CITY OF OSHKOSH—SOUTH PARK MASTER PLAN SCOPE OF WORK PLANNING SERVICES d. Review existing site features and amenities and conditions (i.e. pavilions, restrooms, fishing locations, play areas, open space, etc). e. Soils and bedrock. f. Major vegetation types and locations. g. Erosion and lagoon bank erosion h. Environmentally sensitive areas. i. Existing street locations and vehicle access points. j. Develop final list of needs to be considered in Conceptual Plan development of park. 13. Develop list of uses, suggestions, maintenance requirements,etc. III South Park Storm Water Management Concept Planning A. Background The existing wet ponds within South Park serve as storm water management facilities. Runoff from a large area of the Stringham Creek watershed is piped via City storm sewers directly to the ponds within South Park. Storm water flows exit South Park through a large box culvert that flows beneath Ohio St. (STH 44). The City has plans to improve both water quality and peak flow attenuation capabilities of the ponds within South Park as part of the City's overall approach to storm water management within the Stringham Creek water shed. EI RETTLER corporation CITY OF OSHKOSH PROFESSIONAL SERVICES AGREEMENT: PLANNING SERVICES- SOUTH PARK MASTER PLAN THIS AGREEMENT, made on the 6th day of March, 2013, by and between the CITY OF OSHKOSH, party of the first part, hereinafter referred to as CITY, and RETTLER CORPORATION, 3317 Business Park Drive, Stevens Point,WI 54482, referred to as the CONSULTANT, WITNESSETH: That the City and the Consultant, for the consideration hereinafter named, enter into the following agreement. The Consultant's proposal is attached hereto and reflects the agreement of the parties except where it conflicts with this agreement, in which case this agreement shall prevail. ARTICLE I. PROJECT MANAGER A. Assignment of Project Manager. The Consultant shall assign the following individual to manage the project described in this contract: (Jeff Bahling, Senior Landscape Architect, Rettler Corporation) B. Changes in Project Manager. The City shall have the right to approve or disapprove of any proposed change from the individual named above as Project Manager. The City shall be provided with a resume or other information for any proposed substitute and shall be given the opportunity to interview that person prior to any proposed change. ARTICLE II. CITY REPRESENTATIVE The City shall assign the following individual to manage the project described in this contract: (Ray Maurer, Parks Director) ARTICLE III. SCOPE OF WORK The Consultant shall provide the engineering services described in the Consultant's "City of Oshkosh- South Park Master Plan Scope of Work" proposal dated 4/4/2013. If anything in the Consultant's proposal conflicts with this agreement, the provisions in this agreement shall govern. The Consultant may provide additional products and/or services if such 1 • products/services are requested in writing by the Authorized Representative of the City. ARTICLE IV. CITY RESPONSIBLITIES The City shall furnish, at the Consultant's request, such information as is needed by the Consultant to aid in the progress of the project, providing it is reasonably obtainable from City records. To prevent any unreasonable delay in the Consultant's work the City will examine all reports and other documents and will make any authorizations necessary to proceed with work within a reasonable time period. ARTICLE V. TIME OF COMPLETION The work to be performed under this contract shall commence immediately and work will be completed no later than May 1 , 2013 unless both parties agree to extend the completion date in writing. ARTICLE Ill. PAYMENT A. The Contract Sum. The City shall pay to the Consultant for the performance of the contract the sum of $20,865, adjusted by any changes hereafter mutually agreed upon in writing by the parties hereto. Fee schedules shall be firm for the duration of this Agreement. B. Method of Payment. The Consultant shall submit itemized monthly statements for services. The City shall pay the Consultant within 30 calendar days after receipt of such statement. If any statement amount is disputed, the City may withhold payment of such amount and shall provide to Consultant a statement as to the reason(s) for withholding payment. C. Additional Costs. Costs for any additional services are to be negotiated and set forth in a written amendment to this agreement executed by both parties prior to proceeding with the work covered under the subject amendment. ARTICLE IV. CONSULTANT TO HOLD CITY HARMLESS The Consultant covenants and agrees to protect and hold the City of Oshkosh harmless against all actions, claims and demands of any kind or character whatsoever which may in any way be caused by or result from the intentional or negligent acts of the