That the report of the City Manager, acting as the Board of Public Works, pertaining to the construction of the above described public improvements, including plans and specifications therefor, is hereby adopted and approved with the following MARCH 26, 2013 13-125 RESOLUTION CONT'D a. b. c. 2. That the action of the City Manager in advertising for bids and to carry out the work of such improvements in accordance with the reports of the City Manager and in accordance with the said resolution heretofore adopted, is hereby approved, ratified and confirmed. 3. That payment for said improvements be made by assessing the cost to the property benefited as indicated in said report, except as modified herein. 4. Assessments shown on the report represent an exercise of the police power and have been determined on a reasonable basis and are hereby confirmed. 5. That the assessments for all projects included in said report are hereby combined as a single assessment but any interested property owners shall be entitled to object to each assessment separately or all assessments jointly for any purpose or purposes. 6. That the assessments may be paid in cash, or in installments pursuant to Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear interest at the rate of six percent (6%) per annum on the unpaid balance. The City Clerk shall publish an installment assessment notice in accordance with Section 66.0715(3)(e) of the Wisconsin Statutes in the official newspaper of the City. 7. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY NORTHWESTERN, the official newspaper of the City. 8. Staff will be available beginning at 5:30 p.m. in the rear of the Common Council Chamber (Room 404) to answer questions about the project and the estimated costs. The proposed improvements include: paving, utilities, sidewalks, and/or driveway approaches and the levy of special assessments that partially cover the cost of the improvements. Assessments are not due until the project is certified as complete and then can be paid by any one of the plans as outlined by the City Clerk's information on payment plan options. Based upon the City of Oshkosh assessment policy, the assessable portions of the project have been identified and are outlined on the attached assessment worksheet(s). The estimated distance on side streets is estimated high to allow adequate area for the new construction to be transitioned to the existing pavement. The quantities and costs are estimates and will be adjusted to actual quantity installed and the unit costs will be adjusted according to the assessment policy based on bid prices. Sidewalk estimated quantities include six (6) additional squares of sidewalk to allow for private lateral construction. Only squares actually removed and replaced will be billed. The final cost will not increase above the estimated total without another public hearing. Questions in regard to payment of Special Assessments can be answered by calling the City Clerk's office at (920)236-5011. Questions in regard to the construction project in general can be answered by calling the Department of Public Works Engineering Division at(920)236-5065. The sequence of construction has not yet been scheduled with a contractor. Residents will be notified approximately one week before construction will begin on a particular street. Each street identified in this year's paving program has been designated a specific time frame in which the contractor will need to complete their work on that street. The construction time frames vary from 8-16 weeks depending upon the amount of work and the complexity of the work associated with a specific street. All work within this contract is scheduled to be completed by the end of November 2013. The project construction will consist of the following elements: relay or installation of specific segments of water and sanitary sewer mains and their associated laterals at various locations along the project; relay or installation of storm sewer and storm sewer laterals, as needed, along the project to accommodate the drainage needs for the street and the adjacent properties; new concrete driveway aprons will be constructed; and the existing concrete sidewalk will be repaired as needed while any gaps in the sidewalk will be constructed with new sidewalk. It is recommended that no salt or harsh chemicals be put on new sidewalk for one (1) year. If you know of any underground wires and/or piping, (examples: invisible electric fence, conduit for exterior lighting, irrigation system, etc.) on your property near the sidewalk and driveway, please contact the Engineering Division as soon as possible. Prior to the completion of the project, all disturbed areas will be topsoiled, seeded, and covered with erosion mat(the property Page 1 of 2 I\Engineerirng\13-04 Conc Paving&Util\Project_Information\Correspondence\Letters\13-04 Assessments Letter 41_3-15-13.docx h owner is responsible for watering the newly vegetated areas). The matting placed over the seed is biodegradable; please do not remove the mat because it serves as mulch for the new grass. Please set your lawn mower to the highest setting when mowing the new grass areas for the first few mowings. As part of the construction, a storm lateral will be installed at residential lots to the property line and an 8" diameter drain with a slotted drain cover will be placed approximately one (1) foot off the sidewalk into your yard. The storm sewer lateral and drain will allow you to direct drainage and/or sump pump hoses to this