HomeMy WebLinkAbout05. 12-492 OCTOBER 9, 2012 12-492 RESOLUTION (CARRIED __7-0____LOST ________LAID OVER ________WITHDRAWN ________) PURPOSE: AUTHORIZE SUBMITTAL OF EPA BROWNFIELDS ASSESSMENT GRANT FOR PETROLEUM AND HAZARDOUS SUBSTANCE GRANT TO BE USED IN DESIGNATED REDEVELOPMENT AREAS AND AT SCATTERED SITES THROUGHOUT THE COMMUNITY INITIATED BY: COMMUNITY DEVELOPMENT WHEREAS, the Environmental Protection Agency (EPA) has funds available in the form of grants for brownfields revitalization; and WHEREAS, the City of Oshkosh desires to apply for Petroleum and Hazardous Substance Assessment Grants to be used in designated redevelopment areas and at scattered sites throughout the community. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to submit a grant proposal to the Environmental Protection Agency to obtain funds for said purpose. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to execute any and all documents and assurances which may be required by the Environmental Protection Agency. BE IT FURTHER RESOLVED that if said grant funds are awarded, the proper City officials are hereby authorized and directed to accept said funds, pursuant to the terms of the grant applications, and to execute any and all documents necessary for purposes of same. xF' OJHKOJH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: October 3, 2012 RE: Approve Submittal of EPA Brownfields Assessment Grant for Petroleum And Hazardous Substance Grant to be Used in Designated Redevelopment Areas and on Scattered Sites BACKGROUND/ANALYSIS On January 11, 2002, President Bush signed into law the Small Business Liability Relief and Brownfields Revitalization Act. This Law expands potential federal financial assistance for brownfield revitalization, including grants for assessment and cleanup. The Brownfields Law requires a 20 percent cost share for cleanup grants but no match is required for assessment grants. Grant funds cannot be used for administrative costs or for past costs on the brownfield sites. The Brownfield Assessment application would be for properties contaminated with petroleum or hazardous substances. A"community-wide" application will be prepared so that the funds can be used to assess multiple properties either within designated redevelopment areas or on scattered sites as potential acquisitions/redevelopment sites come forward. The city has previously received and administered Assessment grants in the past, with the latest grant expiring in July 2012. These funds have been used to assess properties in the Fox River Corridor for riverwalk improvements, the Central Garage expansion project, and to work through the DNR's submittal requirements for the VPLE and COC for parcels in the Marion Road Redevelopment Area. FISCAL IMPACT None anticipated. If awarded, the maximum grant amount is $200,000. RECOMMENDATION The City Council approves submittal of the grant application to the EPA. Approved City Manager
