PURPOSE: AUTHORIZE REVISED AWARD OF DAMAGES RELATED TO THE
JURISDICTIONAL OFFER TO ACQUIRE LAND FOR THE
NATIONAL GUARD ARMORY AREA STORM WATER DETENTION
BASIN PROJECT
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, on November 23, 2010, by Resolution No. 10-364, the Common
Council previously approved a Relocation Order pursuant to Sections 62.22 and 32.05 of
the Wisconsin Statutes declaring that it was in the public interest for the City of Oshkosh to
acquire a portion of 1508 South Koeller Street for stormwater detention in the Campbell
Creek Drainage Basin; and
WHEREAS, the Common Council on November 8, 2011 by Resolution 11-495
approved the purchase of the land at 1508 South Koeller Street for a purchase price of
$920,000.00; and
WHEREAS, the Common Council on October 9, 2012 by Resolution 12-497
approved a Jurisdictional Offer for the property located at 1508 South Koeller Street in the
amount of $920,000.00; and
WHEREAS, the property owner has requested a revision of the award to
$970,000.00 based upon an appraisal of the property.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the Award of Damages as established in Resolution 12-497 is hereby
revised to $970,000.00.
BE IT FURTHER RESOLVED that the proper City officials are further authorized
and directed to sign any documents and take any and all other actions necessary to
accomplish this purpose.
BE IT FURTHER RESOLVED that the money for this purpose is hereby
appropriated from:

RE: Authorize Revised Award of Damages Related to the Jurisdictional Offer to Acquire Land for the
National Guard Armory Area Storm Water Detention Basin Project
BACKGROUND
On November 23, 2010, the Common Council approved a relocation order relating to the purchase of property
located immediately east of the new Best Buy Store. This area is a portion of the former Menard's Store
Complex. The City has officially mapped this property for construction of a storm water detention basin. It has
been determined that 8.34 acres (from a total parcel area of approximately 18.58 acres) is required for this
storm water management facility.
ANALYSIS
The Common Council originally approved the acquisition of this property in November of 2011 per Resolution
No. 11-495. Because the property owner was not able to complete the transaction for the approved price, the
Common Council also authorized a jurisdictional offer in October of 2012 in the amount of $920,000. The
property owner has requested a revision to the award to match his appraisal, which established a value for the
property as $970,000. This revision will increase the City's settlement by approximately 5.4%. Our acquisition
consultant recommends approval of the revision as fair compensation for this land acquisition. The following

FISCAL IMPACT
Funding for this acquisition is included in the"Storm Sewer Section" of the Capital Improvement Program.
