PURPOSE: APPROVAL OF CHANGES IN LEASED AND PERMIT PARKING
AREAS
INITIATED BY: PARKING UTILITY COMMISSION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27-48
AND 27-49 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PERMIT
PARKING AREAS AND LEASED PARKING AREAS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 27-48 of the Oshkosh Municipal Code pertaining to
permit parking areas is hereby repealed and recreated as follows:
SECTION 27-48 PERMIT PARKING AREAS
The following areas are reserved for permit parking, as defined in Section
27-46, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on
Sundays and holidays.
(A) Algoma Boulevard Lot: The westerly row of the second aisle and those
stalls facing Brown Street.
(B) Ceape Avenue Lot: The two northernmost rows, except the fifteen (15)
most westerly spaces in the northernmost row.
(C) Division Street Lot: The eight (8) most northerly stalls bordering
Division Street.
(D) High Avenue Lot.
(E) Jefferson Street Lot: The north-south row of stalls on the western side
of the eastern driving aisle, north of the northernmost driveway; and
the eleven (11) stalls immediately north and the seven (7) stalls
immediately south of the northernmost driveway, on the perimeter of
the lot bordering Jefferson Street. The northern four (4) and the
southern (8) stalls on the perimeter of the lot bordering Jefferson Street
are reserved.
(F) Library Lot: the perimeter stalls on the northern edge of the lot, and the
thirteen (13) most northerly stalls on the perimeter of the lot bordering
Mt. Vernon Street.
(G) Otter East Lot: The ten (10) most southern stalls in the westernmost
row of stalls.

(H)Otter Avenue Lot: The southern row.
(I) Pearl Avenue Lot: All stalls except the easterly row of stalls.
(J) State Street Lot: The three southern rows in the western section of the
lot adjacent to State Street, and the second and third northernmost
rows in the eastern section of the lot. The northernmost row in the
western section of the lot is reserved.
(K)Washington Avenue Lot: The five (5) easternmost stalls in the southern
row.
(L) 400 Block West Parking Lot: The perimeter stalls bordering Church
Avenue, the perimeter stalls bordering Division Street, the perimeter
stalls bordering Algoma Boulevard, the five (5) stalls in the southeast
corner facing towards Main Street, the twelve (12) southernmost stalls
in the far west north/south row located adjacent to Algoma Boulevard,
and the second east/west aisle south of Church Avenue.
(M)West 8th Avenue Lot: All stalls except the five southernmost stalls in
the westernmost row.
(N)West 10th Avenue Lot: The western row of the center aisle.
SECTION 2. That Section 27-49 of the Oshkosh Municipal Code pertaining to
leased parking stalls is hereby repealed and recreated as follows:
SECTION 27-49 LEASED PARKING AREAS
(A) Designation of 24-Hour Leased Stalls. The following described parking
areas are designated and established as parking areas to be leased on
a monthly basis. Enforcement of these residential parking stalls shall
be all days, 24 hours per day. These stalls shall be leased to residents
within the BID district boundaries.
(1) Ceape Lot: The fifteen (15) most westerly stalls in the northernmost
row.
(B) Designation of Daytime Leased Stalls. The following described parking
areas are designated and established as parking areas to be leased on
a monthly basis. Enforcement of the monthly parking stalls shall be
between 7:00 a.m. and 6:00 p.m. except as otherwise provided herein.
(1) Otter East Lot: the ten (10) most southerly stalls in each of the four
eastern rows of stalls.
(2) Recreational Gym Lot, the northern three rows of stalls. The
remained stalls are reserved.

(3) West 9th Avenue Lot, the northerly most stall of the southerly most
section on the east side, and the four most northerly stalls in the
western row.
(C)Leased Stall Fees. The Common Council shall establish fees for
parking stalls leased under this section.
SECTION 3. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate signage.
SECTION 4. Publication Notice. Please take notice that the City of Oshkosh
enacted ordinance #12-506 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH
AMENDING SECTIONS 27-48 AND 27-49 OF THE OSHKOSH MUNICIPAL CODE
PERTAINING TO PERMIT PARKING AREAS AND LEASED PARKING AREAS), on
October 9, 2012. The ordinance converts many of the City's leased parking areas into
permit parking areas.

AREAS

CONVERSION OF LEASED PARKING TO PERMIT PARKING
Leased parking, where an individual can lease a particular parking space, is currently available in
many of the Parking Utility's lots. Leased spaces are generally priced from $20 to $30 per month,
based on whether the space is available for daytime hours or 24 hours. Individuals who lease
spaces will give information to Parking Utility staff about the license plate numbers which may
park in a particular space; this list is then used by the Oshkosh Police Department to support
enforcement.
An increasing number of issues have arisen with leased parking that are leading to staff's
recommendation for conversion of many of these spaces to permit parking. These issues include
the following:
• The hours that each stall is leased may vary, leading to confusion among stall lessors,
non-lessors who wish to use the space, and enforcement.
• If a person leasing a space comes home at night and expects to find their space available,
they will need to call OPD for enforcement. Response time at night for issues with leased
parking may be delayed, which does not help the basic issue that a person is looking for a
place to park, and it is difficult to find whose vehicle is occupying the space.
• Setting aside some stalls as leased can reduce parking lot capacity for other users. While
not an issue in all lots,this is a particular issue for daytime events that occur at the Grand
Opera House, which often rely heavily on parking in the High Avenue lot.
• OPD does not necessarily know whether a person who has leased a space is current with
their lease payment.

Explanation of Revised Pay and Display Agreement
According to Parking Utility staff, most leased spaces are used by employees or residents, who
could easily switch to buying parking permits instead. These permits are issued monthly, so it
would be easier to ensure that individuals are current with their payment. The permits are offered
at the same price as most leased spaces, so there would be no out-of-pocket cost difference for
lessors.
Staff recommends converting the following leased spaces to permit parking:
• All fifteen(15) daytime (7 AM-6 PM) leased stalls in the Algoma lot
• Both(2) daytime leased stalls in the Jefferson lot
• All 53 daytime discounted leased stalls in the High Avenue lot
• All 22 daytime leased stalls in the Pearl Avenue lot
• All 23 daytime leased stalls in the State Street lot
• All 37 daytime leased stalls in the 400 Block West lot
• All eight(8) 24-hour leased stalls in the Division Street lot
• All twenty-five (25) leased stalls in the 8th Avenue lot
• All eleven (11) leased stalls in the 10th Avenue lot
Leased parking would be preserved in the following lots,which tend to be in satellite locations
where parking utilization levels are lower and fewer problems have been encountered:
• Ceape Avenue (15 spaces)
• Otter East Lot(40 spaces)
• Rec Department Lot(26 spaces)
• 9th Avenue Lot(5 spaces)
