HomeMy WebLinkAbout05. 13-02 JANUARY 8, 2013 13-02 RESOLUTION (CARRIED___6-1P____LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: APPROVE AMENDMENT TO PREVIOUSLY APPROVED CONDITIONAL USE PERMIT TO EXTEND TIME PERIOD TO SUBMIT PLANS FOR PLACEMENT OF ROOFTOP TELECOMMUNICATION ANTENNA AT 530 NORTH MAIN STREET INITIATED BY: OSHKOSH HOUSING AUTHORITY PLAN COMMISSION RECOMMENDATION: Approved w/condition WHEREAS, the Common Council previously approved a conditional use permit for the installation of three new telecommunication/cellular antennae on the rooftop at 522-530 North Main Street, with one of the conditions being that plans and building permits for the roof rehabilitation and equipment concealment are provided by December 2012 or the conditional use permit be considered null and void and the three antennae included within this request be removed; and WHEREAS, the owner is currently working with the carriers/antenna lessee and State of Wisconsin Historic Preservation Office toward a final design suitable for permit application and construction and the owner is requesting a 6 month extension to submit said plan to the City. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the conditional use permit at 530 North Main Street is hereby amended to grant a 6 month extension for submittal of plans and building permits for installation of rooftop antenna, per the attached, with the following condition. All other conditions of approval shall remain enforce. 1) Said plans and building permits for roof rehabilitation and equipment concealment be provided no later than July 2013 or the conditional use permit be considered null and void and the three antennae included with the previously approved conditional use permit (Resolution #11-543) are removed. ,f o1NK4fH ON WE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: January 3, 2013 RE: Amend Condition on Previously Approved Conditional Use Permit at 530 North Main Street to Extend the Time Period to Submit Plans for Placement of Rooftop Telecommunication Antennae (Plan Commission recommends approval) BACKGROUND The Oshkosh Housing Authority is requesting a six month extension to a previously issued Conditional Use Permit (CUP) that allowed placement of new telecommunication /cellular antennae on the rooftop of the building known as Mainview Apartments (formerly the Raulf Hotel) at 530 North Main Street. Resolution 11 -543 approved a Conditional Use Permit to allow the installation of additional telecommunication equipment/three cellular antennae on the rooftop with conditions including that plans and permits for the roof rehabilitation and equipment concealment are provided by December of 2012 or the Conditional Use Permit be considered null and void and the three new antennae included within this petition be removed. ANALYSIS In addition to the three new antennae approved in the aforementioned CUP, the rooftop and wall structures at the roofline contain numerous antennae, unused antennae mounts, "whip" antennae, and multiple unidentified mounts and cabling which all are considered legal nonconforming facilities. The petitioner has indicated that they have been making progress on the stealth plan however the process is taking longer than expected and all parties are working toward a final design that would be suitable. The applicant is providing three sets of plans being considered including erecting a facade or screen wall and sign to locate the antennae behind, lowering the antennae to be below the height of the building and painting the antennae to match the structure, or lowering the antennae below the height of the building with a cover that would enclose them and appear like an architectural feature. The petitioner is hoping to get a clearer direction on the most desirable method to guide further development with the overall stealth plan anticipated to take six months to complete or July of 2013. FISCAL. IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its December 18, 2012 meeting. Approved, 1 City Manager ITEM: EXTENSION OF A CONDITIONAL USE PERMIT FOR PLACEMENT OF TELECOMMUNICATION EQUIPMENT ON THE ROOFTOP OF MAINVIEW APARTMENTS AT 522 -530 NORTH MAIN STREET Plan Commission meeting of December 18, 2012 GENERAL INFORMATION Petitioner /Owner: Oshkosh Housing Authority Action(s) Requested: The Oshkosh Housing Authority is requesting a six month extension to a previously issued Conditional Use Permit (CUP) that allowed placement of new telecommunication/cellular antennae on the rooftop of the building known as Mainview Apartments (formerly the Raulf Hotel) at 530 North Main Street. Applicable Ordinance Provisions: Wireless telecommunication facilities, including antennae, are regulated in Section 30 -35(J) of the Zoning Ordinance requiring all towers /antennae proposed to be constructed in commercial zoning districts receive a Conditional Use Permit. ANALYSIS Resolution 11 -543 approved a Conditional Use Permit to allow the installation of additional telecommunication equipment/three cellular antennae on the rooftop of 522.530 North Main Street ( Mainview Apartments) with certain conditions including that "Plans and building permits for the roof rehabilitation and equipment concealment are provided by December of 2012 or the Conditional Use Perin it be considered null and void and the three antennae included rvithin this petition be removed ". In addition to the three cellular antennae approved on a temporary basis in the aforementioned CUP, the rooftop and wall structures at the roofline currently contain approximately 27 antennae, 7 unused antennae mounts, 7 -10 "whip" antennae, multiple unidentified mounts and extensive cabling, which are all considered legal nonconforming antennae facilities. Any modifications to the existing equipment and/or installation of new equipment, other than maintenance, now require the issuance of a Conditional Use Permit. The petitioner has indicated that they have been making progress on the stealth plan however, because of complications reaching agreement on a design, the process is taking longer than expected but all parties (Housing Authority, carriers /antenna lessee and State of Wisconsin Historic Preservation Office) are working toward a final design suitable for permit application and construction. At this point, consensus on a mutually acceptable design will not occur in 2012, requiring the need of a six month extension to the CUP. As an update on progress of stealth planning efforts and to receive direction from the Plan Commission on preferred stealth techniques, the applicant has provided three sets of plans showing alternate stealth options for the roof of the Housing Authority. In general, the stealth options include the following designs: 1. Stealth facade or screen wall matching the building behind which antennae are located. 