That Section 7-17(A), (C), (F), AND (H) of the Oshkosh Municipal Code pertaining to the payment of fees before receiving a building permit is hereby repealed and recreated to read as follows: (A) For new buildings, additions, alterations and signs: The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. (C) For Moving Buildings: The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. (F) Additional permit to start construction prior to approval of plans and the issuance of the Uniform One and Two-family Dwelling Permit: The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. That Section 7-32(C)(2) of the Oshkosh Municipal Code pertaining to Temporary Occupancy Fees is hereby repealed and recreated to read as follows: (C)(2) Temporary Certificate of Occupancy Fee: The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. SECTION 3. That Section 7-42(A) of the Oshkosh Municipal Code pertaining to Awnings, Canopies, Mansards, and License Requirements is hereby repealed and recreated to read as follows: (A) Projection License Required: 1. No person shall erect or maintain any sign, marquee, awning, balcony, projection or structure extending over any portion of a street without first having secured a license from the Chief Building Inspector. The Building Inspector may refuse to issue or may revoke a license for a structure which creates a public nuisance affecting peace and safety. The owner or their agent shall pay a fee before receiving a license. 2. The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. SECTION 4. That Section 7-44 of the Oshkosh Municipal Code pertaining to fees related to Furnace and Heating Equipment is hereby repealed and recreated to read as follows: (A) Application for such permit shall be made in writing by the owner or his authorized agent upon forms furnished by the Heating Inspector. A fee shall also be submitted with such application. (B) An additional fee shall be charged in the event activity begins or the Heating Inspector finds such activity completed before a permit is issued and the appropriate fees are paid. The payment of such additional fees shall not relieve any person from fully complying with all of the regulations of this Chapter, nor from any other penalties prescribed in this Code. Re-inspection fees shall also be charged. (C) The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. SECTION 5. That Section 11-24 of the Oshkosh Municipal Code pertaining to the Application for Certificates and Fees is hereby repealed and recreated to read as follows: (A) All applications for Class 2 Maintenance Electrician's Certificate shall be made to the Electrical Inspector on forms furnished for such purpose and shall thereafter be referred to the Board. Each applicant shall pay an Application Review Fee when submitting an application. Such applications shall be subject to review and approval or disapproval by the Board. The applicant shall pay a fee before they are permitted to take the examination. Upon the successful completion of the examination, the applicant shall pay a fee for the initial 3-year certificate. (B) The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. SECTION 6. That Section 11-39(A) and (B) of the Oshkosh Municipal Code pertaining to Permit Fees is hereby repealed and recreated to read as follows: (A) Payment of Fees 1. Upon the issuance of a permit by the Electrical Inspector and before such permit shall be in effect, the applicant shall pay to the Electrical Inspector of the City a fee or fees. 2. The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. (B) Number of Inspections for Each Permit 1. The number of inspections per permit to be allowed without further charge shall be based upon the type or value of the improvement, or other approved criteria. Additional fees for each unnecessary inspection shall be charged for additional inspections due to Code violations or other valid reasons. 2. The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. SECTION 7. That Section 20-8(A)(3), (4), and (5) of the Oshkosh Municipal Code pertaining to Plumbing Permits, Plan Examination and Approval are hereby repealed and recreated to read as follows: (A)(3) Schedule of Fees: The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. (A)(4) Double Fees: i. In the event activity begins or the Plumbing Inspector finds such activity completed before a permit is issued and the appropriate fees are paid, an additional fee shall be paid, or double the amount of the permit fee, whichever shall be greater, and shall be paid by the owner or agent immediately upon notification from the inspector; however, the payment of such fees shall not relieve any person from fully complying with all of the regulations of this Chapter, nor from any other penalties prescribed in this Code. ii. The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. A schedule of the fees established by the governing body shall be available for review in the administering authority office, Room 205 City Hall, 215 Church Avenue, Oshkosh, Wisconsin. (A)(5) Re-inspection Fees: i. When additional inspections