SEPTEMBER 25, 2012 OCTOBER 9, 2012 12-482 12-504 ORDINANCE FIRST READING SECOND READING (CARRIED __7-0____LOST ________LAID OVER ________WITHDRAWN ________) PURPOSE: APPROVE INTERMEDIATE ATTACHMENT OF PROPERTIES FROM TOWN OF ALGOMA EFFECTIVE MARCH 1, 2013 PER APPROVED COOPERATIVE PLAN; ZONE A GENERALLY LOCATED NORTH OF WAUKAU AVENUE, EAST OF USH 41, SOUTH OF WEST 20TH AVENUE INITIATED BY: COMMUNITY DEVELOPMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ATTACHING CERTAIN TERRITORY TO THE CITY OF OSHKOSH The Common Council of the City of Oshkosh do ordain as follows: WHEREAS, in January, 2004, the City of Oshkosh and Town of Algoma adopted a Cooperative Plan as set forth in Section 66.0307, Wis. Stats., and said Plan was approved by the Wisconsin Department of Administration; and WHEREAS, said Plan calls for the attachment of various properties identified as Zone A in the approved Cooperative Plan, and per the attached map and excerpt from said Cooperative Plan, effective March 1, 2013. NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. The following described territories are hereby attached to and made part of the City of Oshkosh, a municipal corporation located in Winnebago County, more specifically to the following Wards of said City and subject to Wisconsin Statutes and the amendments thereto: (see attached “Exhibit A” for legal descriptions) Attachment Area #1: 13th Ward Attachment Area #2: 13th Ward Attachment Area #3: 13th Ward Attachment Area #4: 13th & 14th Wards Attachment Area #5: 14th Ward Attachment Area #6: 14th Ward SEPTEMBER 25, 2012 OCTOBER 9, 2012 12 -482 12 -504 ORDINANCE FIRST READING SECOND READING CONT'D SECTION 2. Sections 1 -28 and 1 -29 of the Oshkosh Municipal Code pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to reflect the provisions of this Ordinance and the proper City officials are hereby authorized and directed to make such changes. SECTION 3. The proper City officials are hereby authorized and directed to comply with the following requirements of Section 66.0217(9)(a) and 66.0307(10) of the Wisconsin Statutes and the City Clerk shall give written notice to the Secretary of State. map: SECTION 4. The Plan identifies 4 areas of the town that will be "attached" to the city in phases commencing in 2013 with the first phase, Zone A attachments, and ending in 2043 with the Zone D attachments. The Zone A attachments generally include all areas of the Town east of US 41. City Administration is now moving forward with the Interrrrediate Attachment Ordinance of the Zone A properties with an effective date of March 1, 2013 pursuant to the Cooperative Plan. ANALYSIS Zone A includes 52 parcels of land totaling approximately 158 acres of land with an assessed value of $45 million. The majority of parcels (29) and value ($4.1 million) are in single family residential properties. The largest area is in airport usage at 93 acres. The attached table provides a breakdown of the land uses and values for the Zone A Attachments. All properties are being attached with their current extraterritorial zoning designation. Meaning a property that is currently zoned R -1 ETZ will be attached as an R -1 property and so on. Any changes to the zoning will be addressed through the city's routine zone change process which would involve a recommendation from the Plan Commission, Zone A can be described as a number of isolated town islands or peninsulas created by the expansion of the city which by being isolated creates some service issues for the Town and/or County. City services are already provided to the surrounding areas so service provision should not be an issue for the attachment area nor would expansion of city services be anticipated because of the attachments. Because of the March I" effective date of the attachments, the properties will not be added to the city's property tax rolls until 2014. Also, because of the delayed effective date of the attachments not coinciding with the calendar year, there may be some service issues or concerns with such things as dog licenses, garbage pick up, snow plowing, etc. City administration is currently coordinating a meeting to discuss any potential city /town /county service issues that may need to be addressed because of the effective date of the attachment. City and Town staffs have already started to identify and discuss potential issues caused by the March 15r effective date and will be working to resolve them as practicably as possible and pass that information along to the appropriate parties. FISCAL IMPACT No unnecessary or unusual services are anticipated to be provided to the newly attached properties over and above what is already being provided to the adjacent areas located within the City. RECOMMENDATION Staff recommends approval of the Intermediate Attachment Ordinance pursuant to the terms of the duly adopted and State approved Cooperative Plan between the City of Oshkosh and Town of Algoma.
