QJHKOfH ON 7NE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: May 23, 2013 RE: Accept Permanent Easement on West 23` Avenue from Oshkosh Corporation for Angled Parking (Plan Commission recommends approval) BACKGROUND Oshkosh Corporation is requesting the City of Oshkosh to accept a parking /sidewalk easement to allow construction of 16 angled parking stalls along W. 23` Avenue. The proposed easement will be located entirely on Oshkosh Corporation's property (2307 Oregon Street) adjacent to W. 23 Avenue. The site is currently used as a manufacturing facility for heavy military vehicles. The surrounding area is a mix of uses with industrial to the south, commercial to the north, low density residential to the east and Wittman Regional Airport to the west. ANALYSIS The City has scheduled reconstruction of W. 23` Avenue in the Capital Improvement Program for the summer of 2013. Oshkosh Corporation approached the City about incorporating angled on- street parking along the south side of W. 23` Avenue as part of the design of the new street. The Department of Public Works determined that the angled parking was possible however additional land outside of the existing right -of -way would be required. Oshkosh Corporation has agreed to grant a permanent easement for this purpose with the proposed easement area beginning 35 feet west of Oregon Street. The easement area will be 10.5 feet wide by 246 feet long and will accommodate 16 angled parking stalls and a wider sidewalk to compensate for vehicle overhang. The Department of Public Works and the City Attorney are working with the property owner to have appropriate documents signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its May 21, 2013 meeting. Approved City Manager ITEM: ACCEPT PARKING /SIDEWALK EASEMENT FOR PROPERTY LOCATED AT 2307 OREGON STREET Plan Commission meeting of May 21, 2013 GENERAL INFORMATION Petitioner /Owner: Oshkosh Corporation Action Requested: Oshkosh Corporation is requesting the City of Oshkosh to accept a parking/sidewalk easement to allow construction of 16 angled parking stalls along W. 23 Avenue. Applicable Ordinance Provisions: NIA Property Location and Type: The proposed easement will be located entirely on Oshkosh Corporation's property (2307 Oregon Street) adjacent to W. 23` Avenue. The site is currently used as a manufacturing facility for heavy military vehicles. The surrounding area is a mix of uses with industrial to the south, commercial to the north, low density residential to the cast and Wittman Regional Airport to the west. Analysis: The City of Oshkosh has scheduled W. 23` Avenue for reconstruction for the summer of 2013 and is included in the Capital Improvements Program. Oshkosh Corporation approached the City about incorporating angled on- street parking along the south side of 23 Avenue to the design of the new street. The Department of Public Works determined that adding the angled parking was possible; however, additional land outside the existing 23` Avenue right -of -way would be required. Oshkosh Corporation agreed to grant a permanent easement on the north side of their property for this construction. The Department of Public Works felt that the granting of an easement was more preferable versus right -of -way dedication due to a Iarge number of existing private utilities located in the proposed easement area. The proposed easement area is located on the south side of W. 23` Avenue, beginning approximately 35 feet west of the Oregon. Street right -of -way. The easement is 10.50 feet wide by 246 feet long (2,583 square feet) and will accommodate 16 angled parking stalls, including one ADA- compliant handicap stall. The easement is large enough to allow construction of wider sidewalk to compensate for vehicle overhang. The Department of Public Works and City Attorney is working with the property owner to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. Staff supports the easement request as this will not have a negative impact on the surrounding properties and will provide additional much needed parking for Oshkosh Corporation. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed sidewalk/parking easement as requested. The Plan Commission approved of the acceptance of the proposed easement. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area. He explained the reasoning for the easement request which would allow for the additional angled parking spaces. He reviewed the site plan for the parking area which would accommodate 16 stalls and the Department of Public Works and City Attorney will draft the necessary easement documents to be recorded at the Register of Deeds. Mr. Thorns questioned why 246 feet was necessary for the length of the easement and why it could not accommodate more than 16 parking stalls. Mr. Nau responded that angled parking stalls take up more space. David Patek, Director of Public Works, added that it would result in a narrower right -of -way but the angled parking was necessary as there was not enough area for 90 degree parking stalls. Mr. Thoms then questioned how much area the vehicles would occupy and if this was a low traffic flow street. Mr. Patek responded that there would be 11 feet for the travel lane which should be adequate and that it was a low traffic flow on this street. He further stated that there was a main entrance to the facility on 23 Avenue and a lot of driveways near the intersection of 23 Avenue and Montana Street however the traffic flow should have no issues east or west bound with the addition of the parking easement. Motion by Lohry to approve the acceptance of the parking /sidewalk easement for property located at 2307 Oregon Street. Seconded by Borsuk. Motion carried 7 -0. Gohde, Assistant Director of Public Works Sr� DATE: May 8, 2013 RE: Acceptance of Easement along W 23 Avenue Included in the 2013 Capital Improvement Plan is the reconstruction of W 23` Avenue between Oregon Street and Montana Street. Oshkosh Corporation owns the entire south side frontage in this area. Oshkosh Corporation, has approached the City about creating on- street angled parking in this area. In order to construct the angled parking, additional land area is needed along the south side of the street. Oshkosh Corporation has agreed to grant an easement to the City for the purposes of providing sidewalk and parking. The proposed easement will allow the creation of 16 angled parking stalls, including one American with Disabilities Act compliant handicap accessible parking stall. Widened sidewalk will be constructed along the curb to account for vehicle overhang and still allow for pedestrian access. An easement is being sought in place of dedication of right -of -way due to the large number of existing private utilities in the area of the easement.
