PURPOSE: APPROVE ACCEPTING STORM SEWER EASEMENT AT
1324 BISMARCK AVENUE

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to accept a storm sewer
easement from Mr. and Mrs. Lester Laabs at 1324 Bismarck Avenue, per the attached,
and to execute any and all documents necessary for purposes of same.

BACKGROUND
The Department of Public Works is requesting acceptance of a storm sewer easement for the
installation of storm sewer and a catch basin at the northeast property corner of 1324
Bismarck Avenue along S. Lark Street. The subject property is located in a predominantly
low- density residential neighborhood. The proposed easement is 10 -foot wide by 15 -foot
deep, located on the west side of S. Lark Street at the eastern side of the subject property.
ANALYSIS
Neighborhood drainage in the immediate area causes storm water runoff to flow across the
public sidewalk on the west side of S. Lark Street causing public nuisance and hazard from
ice build -up. Area property owners contacted the City to determine if any mitigation
measures could be conducted to eliminate the problem and after an inspection by the
Department of Public Works, a proposal was initiated to install a yard drain behind the public
sidewalk to capture runoff and convey it into the City's storm water system prior to reaching
the sidewalk. The Department of Public Works has met with the property owner and the
appropriate documents will be signed and recorded at the Winnebago County Register of
Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its October 2, 2012 meeting.

GENERAL INFORMATION

Action Requested:
The Department of Public Works is requesting acceptance of a storm sewer easement for the
installation of storm sewer and a catch basin at the northeast property corner of 1324 Bismarck Avenue
along S. Lark Street.
Applicable Ordinance Provisions: N/A
Property Location and Type /Analysis:
The subject property is located in a predominantly low - density residential neighborhood. The proposed
easement is 10 -foot wide by 15 -foot deep, located on the west side of S. Lark Street at the eastern side
of the subject property.

documents will be or have been signed. After review by the Plan Commission and approval by the
Common Council, the easement will be recorded at the Winnebago County Register of Deeds.
RECOMMENDATION /CONDITIONS
Staff recommends approval of the acceptance of the proposed storm sewer casement as requested.
The Plan Commission approved of the proposed easement as requested. The following is.the Plan
Commission's discussion on this item.
Mr. Fojtik inquired if the owner has approved of the request.
Mr. Gohde stated staff has worked with the owner to address this issue.
Motion by Yajgrt to accept the easement as requested.
Seconded by Bowen. Motion carried 9 -0.

Project Narrative
Neighborhood drainage in the vicinity of 1324 Bismarck Avenue currently causes water to flow across
the public sidewalk, and down the sidewalk to the nearest driveway. Drainage from an area roughly
bounded by South Eagle Street on the west, 4'h Avenue on the north, Bismarck Avenue on the south, and
South Lark Street on the east drains through the property at 1324 Bismarck Avenue. This drainage
pattern creates a nuisance and hazard on the public sidewalk in front of 1324 Bismarck Avenue. The
Property owners contacted the Department of Public Works to evaluate alternatives to mitigate the
nuisance and hazard. In order to provide a reasonable mitigation of these issues, the Department of
Public Works proposes to install a yard drain behind the public'sidewalk to capture runoff and convey it
to the storm sewer system prior to the runoff reaching the public sidewalk.
The purpose of the easement is to provide for drainage,and storm sewer system conveyance. A yard
drain and storm sewer will be installed, and the area will be graded to drain to the yard drain. The work
will be performed in conjunction with the City's Mini -Storm / Storm Lateral contract in 2012.