are made due to code violations or other valid reasons, an additional fee shall be charged for each unnecessary inspection. Such fees shall be paid in accordance with Section 20-9. ii. The fees referred to in this section and other sections of this article shall be established by the governing body and may from time to time be modified by resolution. As part of that review, the Building Services Division completed a survey of other similar communities in Northeast Wisconsin and the building inspection fees they charge. Based on that survey, the City's current fees set in 2006, are on the low and, and should be increased to about the average fees charged in surrounding communities. ANALYSIS The proposed ordinance has two other major components -first it removes the fee schedules from the building, plumbing, electrical and HVAC sections of the City Code and recreates a fee schedule that can be updated with a resolution rather than by ordinance. Secondly, the fee updates would not take effect until January 1, 2013 so that owners, bidders and contractors would have time to account for the changes. Chief Building Official Zarate has prepared the attached memo that compares the City's fees to other City's fees for a range of residential and commercial projects, before and after the fee update. The fee updates include an across the board increase for the base fee from $25 to $30 for all projects. The proposed building permit fee will now be based on building square foot, rather than applicant reported project value. The proposed fees would appear similar to 2006 fee schedule sample also attached. A new fee schedule would be adopted by resolution at the November 13, 2012 City Council meeting after the Ordinance changes are approved. FISCAL IMPACT The additional revenue generated by the proposed fees update would be about $75,000. The additional revenue is reflected in the draft of the City's 2013 Budget. PERMIT FEE INCREASE ANALYSIS Tables 1-6 will make comparisons of the present fees and proposed fees to those fee structures from Fond du Lac,Neenah and Appleton. Building Permit Fee Increase Suggestions Please refer to Table 1 for direct comparisons of the present and suggested valuation fees to those of our neighboring cities for minimum fees. Tables 2-6 provide comparison of the suggested fees and neighboring fees to the present fee schedule for various types of projects. The changes suggested are as follows: 1. Increase the base fee from $25 to $30. 2. Increase the $3/$1,000 fee for each$1,000 after $20,000 in value to $3.50/$1,000. 3. Add a$25 plan review fee for decks,detached garages/accessory structures and additions to these structures. 4. Increase the 1&2 Family Plan Review and Early Start Fees from $75 to $100. 5. Change project value based permit fee to square footage based for new projects or where floor area is added or altered. HVAC Permit Fee Suggestions Please refer to Table 1 for direct comparisons of the present and suggested valuation fees to those of our neighboring cities for minimum fees. Tables 2-6 provide comparison of the suggested fees and neighboring fees to the present fee schedule for various types of projects. The changes suggested are as follows: 1 1. Increase the base fee from $25 to $30. 2. Increase the $1.50/$100 increment to $16/$1000 for values between $1,000 and $10,000. (This equals a$1.00 increase per $1,000 value while making the fee schedule more user friendly, easier to calculate.) 3. Change the $1.00/$100 increment to $10/$1,000 for values between $10,000 and $25,000. (No increase, proposed fee is more user friendly, easier to calculate.) 4. Increase the $0.50/$100 increment to $5/$1,000 for values over$25,000. (No increase, proposed fee is more user friendly, easier to calculate.) Increase the base fee from $25 to $30. 2. Increase fixture fees from $7.00 per fixture to $9.00 per fixture. PROJECTED REVENUE FROM SUGGESTED FEE INCREASES Because some of the suggested increases are incremental and will affect each permit differently, it is difficult to project the amount of increased revenue the City could anticipate from these proposed increases. Additionally, the number of permits issued, the category of permits issued and the value of the permits all have an effect on the revenues generated. The following is a projection of the increased revenue the city may experience in 2013 based on 2011 permit activity. Mid way through 2012, the revenue generated was 17% above that of 2011 for the same time period. 2 Base Fee Increases were projected based on 2011 Permit activity. Incremental Increases are those increases charged per hundred or thousand dollars of value (depending on the permit category.) These cannot be accurately projected without doing a permit by permit analysis because differing valuations on each permit result in different fees. Projected increases are provided where analogies can be drawn. Square Footage Fee based would apply to all new, additions to and altered space of commercial buildings based upon$0.18/ square foot. Projections are based on 2011 permit activity.