Consultant, his agents or assigns, his employees or his subcontractors related however remotely to the performance of this Contract or be caused or result from any 2 violation of any law or administrative regulation, and shall indemnify or refund to the City all sums including court costs, attorney fees and punitive damages which the City may be obliged or adjudged to pay on any such claims or demands within thirty (30) days of the date of the City's written demand for indemnification or refund. ARTICLE V. INSURANCE The Consultant shall provide insurance for this project that includes the City of Oshkosh as an additional insured. The specific coverage required for this project is identified on a separate document. ARTICLE VI. TERMINATION A. For Cause. If the Consultant shall fail to fulfill in timely and proper manner any of the obligations under this Agreement, the City shall have the right to terminate this Agreement by written notice to the Consultant. In this event, the Consultant shall be entitled to compensation for any satisfactory, usable work completed. B. For Convenience. The City may terminate this contract at any time by giving written notice to the Consultant no later than 10 calendar days before the termination date. If the City terminates under this paragraph, then the Consultant shall be entitled to compensation for any satisfactory work performed to the date of termination. This document and any specified attachments contain all terms and conditions of the Agreement and any alteration thereto shall be invalid unless made in writing, signed by both parties and incorporated as an amendment to this Agreement. South Park, one of Oshkosh's oldest community parks, is a major landmark enjoyed by many residents. The park contains three large lagoons that provide aesthetic and recreational use. These lagoons also provide regional storm water management. The park contains a splash pad, hard courts, shelter buildings, playground equipment, wooded areas, etc. Extensive use, the age of park amenities and utility infrastructure substantiates the need for a newly developed Master Plan. The proposed planning effort recognizes the need to plan for possible redevelopment of the existing shelters, vehicular and pedestrian circulation, and active recreation courts, play areas and associated utility service upgrades. The continued use of lagoons for regional and localized storm water, water quality and the ongoing use for fishing and aesthetic value will also be reviewed. This plan will provide the City a vision for the future. This study will include a summary of the design process, plan components with options, redevelopment costs and a phasing plan for development. PROJECT APPROACH I. Project Planning A. Kick-off Meeting Conduct a preliminary project meeting with City Staff to define the final project scope and identify the split of duties between the City Staff and Consultant Staff. B. Prepare a detailed project plan; identify tasks, responsibilities, and deliverables. The project plan will be based on the proposed project approach. C. Establish a project timeline; identify start and completion dates of all major project phases. II. South Park Conceptual Plan A. Data Gathering 1. Utilize City of Oshkosh GIS CADD Engineering/Planning Division for all base mapping. 2. Review existing survey and/or as-built mapping for private utilities, elevations, etc as provided by City of Oshkosh. 3. Review City of Oshkosh Storm Water Report. B. Site Analysis 1. Prepare base map of existing site and analyze site features and issues. a. Topography and slope. b. Views and vistas(positive and negative). c. Existing drainage features and patterns. tedpik RETTLER r corporation *aE � ry ds CITY OF OSHKOSH—SOUTH PARK MASTER PLAN SCOPE OF WORK PLANNING SERVICES The water quality of the ponds within South Park has been maintained at a level above what could be typically expected of an urban pond with significant urban storm water contributions. This enhancement in water quality has been achieved due to the constant daily discharge of approximately 1.5 million gallons of groundwater from a nearby open pit gravel quarry operation. The quarry is located approximately 2,000 feet west of South Park. The quarry has a finite operational life that has not been accurately quantified by the current owners. If the quarry were to cease operation of its dewatering pumps and cease discharge of the groundwater to the South Park ponds, significant and rapid changes in water quality would be experienced within the South Park ponds. Planning for comprehensive improvements to the recreation facilities within South Park must acknowledge the necessary interface with the City's upcoming storm water facility improvements as well as the potential change in water quality if / when the nearby gravel quarry ceases to discharge groundwater