HomeMy WebLinkAbout27. 13-245MAY 14, 2013 13 -245 RESOLUTION (CARRIED 5 -1 P LOST LAID OVER WITHDRAWN PURPOSE: AUTHORIZE SUBMITTAL OF SITE ASSESSMENT GRANT APPLICATION TO WEDC ON BEHALF OF SIX RIVERS INVESTMENTS LLC FOR THE FORMER JELD -WEN PROPERTY ON WEST 6 AVENUE INITIATED BY: COMMUNITY DEVELOPMENT WHEREAS, the former Jeld -Wen property located at 228 West 6 Avenue was purchased by Six Rivers Investments, LLC in March, 2013 and they intend to redevelop the parcel; and WHEREAS, Six Rivers Investments, LLC plans to demolish the buildings and remediate the site for redevelopment; and WHEREAS, Six Rivers Investments, LLC has requested that the City apply for a WEDC Site Assessment Grant (SAG) to assist with site investigation, demolition and redevelopment of the site; and WHEREAS, Six Rivers Investments, LLC has agreed to pay the City's costs for application and administration of the SAG grant. NOW, THEREFORE, BE IT RESOLVED that the proper City officials are authorized and directed to execute any and all documents required for application for a WEDC Site Assessment Grant on behalf of Six Rivers Investments, LLC for the former Jeld -Wen property located on West 6 Avenue in the City of Oshkosh. BE IT FURTHER RESOLVED that upon approval and execution of an appropriate agreement with Six Rivers Investments, LLC for the reimbursement of City costs pertaining to the grant and if said grant is awarded, the proper City officials are hereby authorized and directed to accept such funds and take all necessary actions, pursuant to the terms of the grant. City of Oshkosh Community Development Department Of HKO H 215 Church Avenue, Oshkosh, WI 54901 ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: May 9, 2013 SUBJECT: Site Assessment Grant application to WEDC on behalf of Six Rivers Investments, LLC for the Jeld -Wen property on West 6 th Ave. BACKGROUND The City can submit a Site Assessment Grant (SAG) on behalf of the new owners of the Jeld -wen property, Six Rivers Investments, LLC. The Wisconsin Economic Development Corporation (WEDC) is the SAG administrator and would review and award the grant funding. The proposed grant of $149,840 will be matched by private funds from the Six Rivers Investments LLC. If WEDC awards the grant, the City would administer the grant funds. ANALYSIS The new owners of the Jeld-Wen property are planning to investigate, demolish buildings and remediate the site as soon as possible. The general schedule for the site is: • Demolition of existing buildings by the end of 2013. • Complete investigation activities by the end of 2013. • Project Planning and design — 2013 and early 2014. • Begin building construction in late 2014 or early 2015. The SAG funds and investor funds will be used largely in 2013 for: • Environmental Assessments — asbestos and other hazardous materials. • Site Investigation • Asbestos rem ovallabatement • Demolition of buildings, footings and foundations. The proposed layout of the redeveloped site would include commercial and a range of residential options. The proposed layout of the site could change based on the Site Assessment and market conditions. The Site Plan for the redevelopment would come before the Plan Commission and City Council for approval at a future date, after the Site Assessment has been completed. The private developers, Six Rivers Investments, LLC will provide the matching funds of $643,160. With the $149,840 SAG, the project cost would total $793,000. City staff is working with the developers to prepare an agreement that will transfer the grant matching fund requirement and other grant requirements from the City to the developers. Staff will bring that agreement forward for City Council approval prior to the City accepting the SAG grant. FISCAL IMPACT There are no City funds included in the SAG grant application or the implementation. City staff will be provided for the grant administration. RECOMMENDATION The City Council authorizes the submittal of a Site Assessment Grant application to WEDC on behalf of Six Rivers Investments, LLC for the Jeld -Wen property. Approved, - 4. 444 Manager April 15, 2013 City of Oshkosh Attn: Oshkosh Common council, c/o Mien Davis 215 Church Avenue Oshkosh, WI 54901 RE: Former JELD WEN property redevelopment Site Assesment Grant application Dear Allen, This letter accompanies a Wisconsin Economic Development Corporation (WEDC) Brownfield Site Assessment Grant (SAG) application, for the former JELD WEN manufacturing property located at 6 and Oregon Street in Oshkosh. This grant will assist with continued environmental investigation, demolition activities, and sub - surface investigation and characterization for the 27 acre redevelopment parcel. The property has been in use as a manufacturing parcel, producing wood windows and doors for over 100 years. The SAG grant will lever state investment to speed redevelopment of the former industrial parcel to our plan for mixed residential and commercial use. The SAG grant activities will aid in removing buildings, where prior enviromnental characterization has been limited and conducting additional investigation in other areas of the site where future buildings and public infrastructure are planned. While the city of Oshkosh is the applicant, our development team is providing all funds and contract obligations for the investigation activities outlined within the application. After activities are complete, we submit to WEDC for reimbursement of eligible grant activities for reimbursement. Sincerely you , rant .Schwab Managing Member Six Rivers Investments, LLC COMMUNITY ASSISTANCE ENVIRONMENTAL ASSESSMENTS Wisconsin's Brownfield Site Assessment Grant (SAG) Program provides grant funds to approved projects to assist local governments with conducting initial environmental assessment and demolition activities on an eligible abandoned, idle or underutilized industrial or commercial site. HOW IT WORKS Village, Town, County or redevelopment authority can apply An applicant that caused the contamination is ineligible. ELIGIBILITY REQUIREMENTS The Viable Causer concern must be addressed in each project and means that it needs to be demonstrated that the party that caused the contamination is unknown, can't be located, or does not have the resources to contribute to the environmental investigation of the soil and 1 or groundwater. The applicant must show that access to the property to conduct the environmental assessment activities has been approved. ELIGIBLE ACTIVITIES SAG Funds can reimburse the following activities that were initiated after an award letter is issued for a project: The investigation of environmental contamination on an eligible site or facility for the purpose of reducing or eliminating soil and or groundwater contamination. The demolition of any structures or buildings located on an eligible site. Asbestos abatement associated with demolition activities. The removal of abandoned containers and the removal of underground hazardous storage tank systems. Soft costs are not reimbursable by the SAG Program. Attorney fees, accountant costs, and consultant billings to complete an application on behalf of a community are not reimbursable. 201 W.
