HomeMy WebLinkAbout26. 13-244APRIL 23, 2013 MAY 14, 2013 13 -219 13 -244 ORDINANCE FIRST READING SECOND READING (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVAL OF TEMPORARY PARKING ON THE WEST SIDE OF SUMMIT AVENUE DURING NEW YORK AVENUE STREET CONSTRUCTION PROJECT INITIATED BY: TRAFFIC REVIEW ADVISORY BOARD A GENERAL ORDINANCE OF THE CITY OF OSHKOSH PERTAINING TO PARKING REGULATIONS ON SUMMIT AVENUE. WHEREAS, parking on the west side of Summit Avenue between New York Avenue and Congress Avenue is prohibited by Section 27A -11 of the City of Oshkosh Municipal Code; and WHEREAS, construction on New York Avenue is anticipated to create a parking shortage in that area during the construction period that cannot be adequately addressed through other available on street parking within the immediate area. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That the parking prohibition on the west side of Summit Avenue between New York Avenue and Congress Avenue, as provided in Section 27A -11 of the Oshkosh Municipal Code, is not in effect between the dates of May 15, 2013 and November 1, 2013. SECTION 2. That this ordinance shall repeal automatically on November 1, 2013 without any further action of the Council being necessary and shall be of no further force and effect. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #13 -244 (APPROVAL OF TEMPORARY PARKING ON THE WEST SIDE OF SUMMIT AVENUE DURING NEW YORK AVENUE STREET CONSTRUCTION PROJECT) on May 14, 2013. DATE: April 17, 2013 RE: Explanation of Traffic Regulations Ordinance Changes SECTION 1: SECTION 27A -1 SECTION 1: SECTION 27A -11 DESIGNATED PARKING RESTRICTIONS A REQUEST FOR UNRESTRICTED PARKING ON THE WEST SIDE OF SUMMIT AVENUE FROM NEW YORK AVENUE TO CONGRESS AVENUE FROM MAY 15, 2013 AND NOVEMBER 12013. (CURRENT CONDITION: NO PARKING.) This is a business request. This year's reconstruction of New York Avenue will result in a reduction of some on- street parking at the western end of the street. In order to enhance on- street parking options, it was suggested that the current parking restriction on the west side of Summit Avenue be reconsidered, both during and after the construction project is complete. This restriction was enacted in 1987, when the street was 21 feet in width. This local street is now 36 feet in width, which is typically wide enough to allow on- street parking on both sides of the street. As the Wiouwash Trail currently uses this section of Summit Avenue, the Bicycle and Pedestrian Advisory Committee was asked to provide a recommendation. They recommended that parking be allowed only during this year's construction project. They recommended against making this change permanent, given concern over bicycle and pedestrian safety on this part of the trail. Rohloff, City Manager FROM: Christopher Strong, Transportation Director (' DATE: April 17, 2013 RE: Items Defeated by the Traffic Review Board at their April 9, 2013 Meeting A REQUEST FOR NO PARKING ON THE SOUTH SIDE OF LINWOOD AVENUE FROM VINLAND STREET TO ONTARIO STREET ON SCHOOL DAYS BETWEEN 7:00 A.M. AND 6:00 P.M. (CURRENT CONDITION: NO BUS PARKING.) And A REQUEST FOR UNRESTRICTED PARKING ON THE NORTH SIDE OF LINWOOD AVENUE FROM VINLAND STREET TO ONTARIO STREET. (CURRENT CONDITION: NO BUS PARKING.) This is a citizen request. The person making this request is concerned over the prevalence of parking on this street when activities are occurring at the athletic fields. With GO Transit bus service now running on Linwood Avenue, the citizen is concerned that parking on both sides of the street, with the bus intermittently stopping to pick up and drop off passengers, could create some congestion and safety problems. The citizen also expressed concern that on- street parking can limit visibility for vehicles turning off of Beech Street onto Linwood Avenue. The first of these two requests would eliminate parking on the south side of the street during times and days when athletic field - related traffic is expected to be the most significant. The second request would provide greater clarity for parking restrictions on the north side of the street, which should simplify parking enforcement. The pavement width west of Walnut Street is 32 feet; east of Walnut Street it is 36 feet. Typically, on- street parking restrictions are not considered for local streets when the pavement width is at least 34 feet. However, the higher demand for on- street parking in this area during events means that the effective street width is reduced for a larger portion of the day. This may increase the likelihood of accidents involving parked cars, especially during times of day when traffic volumes are higher. Though the likelihood of these crashes is higher, it should be noted that a review of crash data from 2002 -2011 showed no reported crashes in this area that involved on- street parking. The board has considered parking restrictions in this area previously. In 2003, the Traffic Review Advisory Board received a request to prohibit parking on the north side of Linwood Avenue between Walnut Street and Ontario Street, due to on- street parking ITEMS DEFEATED 2 APRIL 2013 occurring during activities at the adjacent athletic fields. This request was rejected due to concerns from neighbors. In 2005, the board reviewed a similar request, this time to prohibit parking on the north side of Linwood Avenue between Vinland Street and Ontario Street. The board ended up recommended an amended request which prohibited bus parking on both sides of this section of Linwood Avenue; this amended request was subsequently approved by the Common Council. Based on the citizen's concern, the bus parking prohibition has not addressed the basic challenges in this area. The fact that there are more residential driveways on the south side of the street may mean that residents would prefer that any parking prohibition be on the north side of the street. However, this may not be a good fit with the activities at the athletic fields. The board's previous two discussions in 2003 and 2005 indicate that neighborhood input has been a significant factor in shaping what, if any, parking restrictions exist on this street. Excerpt from the Traffic Review Advisory Board meeting minutes: Mr. David Schwartz, 1125 Linwood Avenue, was opposed to this request and request 45. He said the only area congested is by the church. Otherwise, there is not much congestion from Beech Street to Vinland Street. He noted previously there had been a bus route on this street and there had been no problems. Mr. William Meyer, 1105 Linwood Avenue, agreed with Mr. Schwartz. He said the present parking restriction works fine. He likes to have on- street parking available in front of his home. He was opposed to this request and item #5. Mr. Schuster noted the requestor did not show up for this meeting and these two property owners were opposed to the request. He would oppose it.