to ponds within the park. B. To address these issues as part of the overall South Park Master Plan, Rettler proposes the following scope of services: 1. Meet with the City Engineering Division to review comprehensive goals for the South Park ponds as they relate to proposed Stringham Creek water shed improvements 2. Obtain data from existing base mapping that depicts the size and location of storm sewer outfalls into the ponds at South Park 3. Obtain hydraulic / hydrologic modeling data supplied by others that defines the anticipated peak storm water flows and the water surface elevations on the South park Ponds at the 2, 25 and 100 year storm events 4. Obtain "depth to sediment" measurements within the pond limits to define the current sediment surface within the South park ponds. 5. Evaluate possible consolidation and pre-discharge suspended solids removal mechanisms for the storm sewer outfalls that discharge to the South Park ponds. a. Prepare a plan showing all storm sewer outfall sizes and locations. b. Obtain estimates of suspended solids loading by outfall from others c. Identify best management practices (BMP's) that could be installed on the outfalI pipes upgradient of their discharge in to the South Park ponds d. Develop a plan for consolidation of storm sewer outfalls and establishment of pre-discharge BMP's to reduce sediment deposition in the ponds e. Evaluate ongoing bank erosion around the perimeter of the ponds. a. Prepare a plan showing the limits and extent of bank erosion b. Identify options for dealing with bank erosion including 1.Creating wetland buffers between the pond surface and the upland zones 2.Re-grading the pond fringe and installing permanent erosion mat 3. Utilizing limestone block as bank protection and aesthetic enhancement c. Develop a plan for bank improvements d. Develop an estimate of probable construction cost for the proposed bank improvements 7. Evaluate the potential impact of suspending the supplemental quarry dewatering discharge in to the South Pond Park a. Verify the current average water temperature in the ponds. b. Contact local pond specialist(s) to obtain estimates of anticipated increases in water temperature and accompanying degradation of water quality should the dewatering discharge be discontinued. c. Identify alternative water quality improvement actions to offset probable pond degradation consequences associated with the suspension of the dewatering discharge d. Develop an estimate of probable construction cost for the proposed water quality improvement actions IV. Concept Plan Development A. Provide up to two (2) concept plan layouts, which combine all elements from the site analysis, development program, and storm water concept. B. Workshop Session at Advisory Park Board Meeting to discuss/review the following: 1. Design appeal. 2. Accessibility. 3. Phasing considerations. 4. Environmental impacts. 5. Implementation and constructability. 6. Operational impacts and maintenance considerations. C. Document positive and negative items and consider all input into Conceptual Plan development. D. Refine conceptual plan and review preliminary cost estimates with Owner. E. Review conceptual plan and final cost estimates. I. Submit line item cost estimates for all improvements, based on 2012 construction costs of similar projects completed by Rettler Corporation. I. Submit Phasing development scenario. J. Provide one (1) 24" X 36" color rendering of the Conceptual Plan and electronic format PDF. V. Attendance at Advisory Park Board and/or City Council Meetings A. Meet periodically, throughout the planning process, to meet with City Staff and project team members to review findings, plan components, and update schedule. B. Conduct user group meetings for planning process; including need gathering sessions, review of draft plan document, and final document. C. Prepare presentation to Advisory Park Board of the South Park Conceptual Plan for approval. D. Attend meetings for project. 1. South Park Master Plan a. One(1) meeting with various stakeholders/user groups. b. Two (2) meetings with City Storm Water and Engineering Staff c. Three(3) meetings with the City Park Staff. d. One (2) Advisory Park Board or City Council meeting presentation. e. Ongoing contact with Parks Director. VI. Compensation for Services A. All payments will be billed on a time and materials basis against the "Not to Exceed"total. B. If the Owner changes the Scope of Services after initiation of services, the Consultant has the right to renegotiate the compensation for the charged services. C. All governmental fees will be paid directly by the Owner. D. Construction Documents are not included in this planning proposal. E. GeotechnicaI testing and or topographic mapping not included in this proposal F. Periodic invoices will be submitted on a 30-day basis.
