Ubrig, City Clerk DATE: June 7, 2013 RE: Review & Direction of Inactive Combination "Class B" Licenses A) D & F Investments, 30 Wisconsin Street B) Sister's Pizza & Subs, 1009 W. 911n Avenue C) The Spot 25 & Older Lounge, 2939 Jackson Street City ordinances provide that the failure to conduct a license - related business on a premise for which a license has been issued for any one year period is a violation of the city municipal code. If no license - related business is carried on for a one -year period, the council may consider non - renewal or revocation of the liquor license. In practice, when the City Clerk's office becomes aware that a licensed business appears no longer to be in operation, staff will attempt to contact the licensee or otherwise confirm that the business is no longer in operation and will make a notation in the license file indicating that the business is closed and the date. Each year at renewal time, the City Clerk's office reviews the applications and any establishments which appear to have not conducted business within the prior license year are asked to appear before the Council for consideration of whether the license has been used or should be renewed in light of the lack of use of the license within the preceding license year. In reviewing the file for inactive Combination "Class B" Licenses, the following meet that criteria: A) D & F Investments (Dennis Schwab) located at 30 Wisconsin Street — Inactive since August 2011 B) Sister's Pizza & Subs (Steven Sosnoski) located at 1009 W. 9 Avenue - Inactive since Spring 2012 C) The Spot 25 & Older Lounge (Robin Madrid) located at 2939 Jackson Street - Inactive since Spring 2012 PAMELA R. At this time, staff is looking for direction on these licenses, either by preparing a resolution for approval at the June 25 Council meeting or to start the non - renewal process.
