PURPOSE: APPROVE AMENDMENT TO PROFESSIONAL SERVICE
AGREEMENT WITH AECOM FOR ENVIRONMENTAL
ENGINEERING SERVICES FOR THE PROPOSED RIVERWALK
IMPROVEMENTS AT BOAT WORKS PROPERTY (+$121,000)
INITIATED BY: COMMUNITY DEVELOPMENT
WHEREAS, AECOM is a consulting firm that provides professional services with
expertise in a number of areas including environmental engineering; and
WHEREAS, the City and AECOM previously entered into a professional services
agreement in which AECOM would provide the City with engineering and environmental
services associated with obtaining a Chapter 30 permit from the Wisconsin Department of
Natural Resources (DNR) for riverwalk improvements at the former Boat Works property
on Michigan Street; and
WHEREAS, due to the proposed scope of the project, the DNR is requesting input
and review from the Army Corp. of Engineers and US Coast Guard, which entities have
requested detailed geotechnical engineering reports, more detailed design plans, and
additional permit submittals, and it is efficient and beneficial to achieve this requirement by
amending the existing agreement with AECOM.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-
16 of the Municipal Code to enter into an amended agreement with AECOM, 558 North
Main Street, Oshkosh, WI 54901 in substantially the same form as the attached
amendment and said City officials are authorized and directed to take those steps
necessary to implement the terms and conditions of the amended Agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from Acct. No. 534-1040-6401-07280 TIF #20 South Shore Redevelopment

SUBJECT: Approve Amendment to Professional Service Agreement with AECOM for
Engineering Services for Riverwalk Improvements at Boat Works Property
BACKGROUND
The Community Development Department requested a design and permitting services contract
amendment from AECOM for the design and permitting of the future redevelopment of the
Boatworks Property on the northeast quadrant of Michigan St. and 4th Ave.
ANALYSIS
The amended scope of services is related to the design, mapping, and permitting process
required with the Wisconsin Department of Natural Resources, US Coast Guard and Army
Corps of Engineers. The scope of the project would include the riverwalk extension, including a
bridge system, dredging of the docking area, docks and a possible boat landing, and other
public improvements on the property. Environmental remediation will also play a large role in
this segment of the river walk project and property redevelopment. The original contract for
preliminary design and initial WisDNR permitting was for $47,500 and was approved this spring.
The contract amendment totals $121,000 for a total contract price of$168,500. Staff has been
working on multiple grant applications in concert with AECOM design and permitting for the 2013
construction season for trail construction, site remediation, and possible dredging projects for
the Boatworks property with the Redevelopment Authority, the owner of the property.
FISCAL IMPACT
The funds for these professional services are included in the approved 2012 Capital
Improvement Program, and are available in Account Number 534-1040-7216-07280.
Construction for this segment of the riverwalk is scheduled for the 2012 and 2013 Capital
Improvement Program.
RECOMMENDATION
The City Council approves the contract amendment as presented.

1.Additional Costs to date - $15,000
These costs are for the preparation of the
response to the U.S. Army Corps of
Engineers' (USACE`s)comments, the initial
review and discussion with the U.S. Coast
Guard (USCG)of their requirements for the
bridge permit, and follow-up conversations
with the WIDNR to get clarification on the
requirements for the Chapter 30 permit and
for what they require relative to the other
agencies requirements.
2. Engineering $39,000
2 (a). Initial Bridge Design-$19,000
These costs include the minimum design
drawings necessary to address the USCG
permit for the approval of the pedestrian
bridge permit It includes the preparation of
the design drawings and an initial cost
estimate for the bridge.
2 (b). Geotechnical Engineering-$20,000
This is for the geotechnical engineering
required for the bridge foundations, the piers,
and the shoreline improvements.

3. State and federal permitting $47,000
3(a). Preparation of USCG permit—$ 12,000
These costs are those necessary to take the
bridge design and incorporate the required
information from the Environmental Section
described below as Task 3(b) into the permit
application to submit an application meeting
the requirements as specified in the USCG
permit guidance document formatted in a
manner that will expedite the permit process.
3(b). Environmental Section-$20,000
This section is required to be completed in
accordance with: National Environmental
Policy Act(NEPA) of 1969 (Section
102[2][c]), as implemented by the Council on
Environmental Quality(CEQ) regulations (40
CFR parts 1500-1508)for the bridge
installation, the modifications to the
shoreline, and the dredging process. The
work to be completed in this section overlaps
with the WDNR, USACE, and USCG
requirements for the project. Following
discussions with the USCG, this project will
not require an Environmental Assessment
(EA), and qualifies for a Categorical
Exclusion (CatEx). To fulfill the requirements
of the permit and document the CatEx, a
natural resources survey(includes
threatened and endangered species,
wetlands,floodplain, and terrestrial and
aquatic habitats)and a cultural and historical
review and consultation with the State
Historic Preservation Office(SHPO). The
activities will include a site/project survey and
consultations with the appropriate state and
federal agencies to expedite the review and
approval process.
3(c). Dredging plan and WIDNR Permitting-
$10,000
This is for the preparation of the dredging
plans and the compilation of the figures for
submittal of the information required for the
WDNR to approve the permitting of the
Bridge and the associated improvements,
and the issuance of the Chapter 30 permit.

This includes the collection of additional
sediment and soil (landward)samples for
profiling for landfill acceptance of the dredge
spoils and contaminated soil removed during
demolition and construction.This information
is required in the dredging plan for the
WDNR.
4. Project Management-$15,000 $15,000
This is to cover the cost of 3-meetings with
the various agencies to address their
comments on the draft documents, to revise
the submittals, and to prepare a final set of
plans and submittals. It also includes money
for the grant oversight function.
