HomeMy WebLinkAbout10. 13-132 MARCH 26, 2013 13-132 RESOLUTION (CARRIED__6-0__ LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: DESIGNATE MEETING PLACE FOR BOARD OF REVIEW INITIATED BY: CITY ADMINISTRATION WHEREAS, §70.47(1) of the Wisconsin Statutes provides that the Board of Review shall meet at the council chamber or someplace designated by the council; and WHEREAS, construction of a storm water facility and reconstruction of the City Hall parking lot will limit available parking at the City Hall during 2013. NOW, THEREFORE, BE IT RESOLVED by the Common Council for the City of Oshkosh that the Library Training Room on the third floor at the Oshkosh Public Library is hereby designated as an alternative meeting place for the Board of Review if in the opinion of the City Manager an alternative meeting place shall become necessary. BE IT FURTHER RESOLVED that the City Clerk shall post notice of the alternate meeting place, if used, on or near the main entrances of City Hall and the Oshkosh Public Library in a manner designed to give reasonable notice of the alternative meeting location. Lorenson, City Attorney DATE: March 20, 2013 RE: Designate Meeting Place for Board of Review BACKGROUND Due to the ongoing construction of the storm water facilities and parking lot reconstruction occurring at City Hall during 2013, all staff liaisons to Boards and Commissions were asked to review the needs of their Board and to make accommodations if necessary for meetings. §70.47(1) of the Wisconsin Statutes requires that Boards of Review in cities meet in the Council Chamber or at some other place designated by the Council. The City of Oshkosh Board of Review is the Board responsible to hear objections to property tax assessments. This Board meets annually in May and schedules and hears all objections properly brought before it until its work is concluded. Meetings of the Board are conducted during the work day and are open to the public. The number of objections varies from year to year and taxpayers are allowed to file objections, subject to certain limitations, even during the period the Board is in session, making it difficult to determine prior to the start of the Board's sessions how many appeals will be heard and what type of accommodations will be required for parking. ANALYSIS Because of the uncertainty associated with the Board of Review schedule, the Board will hold its first meeting on Wednesday, May 15th, as it typically has in the City Council Chambers. At that time, the Board reviews the Assessment Rolls and takes other administrative action and schedules hearings for the objections that it receives. Based upon the number of objections and the estimated time for hearings, a determination will be made at that time whether it will be necessary or more convenient to move the Board's hearings to an alternate location. If an alternate location is advisable, staff identified an appropriate room at the Oshkosh Public Library that can be utilized. The .• proposed resolution gives the City Manager the authority to determine whether the alternate location should be used. FISCAL IMPACT There is no fiscal impact. RECOMMENDATION Staff recommends approval of the resolution to give the City Manager, in consultation with the Board of Review and staff, the ability to move the Board's hearings should that become necessary or convenient.
