WHEREAS, it appears that the public interest requires that that portion of the
following described street or alley within the City of Oshkosh be vacated and
discontinued:
Partial Street Vacation / West Waukau Avenue & Knapp Street
As described in the attached “Exhibit A”
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that a hearing on the passage of the following resolution shall be held before
the Common Council in the Council Chambers in the City Hall, City of Oshkosh,
Winnebago County, Wisconsin, on Tuesday, May 14, 2013 at 6:00 PM of said day and
the proper City officials are hereby authorized and directed to give notice of said hearing
by personal service and publication of said hearing as provided by law.
BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh
pursuant to Section 66.1003(4) of the Wisconsin Statutes, that it is hereby declared that
since the public interest requires it, that portion of the following described street or alley

Knapp Street Adjacent to Wittman Regional Airport (Plan Commission recommends
approval)
BACKGROUND
Council is being asked to set a public hearing date for a proposed right -of -way vacation for portions of
W. Waukau Avenue and Knapp Street. The land to be vacated will be utilized as part of a perimeter
fencing project of the airport grounds as well as including sections of street right -of -way that have only
served the airport and its facilities for the past several years. State Statutes require that the public
hearing be held no less than 40 days after the introductory resolution which would set the public
hearing date for this request no earlier than the Council's May 14th meeting.

The subject vacations involve an approximately 1,510 foot (2.29 acre) section of W. Waukau Avenue
and a 1,634 foot (2.48 acre) section of Knapp Street. Both sections are located within the Wittman
Regional Airport grounds. Access to most of these sections of right -of -way are currently restricted to
the general public, with security gates located at the south end of the proposed Knapp Street vacation
and at the intersection of W. Waukau and Knapp Street. The lands adjacent to the proposed
vacations are entirely owned by Winnebago County; therefore, the vacated right -of -way will be
attached to County -owned land. The vacations will also allow the County to construct their proposed
fencing within the current right -of -way areas without a privilege in the right -of -way permit, as the land
will no longer be public. The Department of Public Works has reviewed the proposed vacation and
does not see any issues or concerns with the request as the right -of -way is not needed, but requires
retention of full utility easements within the former rights -of -way.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its March 19, 2013 meeting.

GENERAL INFORMATION
Applicants: Omruri Associates, Winnebago County
Owners: City of Oshkosh, Winnebago County
Actions Requested:
The applicant requests the vacations of portions of W. Waukau Avenue and Knapp Street public
right -of -way and two right -of -way dedications; the first located at the new eastern terminus of W.
Waukau Avenue and the other at the new northern terminus of Knapp Street.
Applicable Ordinance Provisions:
WI State Stats. 66.1003 regulate the discontinuance of a public right -of -way.
Property Location and Background Information:
The area in this request involves the Wittman Regional Airport, approximately 1,400 acres of land
comprised of several parcels, generally located south of W. 20"' Avenue, east of U.S, Highway 41,
West of Oregon Street, and north of Fisk Avenue. The airport property contains several aviation -
related uses ranging from hosting the annual EAA AirVenture, aircraft maintenance and storage
facilities, and general aviation related services. The airport is in the process of constructing new
perimeter fencing around the airport to meet FAA recommendations to better secure the site from
the general public and wildlife.

ITEM A -- RIGHT -OF -WAY VACATION
ANALYSIS:
The vacations involve an approximately 1,510 foot (2.29 acre) section of W. Waukau Avenue and
a 1,634 foot (2.48 acre) section of Knapp Street. Both sections are located within the Wittman
Regional Airport grounds. Access to most of these sections of right -of -way are currently_ restricted
to the general public, with security gates located at the south end of the proposed Knapp Street
vacation and at the intersection of W. Waukau and Knapp Street.
The vacation request is being made at this time to coincide with a perimeter fencing project of the
airport grounds this spring. In addition, the petitioners state that this request is long overdue as
these sections of street have only served the airport and its facilities for the past several years. The
lands adjacent to the proposed vacations are entirely owned by Winnebago County; therefore, the
vacated right -of -way will be attached to County -owned land. The vacations will also allow the
County to construct their proposed fencing within the current right-of-way areas without a
privilege in the right-of-way permit, as the land will no longer be public.
The Department of Public Works has reviewed the proposed vacation and does not see any issues
or concerns with the request as the right -of -way is not needed, but requires retention of full utility
easements within the former rights -of -way.
Staff is comfortable with this request as the current right -of -way more or less serves as vehicular
access to the airport grounds and not used by the general public. The vacation will not have a
negative impact on the surrounding land uses or change the character of the area.

ITEM B — W. WAUKAU AVENUE RIGHT -OF -WAY DEDICATION
ANALYSIS:
The petitioners are proposing a 5,750 square foot right -of -way dedication at the proposed easterly
terminus of W. Waukau Avenue to accommodate construction of a new cul -de -sac. The proposed
50 -foot radius bulb will be offset to the north onto County property. The cul -de -sac is needed to
provide a turnaround area for protective services and Public Works vehicles.

