PURPOSE: APPROVAL OF AMENDMENT TO AGREEMENT FOR
ENGINEERING SERVICES RELATING TO THE DESIGN OF THE
JAMES ROAD AREA STORM WATER BASIN / STRAND
ASSOCIATES, INC. ($79,500.00)
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City and Strand Associates, Inc. previously entered into a
professional services agreement in which they would provide the City with services related
to the design of the James Road Area Storm Water Basin; and
WHEREAS, additional design-related services are required to complete the plan
preparation.
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are authorized and directed pursuant to Section 12-16 of the Municipal Code
to enter into an amended agreement with Strand Associates, Inc.
BE IT FURTHER RESOLVED that an agreement is approved in a form substantially
the same as the attached amendment to the agreement and said City officials are
authorized and directed to take those steps necessary to implement the terms and
conditions of the final agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

RE: Amendment to Agreement for Engineering Services Relating to the Design of the James
Road Area Storm Water Detention Basin—Strand Associates, Inc. ($79,500)
BACKGROUND
In November 2011, a contract was awarded to Strand Associates, Inc. (Strand) to provide engineering
services for design-related services associated with the preparation of construction plans and
specifications for the James Road Area Detention Basin. During the course of performing those services,
it was determined that additional services were necessary in order to complete the plan preparation.
ANALYSIS
The extra services requested of Strand Associates were required to meet new DNR regulations that were
enacted near the end of the design of the project, to revise the project design to account for the "off-road"
hauling of the excavated material to the "Clark-Hill" site, and prepare bidding documents for the separate
contract to install the fence around the site. In addition, due to the extraordinarily large number of bidders
on the project, additional effort was necessary to respond to bidders questions.
FISCAL IMPACT
Staff has reviewed the amendment and costs. The amount of this contract amendment is $79,500. This
will raise the total contract amount to $334,000 (not to exceed). These services will be funded through
the Storm Water Utility.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature, including engineering services, may be procured without the use of formal, sealed
quotes. I have reviewed this amendment and in accordance with Section 12-16 of the Code, I am hereby
recommending that the Common Council approve this amendment.