location. This drain is connected to the storm sewer system and drains directly to local streams and lakes. The lateral is to be used for "clear water" only. "Clear water" is typically groundwater discharged by a sump pump or runoff from precipitation (i.e. rainfall or snow melt). Do not place pet waste, yard waste, or other waste material into the storm sewer system. If you wish to have a storm sewer lateral without the surface drain feature, please contact the Engineering Division. In the event conditions on the property prevent the installation of the drain(a retaining wall, for example), a drain will not be installed. The storm sewer lateral will be stubbed underground to the property line. You will be receiving additional information about the storm sewer lateral and drain. The drain is part of your private lateral and will be yours to maintain. The drain will have a fabric filter installed as a part of the construction. Please leave the filter in place until the grass surrounding the drain is well established. The fabric will prevent dirt and debris from filling the pipe until the grass is established. Commercial properties will receive a larger diameter storm sewer lateral stubbed to the property line. During construction,there will be periods of time when access to your property will be restricted. There will only be a few instances when this will occur. Typically, short access restrictions occur during the underground utility installation and longer restrictions occur during the placement of concrete pavement and driveways. To minimize the inconvenience, the contractor will provide a one-week notice prior to the access being restricted for concrete work. Per the Police Department, a Construction Parking Permit is required to park on a street overnight, if required because of road construction. Construction Parking Permits are free of charge and are issued at the Oshkosh Police Department Telecommunication Desk(see enclosed information from the Police Department). All"No Parking" areas and/or posted time zones must be obeyed. Vehicles parking overnight must be parked on the house address side of the street that corresponds to the current date. On odd calendar dates, the vehicles should be parked on the odd address side of the street. On even calendar dates, vehicles should be parked on the even address side of the street. Provisions will be made with the Fire Department and the Sanitation Division so fire protection and City garbage/recycling collection will continue at all times. Please ensure your garbage/recyclables are at the curbside by 7:00 a.m. on your regular collection day. Crews schedule collection of garbage/recyclables in construction areas at the start of each day. If rural-type mailboxes exist on your street, the contractor will remove them during construction. This removal will make it necessary for you to pick up your mail at the Post Office. The contractor will be responsible so as not to damage the mailboxes. Upon completion of the paving work,the contractor will reset the mailboxes. Although terrace trees may need to be removed at specific locations, they will be preserved as much as possible. Property owners at locations where a tree needs to be removed will receive advance notice of the removal and replacement options. Roots and branches may be cut to allow for paving operations. Cutting and pruning will either be done by, or under the direction of,the City Forester. Construction Permits are free of charge and are issued at the Oshkosh Police Department Telecommunications Desk. Construction Permits are issued one permit per vehicle and cannot be interchanged between different vehicles. Construction Permits are not to be used for 24-hour parking. They are issued for parking vehicles on the street at night and vehicles must be used and moved during the day. Construction Permits are issued on an assigned block basis. In order to obtain a permit for a specific block, vehicles must be able to park on both sides of the street* or a permit cannot be issued for that particular block. *This does not apply to road construction or utility repair areas. If the permit is assigned to a specific block where there is a timed-zone during the day, the permit holder must obey those signs. On odd days of the week, the permit holder should park on the side of the street with odd- numbered houses. On even days of the week, the permit holder should park on even-numbered sides of the street. Each night, the car should be parked on the opposite side of the street as the night before. NOTE: Odd and Even dates are figured before midnight. In the case of a declared Snow Emergency, ALL vehicles must be removed from the street or the vehicle will be towed at owner's expense. It is the responsibility of the vehicle owner/operator to find alternate parking in the event of a snow emergency. Permits must be displayed in the driver's side window. Rubber bands are supplied to attach the permit to the driver's side visor. Each night, the visor should be put down and pushed against the window so that the permit is visible from the outside of the car. Each permit is good for 10 days.