The certified survey map which will be used to describe the dedication shows several structures
located within the proposed right-of-way including a County Sherriff's building, fencing and
several private utilities serving the building. Private structures are not allowed in public right -of-
way; therefore all non - public structures shall be removed or properly abandoned from the
proposed right -of -way area prior to the City signing the final certified survey /right -of -way
dedication.
Construction of the cul -de -sac will be paid for entirely by Winnebago County. The Department of
Public Works, City Attorney and The County is or will be working on a Developers Agreement to
ensure the cul -de -sac is constructed to City standards.
Staff does not have any concerns with the proposed dedication as it will meet the needs of the
Oshkosh Fire Department and the Department of Public Works and will not negatively impact the
area.
ITEM C — KNAPP STREET RIGHT -OF -WAY DEDICATION
ANALYSIS:
The petitioners are proposing a 4,784 square foot right-of-way dedication at the proposed northerly
terminus of Knapp Street to encompass an existing cul -de -sac south of an existing security gate
leading into the airport property. The existing 35-foot radius paved bulb meets the minimum
turnaround area for protective service and Public Works vehicles.
The certified survey map which will be used to describe the dedication does not show any private
structures however aerial imagery shows fencing outlining the west side of the existing paved area
Private structures are not allowed in public right -of -way; therefore all non - public structures shall
be removed from the proposed right -of -way area prior to the City signing the final certified
survey /right -of -way dedication. The petitioner is aware of the fencing and stated that the fencing
will be removed and reconstructed as part of the perimeter fencing project.
Staff does not have any concerns with the proposed dedication as it will meet the needs of the
Oshkosh Fire Department and the Department of Public Works and will not negatively impact the
area.
RECOMMENDATION /CONDITIONS
ITEM A:
Staff recommends approval of the partial vacations of W. Waukau Avenue and Knapp Street as
requested with the following condition:
1) The City retains full utility easements within the vacated right -of -way.
ITEM B:
Staff recommends approval of the right -of -way dedication at the easterly terminus of W. Waukau
Avenue as requested with the following conditions:

The Plan Commission approved of the street vacations and dedications as requested with
conditions noted. The following is the Plan Commission's discussion on this item.
Mr. Nau presented the street vacation requests and reviewed the site and surrounding area as well
as the land use in said area. He discussed the proposed street vacations and reviewed the current
street layout and the fencing project to be completed at Wittman Field in spring. He explained that
the proposed street vacation areas had not been used for public right- of-way in the past several
years and the vacation requests, if approved, should not have any negative impact on the area.
Mr. Nau presented the right -of -way dedication request on W. Waukau Avenue which is in
conjunction with the proposed street vacations and reviewed the right-of-way dedication area
which would be for the construction of a cul -de -sac. The costs related to this construction would
be at Winnebago County's expense and any private facilities located in this area would have to be
removed.
Mr. Nau also presented the right-of-way dedication request on Knapp Street and stated that a cul-
de -sac already existed on the site. This request was also in conjunction with the street vacation
requests.
Mr. Nau reviewed the conditions recommended for each of the three requests.
There was no discussion on these items.
Motion by Thorns to approve the partial street vacation of W. YVaukatt Avenue east and
ivest of Knapp Street and Knapp Street south of TV Waukau Avenue all located adjacent to
Wittman Regional Airport with the following conditions:

Proposed Vacation of West Waukau Avenue_ and Knapp Street Road Narrative
We are proposing to vacate a portion of West Waukau Avenue and Knapp Street
Road. We are proposing to vacate both roads inside the new Wittman Field
Perimeter Fence that is being built this spring. Both roads are no longer used for
roads. Neither road is used for local traffic. Both roads are now gated to stop
public access onto Wittman field and EAA grounds. These two roads are generally
used as service roads for daily use of EAA and Wittman Field personnel. There is
no reason to leave either road as a dedicated roadway when it is not used as
such.

Proposed West Waukau Avenue CSM Narrative
We are proposing to dedicate land for a cul -de -sac and storm water detention
pond. We are proposing this dedication at the end of West Waukau Avenue
where the new Wittman perimeter fence will be crossing the road. At this
location there will be a gate to allow people with authorized access to the airport
and EAA grounds. Also within this dedication the City of Oshkosh has required a
storm water detention pond so that they have access to the pond for
maintenance.

Proposed Knapp Street Road CSM Narrative
We are proposing to dedicate land for the proposed cul-de -sac. An existing cul -de-
sac is present in this location which encroaches outside the current right -of -way
of Knapp Street Road. We are proposing this dedication at the end of Knapp
Street Road where the new Wittman perimeter fence will be crossing the road. At
this location there will be a gate to allow people with authorized access to the
airport and EAA grounds. The cul -de -sac shape represents a border between the
current pavement for the existing cul -de -sac and one of the gravel service roads
that EAA now uses.
