OSHKOSH INVESTORS LLC / VACATED CEAPE AVENUE
AT CEAPE/COMMERCE INTERSECTION
INITIATED BY: CITY ADMINISTRATION
PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that that
portion of vacated Ceape Avenue at the Ceape/Commerce intersection, per the
attached, is hereby declared surplus and the proper City officials are hereby authorized
and directed to execute any and all documents necessary to transfer said property to
Oshkosh Investors LLC.

BACKGROUND
The area in this request involves a triangular section, approximately 222 square feet remnant
parcel of the southwestern portion of Ceape Avenue right -of -way which the City obtained as a
result of the vacation of a portion of that street. The land to be vacated is to be utilized as
part of proposed improvements to the former City Center Hotel by Oshkosh Investors, LLC
and the University of Wisconsin Oshkosh Foundation.
ANALYSIS
The subject property was created as a result of the partial vacation of Ceape Avenue. The
piece of land is part of proposed entrance improvements for the former City Center Hotel
property currently being renovated by Oshkosh Investors, LLC and the University of
Wisconsin Oshkosh Foundation. The land has no practical use to the City and will be better
utilized for the proposed hotel improvements.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its September 4, 2012 meeting.

ITEM: LAND DISPOSITION OF A PORTION OF VACATED CEAPE AVENUE
LOCATED ADJACENT TO 1 N, MAIN STREET

GENERAL INFORMATION
Applicant/Owner: City of Oshkosh
Actions Requested:
The applicant requests the land disposition of a portion of vacated Ceape Avenue.
Applicable Ordinance Provisions:
N/A
Property Location and Background Information:
The area in this request involves a triangular, 222 square foot remnant parcel the City obtained as a
result of the vacation of a portion of Ceape Avenue (Item A).
ANALYSIS
The subject property was created as a result of the partial vacation of Ceape Avenue. The piece of
land is part of proposed entrance improvements for the former City Center Hotel property
currently being renovated by Oshkosh Investors, LLC and the University of Wisconsin Oshkosh
Foundation. The land has no practical use to the City and will be better utilized for the proposed
hotel improvements.
RECOMMENDATION /CONDITIONS
Staff recommends approval of the land disposition of partially vacated Ceape Avenue as requested.
The Plan Commission approved of the land disposition as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area. He explained that the
right -of -way serves no purpose to the City and the City has no issues with the vacation request.
Typically half of the vacated land goes to each adjoining property owner however, in this case, the
City has no use for their portion of the vacation and the land is needed for the proposed private
sidewalk for the hotel. Therefore the City has agreed to dispose of the City's portion of the
vacation to the hotel property with the condition that the City retains frill utility easements within
the vacated right-of-way.
