HomeMy WebLinkAbout06. 13-306 JUNE 25, 2013 13-306 RESOLUTION (CARRIED___6-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: GRANT EASEMENTS TO WISCONSIN PUBLIC SERVICE AT CENTRAL GARAGE PROPERTY / 639 WITZEL AVENUE INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant Wisconsin Public Service necessary easements on the Central Garage property at 639 Witzel Avenue, per the attached, and the proper City officials are hereby authorized and directed to execute any and all documents necessary for purposes of same. OfHKOfH oN THE WATEN TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: June 20, 2013 RE: Grant Easements to Wisconsin Public Service at Central Garage Property 1639 Witzel Avenue (Plan Commission recommends approval) BACKGROUND The Central Garage facility is currently located on approximately 12.3 acres of land along the south side of Witzel Avenue between Ohio Street and Idaho Street. The facility was originally constructed in the 1940's and has had building additions in 1964 and 1985. The property is in the early phases of complete site renovation and modernization which will take place over the next few years. The property is located in a mixed -use area with the uses to the north, east, and west being a mixture of commercial and institutional uses. The area to the south across W. 3rd Avenue is light industrial that borders the rear yard of residential uses along W. 4th Avenue. ANALYSIS The Central Garage project requires two easements for Wisconsin Public Service. The first ten -foot wide easement is needed to relocate a portion of an existing utility pole and overhead lines located on the site. The second 12 -foot wide by 95 -foot long easement is required to provide a new underground primary electric service to the site off of Witzel Avenue. The proposed easement locations are laid out so they will not conflict with proposed site improvements and/or other utility facilities and the easements will be non - inclusive which will allow other service providers to utilize the easement areas. The Department of Public Works and City Attorney are working with Wisconsin Public Service to have appropriate documents signed and recorded at the Winnebago County Register of Deeds and is needed as part of the renovation of the site. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its June 18, 2013 meeting. Approved, City Manager ITEM: GRANT PRIVATE UTILITY EASEMENT FOR PROPERTY LOCATED AT 639 WITZEL AVENUE (CENTRAL GARAGE) Plan Commission meeting of June 18, 2013 GENERAL INFORMATION Petitioner /Owner: City Administration Action Requested: The City of Oshkosh is requesting the granting of two private utility easements located on the City's Central Garage property, 639 Witzel Avenue. Staff supports the easement request as this will not have a negative impact on the City's or surrounding properties and is needed as part of the renovation of the site. RECOMMENDATION/CONDITIONS Staff recommends approval of the granting of the proposed private utility easements as requested. The Plan Commission approved of the utility easement as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site plan for the renovation of the Central Garage. He discussed the history of the site and reviewed the areas involved in the easement requests and explained the reasoning for said requests. There was no discussion on this item. Motion by Vajgrt to grant the easements for property located at 639 Witzel Avenue (Central Garage). Seconded by Cummings. Motion carried 5 -0. Gohde, Assistant Director of Public Works DATE: June 7, 2013 RE: Grant Easements, 639 Witzel Ave The Central Garage construction project requires Wisconsin Public Service (WPS) to relocate a portion of an existing utility pole and overhead line system located on the site. Additionally, a new primary electric service is needed to serve the site. In order to install these facilities, two easements are needed on property owner by the City. The easement along the northeast side of the property is proposed to be 10' wide to allow for the installation and maintenance of the relocated overhead lines. The easement to allow underground services to the new building is proposed to be 12' wide and extend south from Witzel Avenue approximately 95'. Both easement locations are laid out to avoid conflicts with the proposed site plans. The easement will be non - exclusive, allowing others utilities to utilize the easements.