* If parking permission is needed for longer than 10 days, a regular overnight permit must be purchased at the Oshkosh Police Department. *This does not apply to road construction or utility repair areas. Page 1 of 2 Disabled vehicles will not be issued Construction Permits. Construction Permits will not be granted for motor busses; truck tractors; semi-trailers; and motor trucks designed, used, or maintained primarily for the transportation of property as defined in City Code 27-26(3). All Construction Permit parking is subject to the following guidelines: • May not park in Signed/ designated "No Parking" areas • Vehicles may not stop or park in a designated "Fire Lane" • No parking within 10 feet of a fire hydrant (an official traffic sign may indicate that a greater distance is required) • No parking in loading zones • No parking within 4 feet of an alley or private road or driveway • No parking with 15 feet to the near limits of a crosswalk Failure to follow the above rules could result in the loss of the privilege to use the Construction Permit, and/or citations being issued. Individuals wishing to "appeal" a parking citation may do so by completing a Request to Review Parking Citation form, which is available at the Telecommunications Desk of the Oshkosh Police Department. The Construction Permit may be rescinded at any time if it is determined that the above rules and guidelines have not been followed, or misleading or inaccurate information for documentation on the permit has been provided. OSHKOSH POLICE DEPARTMENT 420 JACKSON STREET OSHKOSH, WISCONSIN 54903 (920)236-5700 www.oshkoshpd.com Page 2 of 2 #2 MARCH 12, 2013 13-108 RESOLUTION (CARRIED X LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND INITIAL RESOLUTION NO. 13-10 FOR SPECIAL ASSESSMENTS — CONTRACT NO. 13-04 / PAVING, SIDEWALK, DRIVEWAY, AND UTILITIES / SECOND LOCAL STREET CONCRETE PAVING PROGRAM (NORTH & SOUTH CENTRAL AREA) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the Common Council previously adopted Initial Resolution No. 13-10 on January 8, 2013 for Special Assessments for Paving, Sidewalk, Driveway, and Utilities for the City's Second Local Street Concrete Paving Program in the North and South Central Area; and WHEREAS, further review of the skew of the street intersections within the project area resulted in the conclusion that the limits of this project must be extended to allow for the connection to existing utilities and pavement; and WHEREAS, it is necessary to amend the Initial Resolution to include the extended limits for the project area so that project may be properly completed and assessed. BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. 3. The assessments against any parcel may be paid according to the provisions of Section 25-83 through 25-89 of the Oshkosh Municipal Code. 4. The governing body determines that the improvements constitute an exercise of the police power for the health, safety, and general welfare of the municipality and its inhabitants. 5. The Board of Public Works is directed to prepare a report consisting of: (a) Final plans and specifications for said improvements. (b) An estimate of the entire cost of the proposed work or improvements. (c) An estimate as to each parcel of property within the assessment district of: (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. (3) The net amount of benefits over damages or the net amount of damages over benefits for each improvement. (4) The total assessment against each parcel Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. 6. Upon receiving the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held before the Common Council at the Council Chambers, Room 406 in the City Hall at a time set by the Clerk in accordance with the Wisconsin Statutes. The assessment against any parcel may be paid in cash, paid with the first property tax installment, or in ten (10) installments if the total amount of the assessment is greater than five hundred dollars ($500.00) or fifteen (15) installments if the total amount of the assessment is greater than one thousand dollars ($1000.00). 7. Once Contract No. 13-04 is certified as complete by the Public Works Department, the final amount (quantities and costs) of the special assessment against your property or properties will be mailed to you. At that time you will also receive the paperwork to select a payment choice for the special assessments. PAYMENT CHOICE OR PAYMENT IS NOT ACCEPTED AT THIS TIME. THE PAYMENT OPTIONS SHEET YOU WILL RECEIVE AFTER THE CONTRACT IS CERTIFIED AS COMPLETE WILL HAVE THE FOLLOWING OPTIONS: INVOICE - PAYMENT WITHIN 30 DAYS If you choose this option, the City of Oshkosh will then send you a special assessment invoice and you must make payment within thirty days of that notice. If the payment is not made within thirty days after receiving the special assessment invoice, 6% interest accrues from the date of notification. If after making this selection, the property owner fails to make payment to the City Treasurer; the entire amount including interest will be placed on the next property tax bill. TOTAL ASSESSMENT ON NEXT TAX BILL IN FULL Property owners may elect to pay 100% of the assessment on the next designated real estate property tax bill, without interest. The total amount of the assessment will be included on and payable in conjunction with the next designated property tax bill. TEN ANNUAL INSTALLMENT PAYMENTS ON PROPERTY TAX BILL(ASSESSMENT MUST BE IN EXCESS OF $500.00) The amount of the assessment will be placed on the property tax bill with interest at 6% on the unpaid balance per year over the ten- (10) year period. The annual assessment payment and interest will be included in each year's tax bill payment. The assessment balance may be paid in full at any time during the ten-year period, with interest pro-rated to the month of payment. (Applies to assessments in excess of $500.00.)
