is based on recommendations from
professional law enforcement training organizations, a review of post critical 'incident
After - Action Reports, and from law enforcement agencies previously involved in active
shooter incidents.
The Winnebago County Sheriff's Office intends to purchase one (1) additional dog for a
K9 Unit to be used for daily operations and to assist in their drug enforcement activities.
The WCSO currently has one K9 Unit, and desires to increase the availability of K9 to
additional hours of the day and days of the week to support their needs as well as the
needs of other law enforcement agencies that currently do not have K9 capability. The
purchase cost of the K9 dog is approximately $10,000.
FISCAL IMPACT
No 2013 Oshkosh Police Department budget dollars will be used to support any of the
initial equipment purchases for this grant and there are no matching funds required.
Replacement of the ammunition, trauma kit components and magazines will be the only
cost in the future as these items are used or expired. After the initial 2 -3 year life of the
ammunition if not used, we will use this increased inventory of ammunition for regular
training and qualification annually, and reduce our practice ammunition needs.
For the Winnebago County Sheriff's Office, the on -going maintenance costs of the dog,
training certification of an officer handler, and other necessary K9 equipment in support
of the additional K9 dog will be purchased through other means by the Sheriff's Office,
but will not be a part of this grant.
SUMMARY
If approved, we intent to submit the application by the established deadline, accept the
grant funds as allocated and purchase the equipment indicated in this memo within the
established grant timelines and guidelines. The Oshkosh Police Department will act as
the fiscal agent for this grant.

MEMORANDUM OF LTNDERST.ANDING
BETWEEN THE CITY OF OSHKOSH POLICE DEPARTMENT
AND THE WINNEBAGO COUNTY SHERIFF'S OFFICE
Edward Byrne Memorial JUSTICE ASSISTANCE GRANT AG PROGRAM FY 2013
Local Solicitation Allocation
This agreement is made and entered into on June 10, 2013 by and between the Oshkosh Police
Department and the Winnebago County Sheriff's Office concerning the FY2013 justice Assistance
Grant GAG) Program allocation in the amount of $25,079. It is the understanding of each law
enforcement agency that the Oshkosh Police Department grill act as the fiscal agent for this grant
allocation and will assume the duties of all grant reporting and management in accordance with the
Bureau of justice stipulations and requirements.
Each law enforcement agency finds that the performance of this agreement is in the best interests of
both parties, that the undertaking will benefit the public and that the expenditure of the allocation as
outlined below is for the mutual benefit of those seared by both agencies.
Now, therefore, City of Oshkosh Police Department and the Winnebago County Sheriff's Office
agree that the following expenditures be assigned to this allocation:

The City of Oshkosh Police Department and the Winnebago County Sheriffs Office will purchase
various items, including equipment to support those agencies in the performance of their daily
operations to include:
A. OPD purchase of 152 Rifle (.223) Magazines, and 152 Pistol (.357) magazines fox police
marked and unmar vehicles in the amount of approximately $7,144.
B. OPD purchase of ammunition consisting of 3800 rounds of Rifle (.223), and 1824
rounds of Pistol (.357) for police marked and unmarked vehicles in the amount of
approximately $3,100.
C. OPD purchase of thirty -eight (38) "Go Bags" to carry and store the rifle and pistol
magazines and ammunition for each of the police vehicles in the amount of
approximately $2,470.
D. OPD purchase of Twenty, -eight (28) North American. Rescue Individual Patrol Officer
Kits (IPOK) with Medical Quick Clot Sport for marked police vehicles in the amount of
approximately $2,365.
E. WCSO purchase of one (1) K9 Unit dog for daily operational use in the amount of
approximately $10,000.

Sheriff's Department do not intend to create any obligations express or implied other than those set
