HomeMy WebLinkAboutMinutes PLAN COMMISSION MINUTES January 15, 2013 PRESENT: Jeffrey Thoms, Thomas Fojtik, John Hinz, Steve Cummings, Donna Lohry, Karl Nollenberger EXCUSED: David Borsuk, Ed Bowen, Kathleen Propp, Robert Vajgrt STAFF: Darryn Burich, Director of Planning Services; David Buck, Principal Planner; Jeffrey Nau, Associate Planner; Steve Gohde, Assistant Director of Public Works; Deborah Foland, Recording Secretary Chairperson Fojtik called the meeting to order at 4:00 pm. Roll call was taken and a quorum declared present. The minutes of December 18, 2012 were approved as presented. (Nollenberger/Cummings) I. GRANT STORM SEWER EASEMENT FOR PROPERTY NORTH OF 3555 MOSER STREET Suneer Patel, representing Pacur, LLC, is requesting a 20 foot by 15 foot storm sewer easement from the city to install a 12 inch storm sewer across a 15 foot strip of city-owned land to connect with a proposed storm basin located north of the City property. This request was initiated as part of a parking lot project at 3555 Moser Street which required expansion of the property’s storm water management infrastructure. Mr. Nau presented the item and reviewed the site and surrounding area as well as the zoning classifications in said area. He stated that the storm water management infrastructure is in the form of a detention basin to be constructed north of the property and the easement would allow connection to this basin by boring underneath the existing railroad spur located on City property. Mr. Thoms questioned if the Town of Oshkosh has already approved the construction of the detention basin as it would be located outside of the city limits. Steve Gohde, Assistant Director of Public Works, stated that the basin would require a building permit as it is located on the property owner’s land however he was not aware if the Town has approved a building permit for the structure at this time. Ms. Lohry inquired where the storm water runoff would go. Mr. Nau responded that the water would go north via the storm sewer located in the easement, if approved, to the planned detention basin which would be located in the southeast corner of the property. Ms. Lohry requested clarification on the map as to the location of the detention basin. Mr. Nau displayed the location of the basin on the map. __________________________________ Plan Commission Minutes 1 January 15, 2013 Mr. Gohde stated that the detention basin would be tied into the public storm system on Moser Street however construction on the basin has not yet begun. Mr. Hinz questioned if the approval of the easement was necessary to move forward with the detention basin construction. Mr. Gohde indicated that there was not adequate space on the existing site for the basin and Pacur had plans to expand their business which was necessitating the requirement for additional storm water management. Mr. Thoms inquired if there were any concerns regarding the integrity of the railroad spur line. Mr. Gohde responded that the spur line takes precedence and the property owner would be responsible for any damage to it. Motion by Nollenberger to approve the easement for property north of 3555 Moser Street. Seconded by Cummings. Motion carried 6-0. II. EXTRATERRITORIAL THREE-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT 105 INDIAN POINT ROAD AND 5110 JACKSON STREET IN THE TOWN OF OSHKOSH Three-lot land division/certified survey map from two existing parcels containing a total of 4.694 + acres. Sizes of the proposed lots are as follows: Lot 1 = 1.635 Acres Lot 2 = 1.275 Acres Lot 3 = 1.784 Acres Mr. Nau presented the item and reviewed the site and surrounding area as well as the zoning classifications in said area. He stated that the land division was re-distributing the lot lines in addition to creating a new parcel. He reviewed the lot configuration and stated that the Department of Public Works is recommending cross access agreements as well as wells/septic fields be shown on the final certified survey map. Mr. Thoms questioned if the recommendations by Public Works should be added as conditions of approval for this request. Mr. Burich responded that the although the City has design standards, recent changes by the legislature have impacted much of the City’s review authority with respect to being able to place conditions or even deny a CSM. Mr. Thoms inquired that he felt the land division could create issues regarding ingress/egress to the lots and it has a residential use in a M-2 zoning district and questioned if that would not be considered. Mr. Burich responded that although these are valid concerns, he indicated that the County and the Town have final jurisdiction regarding extraterritorial land divisions and the City’s jurisdiction has been greatly diminished other than reviewing it to determine if it is consistent with the City’s Comprehensive Plan, which the City cannot even deny a CSM based on that inconsistency. __________________________________ Plan Commission Minutes 2 January 15, 2013 Motion by Hinz to approve the extraterritorial three-lot land division/certified survey map at 105 Indian Point Road and 5110 Jackson Street in the Town of Oshkosh. Seconded by Cummings. Motion carried 6-0. OTHER BUSINESS Mr. Burich stated that the City Hall parking lot will be reconstructed beginning in March of this year and all public meetings including the Plan Commission would be moved to the Oshkosh Seniors Center from March through November of 2013 until the work is completed. Mr. Fojtik questioned if the city would be meeting the storm water detention requirements. Mr. Gohde responded that a 5-acre detention facility would be constructed underneath the parking lot and the reconstruction would include both the City Hall parking lot and the Oshkosh Police Department. There being no further business, the meeting adjourned at approximately 4:17 pm.
