HomeMy WebLinkAbout19. 13-86 FEBRUARY 26, 2013 13-86 RESOLUTION (CARRIED___7-0____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVAL OF AMENDMENT FOR ENGINEERING SERVICES AGREEMENT TO CONDUCT A SEDIMENT SAMPLING INVESTIGATION & SEDIMENT DISPOSAL CHARACTERIZATION FOR THE SAWYER CREEK CHANNEL IMPROVEMENT PROJECT / AECOM ($67,720.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, AECOM is a consulting firm that provides professional services with expertise in a number of areas including environmental engineering; and WHEREAS, the City and AECOM previously entered into a professional services agreement with AECOM to determine the nature and extent of contamination discovered during the Sawyer Creek Channel Improvement Project and to provide recommendations for continued dredging and disposition of dredged sediments from the Project; and WHEREAS, it is necessary to have additional services performed in relation to this Project, including providing support to the City for the disposal of the impacted material dredged in 2012, collecting additional sediment samples with a report and recommendations, and support during meetings with the Wisconsin Department of Natural Resources which can be performed effectively and efficiently by AECOM through an amendment to the existing agreement. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed pursuant to Section 12- 16 of the Municipal Code to enter into an amended agreement with AECOM to provide additional services pertaining to the Sawyer Creek Channel Improvement Project. BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to take those steps necessary to implement an amendment to the existing agreement with AECOM for these additional services. BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated from: Acct. Gohde, Assistant Director of Public Works S'"J DATE: February 21, 2013 RE: Amendment to Engineering Services Agreement to Conduct a Sediment Sampling Investigation and Sediment Disposal Characterization for the Sawyer Creek Channel Creek Improvement Project/ AECOM ($67,720) BACKGROUND Advance Construction, Inc. was awarded Contract 12 -03 — Sawyer Creek Channel Improvements at the May 22, 2012 Common Council meeting. While dredging in the area between Sawyer Street and the Fox River, a sheen appeared on the water surface. The appearance of the sheen is an indication of contaminated sediment. The Department of Public Works contracted with AECOM to determine the nature and extent of the contamination and to provide recommendations for the approach for the remainder of the dredging and for disposition of the dredged sediments. Their recommendations were submitted in a report dated February 14, 2013. An amendment to the engineering services agreement has been submitted to provide additional services for this project. These services will include providing support to the City for the disposal of the impacted material dredged in 2012, collecting additional sediment samples necessary to determine if impacted sediment will be encountered during dredging west of the North Sawyer Street bridge, providing a summary report with recommendations regarding the results of the additional sediment sampling, and providing support to the City during meetings with the Wisconsin Department of Natural Resources and the contractor. ANALYSIS AECOM was chosen due to their experience on previous environmental engineering projects for the City. Staff has reviewed the amendment and costs. The proposed fee is time and materials $67,720 for a total contract amount of $126,765. FISCAL IMPACT Funding for these services is available in the Storm Water Utility. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. I have reviewed this amendment and in accordance with Section 12 -16 of the Code, I am hereby recommending that the Common Council approve this amendment.
