PURPOSE: AMEND MUNCIPAL ORDINANCE RELATED TO FIRE PREVENTION
TO ADD FEES FOR NON-ROUTINE INSPECTIONS

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 13-2.3(A)
AND (B), RELATING TO FEES FOR FIRE INSPECTIONS AND PERMITS FOR NON-
ROUTINE INSPECTIONS, PERMITS, AND SERVICES.
The Common Council of the City of Oshkosh does ordain as follows:
SECTION 1. That Section 13-2.3(A) and (B) of the Oshkosh Municipal Code be
created as follows:
SECTION 13-2.3 NON-ROUTINE INSPECTIONS, PERMITS, AND SERVICES
(A) The City shall charge a fee for non-routine inspections, permits and services.
(B) The list of non-routine inspections, permits, and services, along with the fees
charged for such services referred to in this section and other sections of
this article shall be established by the governing body and may from time to
time be modified by resolution. A schedule of the fees established by the
governing body shall be available for review in the administering authority
office, Oshkosh Fire Department, 101 Court Street, Oshkosh, Wisconsin.
SECTION 2. This ordinance shall be in full force and effect from and after its
passage and publication on January 1, 2013.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh
enacted ordinance #12-559 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH
CREATING SECTIONS 13-2.3 (A) AND (B). The ordinance amends and updates
language relating to the setting of fees related to fire inspection and prevention service for
the Fire Department.

RE: Request to Amend City Ordinance Related to Fire Prevention to
Add Fees for Non-routine Inspections
BACKGROUND
The City of Oshkosh Fire Department is charged with the task of providing routine fire
prevention inspections under administrative code SBS 14. The City receives funding
through the "2% Dues" program which taxes fire insurance 2% which is then
redistributed to cities to provide these inspections and response services. Additional
inspections such as temporary structures, new construction or occupancy changes and re-
inspections of non-compliant properties are not considered to be routine inspections.
These inspections are above beyond basic level service and are a direct benefit to a
specific property. With an increase in demand for these types of inspections and services,
and the subsequent cost, it would be appropriate that they are funded by a fee for service.
ANALYSIS
In researching other cities approach to funding of these inspections and services we found
that most charge fees for some or all non-routine inspections through a permit or service
fee. The Cities surveyed include Appleton, Town of Menasha, Fond du Lac, Eau Claire
and Green Bay. We also reviewed the types of special inspections and services we
provide, the average staff time and cost of providing these services which is included in
the attachments.
FISCAL IMPACT
The fees we are proposing for fire special fire inspection,permits and services would
provide an estimated $14,130.00 in revenue for the City.
RECCOMENDATION
I recommend that the City amend the Fire Prevention Ordinance Chapter 13 as attached
to allow the charging of fees for non routine fire inspections, permits and services and to
allow these fees to be modified by Council Resolution as needed. This will ensure our
ability to cover the cost of enforcing the Fire Prevention Codes for the continued safety
of our residents and property owners. Pending the approval of this ordinance change, I
will be following up with a resolution to adopt the fees as presented in the attachment.
