The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30 -16(B) of the Oshkosh Municipal Code pertaining to Zoning Districts and the map therein described is hereby amended by changing the district character of the property at 205 West Linwood Avenue from R -4 Multiple Dwelling to R -1 Single Family with a Planned Development Overlay North Y2 of vacated alley lying south of and adjacent to Lot 13, also all of Lot 13, Block 5, Plat of Interurban Land Co., 15th Ward, City of Oshkosh, Winnebago County, Wisconsin plus public right -of -way abutting said lot extending to the centerline of West Linwood Avenue. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and publication. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted Ordinance #13 -xxx APPROVE REZONING 205 WEST LINWOOD AVENUE FROM R -4 MULTIPLE DWELLING TO R -1 SINGLE FAMILY WITH A PLANNED DEVELOPMENT OVERLAY on January 22, 2013. Recently, the Oshkosh Area School District purchased the property with plans to incorporate it into the overall redevelopment of Oaklawn School. ANALYSIS The Comprehensive Plan Land Use Map categorizes the area of the subject site as a conversion point between the commercial designation extending from Jackson Street and the public /institutional land use recommended to the east and south. The Comprehensive Plan land use recommendations are general in their placement and not parcel fixed making areas of transition open to interpretation. When analyzing the dynamics of the area in relation for a commercial use, staff believes the subject site is far too small to be developed commercially as setbacks would consume a majority of the property leaving area insufficient for necessary improvement. The appropriateness of the public /institutional designation is further supported because the lot is being incorporated into the larger school site and will match the zoning of properties on the north, south and east and the Planned Development Overlay will coincide with the zoning designation located on the remainder of the school development area. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its December 18, 2012 meeting. Approved, City Manager ITEM: ZONE CHANGE FROM R -4 MULTIPLE DWELLING DISTRICT TO R -1 SINGLE FAMILY RESIDENCE DISTRICT WITH PLANNED DEVELOPMENT OVERLAY FOR PROPERTY LOCATED AT 205 WEST LINWOOD AVENUE Plan Commission meeting of December 18, 2012 GENERAL INFORMATION Applicant: City of Oshkosh Administration Property Owner: Oshkosh Area School District Action(s) Requested: The applicant is requesting a zone change from the R -4 Multiple Dwelling District to R -I Single Family Residence District with Planned Development Overlay to match the Oaklawn School property to the south and east to provide the ability to incorporate the parcel with the school redevelopment. Applicable Ordinance Provisions: The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning but relies on the Comprehensive Plan and good planning principles. RECOMMENDATION /CONDITIONS Staff recommends approval of the rezoning from R -4 Multiple Dwelling District to R -1 Single Family Residence District with Planned Development Overlay, as proposed. The Plan Commission approved of the rezoning as requested. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and reviewed the site and surrounding area and land use and zoning classifications in said area. He explained that the Oshkosh Area School District acquired the parcel adjacent to their school site and the zone change would give the property the same zoning classification as the school's existing site. The zone change would be consistent with the City's Comprehensive Plan. There was no discussion on this item. Motion by Vajgrt to approve the zone change from R -4 Multiple Dwelling District to R -1 Single Family Residence District with Planned Development Overlay for property located at 205 YV Linwood Avenue. Seconded by Propp. Motion carried 6 -0.
