PURPOSE: APPROVE LAND PURCHASE AT 2440 JACKSON STREET FOR
THE LIBBEY / NICOLET AREA WATERSHED STORMWATER
DETENTION BASIN PROJECT ($290,100.00)
INITIATED BY: PUBLIC WORKS DEPARTMENT
WHEREAS, on April 10, 2012, by Resolution No. 12-155, the Common Council
previously approved a Relocation Order pursuant to Sections 62.22 and 32.05 of the
Wisconsin Statutes declaring that it was in the public interest for the City of Oshkosh to
acquire land at 2440 Jackson Street for storm water detention in the Libbey/Nicolet
Drainage Basin; and
WHEREAS, the parties have reached agreement upon the purchase price for
these property interests.
NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to purchase a portion
of 2440 Jackson Street as outlined below, and to execute all documents necessary for
purpose of same.
Fee Acquisition $290,100.00
Money for this purpose is appropriated from:
Acct. No. 561-2010-1799-00000 Storm Water Utility Construction Work in Progress

RE: Approve Land Purchase at 2440 Jackson Street for Libbey/Nicolet Area Watershed Storm
Water Detention Basin Project ($290,100)
BACKGROUND
The Libbey Avenue and Nicolet Avenue Storm Water Management plan was approved by the
Common Council on October 25, 2011 and a Relocation Order/Determination of Necessity to
Acquire Properties was approved on April 10, 2012 per Resolution 12-155. Included in the
recommendations was the creation of a flood relief channel and storm water detention on this
property.
ANALYSIS
Our right-of-way consultant has had discussions with the property owner. The property owner has
agreed to sell their property for $290,100. The following information pertains to this property
acquisition:

Fee Acquisition $273,835 $290,100
FISCAL IMPACT
Funding for these acquisitions is included in the "Storm Sewer Section" of the Capital Improvement
Program.
RECOMMENDATION
I recommend approval of the land purchase.