2. Stealth antenna cover painted to match the building behind which antennae are located. 3. Antennae located below the existing rooftop (or parapet) painted or wrapped to match the building. Flush mounted to the greatest extent possible to reduce profile. 4. Partial option of antennae located behind, or incorporated in, a sign that might be included in a future Planned Development proposal. ALTERNATE STEALTH OPTIONS Below are descriptions and photo simulations of three options currently being considered that coincide with submitted plan sets. Additionally, photo examples of these installations at other locations will be presented at the meeting. The designs are not mutually exclusive and different aspects could be mixed into an overall design. They are examples of stealthing that carriers have done, and SHPO has agreed to in the past, and are options that are viable from a construction and engineering standpoint with regard to both structural and radio frequency engineering. Option 1: Depicts the facade or screen wall, the sign, and each carrier's antennae located behind the stealth facade or incorporated into a possible future sign. Option 2(a): Depicts the antennae lowered to be below the height of the existing building and painted to match the building. The antennae can be either painted or wrapped with a material that is antenna friendly and matches the existing building. This option does not incorporate the sign into the design. Item- 522- 530NAlah0faisview CUPEVension Option 2(b): Depicts the antennae lowered to be below the height of the existing building with a cover that would look like an architectural feature and also enclose the antennae. After going over the stealth options with the Plan Commission, the petitioner hopes to get a clearer direction on what the most desirable method is to guide the further development of the overall rooftop stealth plan, which is anticipated to take approximately 6 months or the summer of 2013. RECOMMENDATION/CONDITIONS Staff recommends approval of the requested six month extension to the previously issued Conditional Use Permit (CUP) with the following condition: 1) Plans and building permits for the roof rehabilitation and equipment concealment are provided no later than July of 2013 or the Conditional Use Permit be considered null and void and the three antennae included within CUP Resolution 11 -513 are removed. The Plan Commission approved of the extension to the previously issued conditional use permit as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and stated that in 2011, a request was approved for three additional antennae to be added to the rooftop with the condition that a stealth plan be provided by December of 2012 for all the antennae on said rooftop. He explained the progress to date and that the plan was taking longer than expected to develop and the owner was requesting a six month extension to complete the project. The owner submitted three options for stealthing the antennae which Mr. Buck reviewed as well as examples both on Mainview Apartments and other structures. He stated that by not allowing the requested extension, the three additional antennae would have to be removed at this time. Mr. Borsuk questioned if the owner ever submitted an inventory of all the antennae that are located on the roof as requested. Mr. Buck responded affirmatively. Mr. Borsuk also questioned if this plan addresses all the antennae on the roof. Mr. Buck indicated that it did not include the whip antennae. Item — 522 -530 N Dfatn/lfainview CUPEWension Jim Weinmann from Wireless Planning, LLC, stated he was present as the liaison for all the carriers with equipment located on the rooftop and several of the whip antennae are not in use and could be removed however some still need to be addressed as yet. He further stated that he was working with these companies to address the issue. Mr. Thorns inquired if he had identified all the antennae and the number of them that could be removed. Mr. Weinmann responded that he has accounted for all the carriers' antennae and there were just two whip antennae left that they do not have incorporated into the plans. Mr. Thorns then inquired if these stealth plans were something that could be used in other areas as well as at Mainview Apartments. Mr. Cummings left at 5:16pm. Mr. Weinmann described several options available for stealthing antennae that would be viable at other sites. Mr. Hinz questioned if Option #1 with the signs would make at easier to hide the whip antennae. Mr. Weinmann responded that the issue is the penthouse blocks the signal at some points and the logistics are what has to be dealt with. Mr. Borsuk questioned if the wrap around features displayed in one of the options could be painted on as far as false features such as windows. Mr. Weinmann replied that this option was mainly used to match the buildings and he would have to look into the possibility of painting features on them. The facades and covers could deal with all the antennae present and the sign is at the desire of the owner of the Housing Authority. Mr. Borsuk inquired what the State of Wisconsin Historic Preservation Office's desire was as far as the options presented. Dan Meissner, architect for the renovation project, stated that he has been involved with the designs and the historic signs that the owner desires used to be in place many years ago when it was still a hotel. The Housing Authority wants to keep the antennae low profile as possible as they are in the process of a grant application for funding for the renovations and they do not want to jeopardize the grant. Mr. Borsuk felt the Plan Commission should not make a decision on this request without the owner present. Mr. Meissner replied that Brad Masterson, Executive Director of the Housing Authority, could not be present today as he had a meeting in Madison regarding their grant application. Mr. Buck stated that the owner was requesting an extension at this time and a decision on the options did not need to be determined today. Mr. Thorns suggested that the extension be granted and the Plan Commission could hold a workshop at a later date to further discuss the options. Mr. Meissner stated that a workshop would be a great idea. Motion by Propp to approve the extension of a conditional use permit for placement of telecommunication equipment on the rooftop of Mainview Apartments at 522 -530 N. Main Street with the following condition: 1) Plans and building permits for the roof rehabilitation and equipment concealment are provided no later than July of 2013 or the Conditional Use Permit be considered null and void and the three antennae included within CUP Resolution 1] -543 are removed Seconded by Hintz.
