HomeMy WebLinkAbout18. 13-25 JANUARY 22, 2013 13-25 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: AUTHORIZE THE SALE OF FERMENTED MALT BEVERAGES AT REETZ BALL FIELDS CONCESSION STAND BY PARKS DEPARTMENT STAFF INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that pursuant to Sec. 125.06(6) of the Wisconsin Statutes, the proper Parks Department staff are authorized to sell fermented malt beverages at Reetz Ball Field Concession Stand in accordance with the regulations established by Chapter 125 of the Wisconsin Statutes and Chapter 4 of the Oshkosh Municipal Code. City of Oshkosh Parks Department 805 Witzel Ave.,PO Box 1130 Ray Maurer Oshkosh,WI 54903-1130 Director Of HKOf H (920)236-5080 (920)232-5316 FAX ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Ray Maurer, Parks Director DATE: January 16, 2013 RE: Authorize Sale of Fermented Malt Beverages at Reetz Ball Fields Concession Stand By Parks Department Staff BACKGROUND For the past 20 years, the Boys & Girls Club Alumni have operated the concession stand at the Reetz Ball Fields. Concession items included beer,soda,water,hot dogs,hamburgers,candy and snacks,etc. The City and the Alumni group had a lease agreement which expired at the end of 2012. The Alumni group has notified us that they will no longer be able to operate the concession stand. ANALYSIS Jenny McCollian,Revenue Facilities Manager,and.I discussed various options for the concessions operation and have decided the Parks Department will operate the concessions for the 2013 season. We will utilize some of our existing seasonal staff that work at our other concession operations throughout the parks. The staff members that will work at the Reetz Ball Fields concession stand will have their Wisconsin Responsible Beverage Service license. Section 125.06(6)of the Wisconsin Statutes provides that employees of the municipality can sell fermented malt beverages in parks when authorized by the legislative body. The resolution that is included for action will provide us that authorization. This is the same process that the City utilized back in 2000 to authorize City employees to sell fermented malt beverages at Lakeshore Municipal Golf Course. FISCAL IMPACT The Lease Agreement that we had with the Boys&Girls Club Alumni included an annual payment to the City of$1,000 or 10%of gross revenues,whichever was greater for the year. Payments generally ranged between $1,000 and $2,000. We anticipate that we will be able to generate approximately$5,000 net with our staff operating the concession stand.
