HomeMy WebLinkAbout17. 13-139 MARCH 26, 2013 13-139 RESOLUTION (CARRIED__6-0__ LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: APPROVE SPOT BLIGHT DESIGNATION; AUTHORIZE REDEVELOPMENT AUTHORITY TO ACCEPT PROPERTY AT 349 WEST 7TH AVENUE INITIATED BY: COMMUNITY DEVELOPMENT REDEVELOPMENT AUTHORITY RECOMMENDATION: Approved WHEREAS, the Redevelopment Authority of the City of Oshkosh was created to assist in the elimination and prevention of blight and blighting influences and to promote urban renewal; and WHERES, per Section 66.1333, Wisconsin Statutes, the Redevelopment Authority may spot blight and acquire blighted property without designating a boundary or adopting a redevelopment plan; and WHEREAS, Gerald and Rita Lauer have generously offered to donate to the Redevelopment Authority the property at 349 West 7th Avenue, and said property is not within a designated redevelopment area; and WHEREAS, the Redevelopment Authority conducted a public hearing and approved a determination that the property at 349 West 7th Avenue is blighted and in need of rehabilitation and blight elimination. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the property at 349 West 7th Avenue is hereby declared blighted pursuant to the provisions of Section 66.1333, Wisconsin Statutes. BE IT FURTHER RESOLVED by the Common Council that a comprehensive redevelopment plan is not necessary to determine the need for acquisition and redevelopment of said property. MARCH 26, 2013 13-139 RESOLUTION CONTD BE IT FURTHER RESOLVED that the City of Oshkosh expresses its utmost gratitude and appreciation to Gerald and Rita Lauer for their generous donation. BE IT FURTHER RESOLVED that the proper Redevelopment Authority officials are authorized and directed to accept said conveyance of land and to execute all documents necessary to consummate said transaction. OJHKOJH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis Community Development Director DATE: March 21, 2013 RE: Approve Spot Blight Designation; Authorize Redevelopment Authority to Accept Property at 349 West 7th Avenue BACKGROUND/ANALYSIS The owner of the property at 349 West 7th Avenue approached the RDA/City regarding donating the property. The property was a single family rental and is currently vacant and uninhabitable. The tenant had made improvements to the property without permits. The owner has indicated they are not able to make the necessary improvements to bring the property up to code. The Redevelopment Authority (RDA) held a public hearing on March 20, 2013 to hear comments on the proposed spot blight designation of the property. The property is not within a designated redevelopment area, and as such, must be spot blighted in order for the RDA to acquire, or accept, the property. No one appeared at the March 20th RDA public hearing. Per Wisconsin Statutes, Council needs to approve the spot blight designation as well as authorize the RDA's acquisition (acceptance) of the property. FISCAL IMPACT The house may be either rehabilitated and resold, or razed and the lot sold for construction of a new single family home. A determination will be made once the property has been transferred to the RDA and an evaluation of the property can be made. Community Development Block Grant funds will be used for closing costs associated with this donation.
