Washburn Street (Plan Commission recommends approval) BACKGROUND The 1.90 acre subject site is located on the east side of S. Washburn Street, approximately 1,000 feet south of W. 20th Avenue. The parcel shares frontage with U.S. Highway 41 to the functional rear of the parcel. The parcel is currently undeveloped, mainly due to a drainage way that diagonally bisects the property, making it difficult or possibly impossible to develop. The site is surrounded by industrial uses to the north, south, and west, and U.S. Highway 41 to the east. ANALYSIS The property owner contacted the Department of Public Works to determine if it would be possible to divert the existing drainage way to make the site developable. The drainage way receives storm water runoff from 100 acres of land southwest of the subject site and the owner's consultant submitted plans to the City for review which the Department of Public Works found would be able to adequately handle the flowage. To ensure the operation and maintenance of the drainage way, the City needs to acquire an access and drainage easement to allow the City legal access to the site. The Department of Public Works and the City Attorney will work with the property owner to have the appropriate easement documents prepared, signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its February 19, 2013 meeting. WASHBURN STREET Plan Commission meeting of February 19, 2013 GENERAL INFORMATION Petitioner: City of Oshkosh Department of Public Works Owner: Riviera Ventures, LLC Action Requested: The Department of Public Works is requesting the acceptance of a 15 -foot wide by approximately 600 -foot access and drainage easement located on a vacant parcel south of 2150 S. Washburn Street. Applicable Ordinance Provisions: N/A Property Location and Type: The 1.90 acre subject site is located on the east side of S. Analysis: Riviera Ventures, LLC, the owner of the property, contacted the Department of Public Works to determine if it would be possible to divert the existing drainage way to make the site developable. Staff supports the easement request as this will not have a negative impact on the surrounding properties and will prepare and enable the site for future development. RECOMMENDATION /CONDITION Staff recommends approval of the granting of the proposed drainage and access easements as requested, The Plan Commission approved of the easements as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area as well as the zoning classifications and land use in said area. He explained the reasoning for the easement request which will enable the site to be developed in the future. He also reviewed the site plan for the easement. Ms. Propp questioned if this easement would possess an open drainage area. Mr. Nau responded affirmatively. Motion by Nollenberger to approve the acceptance of the drainage and access easements for property south of 2150 S. Washburn Street. Seconded by Borsuk. Motion carried 8-0. This existing drainage way receives storm water runoff from approximately 100 acres of land to the southwest of the parcel in question. The property owner contacted the Department of Public Works to discuss the potential to reconstruct the drainage way.
