Home My WebLink About45. 12-485 SEPTEMBER 25, 2012 12-485 RESOLUTION (CARRIED__7-0_____ LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: APPROVE & EXECUTE REVISED RELOCATION ORDER; DETERMINATION OF NECESSITY TO ACQUIRE TEMPORARY LIMITED EASEMENTS FOR CONSTRUCTION OF JAMES ROAD DETENTION BASIN INITIATED BY: PUBLIC WORKS PLAN COMMISSION RECOMMENDATION: Voted 4-4 on Motion WHEREAS, on September 15, 2010 by Resolution 10-297 Council approved a relocation order for acquisition of property to construct the James Road storm water detention basin; and WHEREAS, the Department of Public Works has completed further study of the area and is recommending acceptance/acquisition of a temporary limited easement for construction access to the proposed storm water detention area, on properties owned by Mr. and Mrs. Wesley Radloff and Mr. and Mrs. Kevin Radloff, more particularly described in the attached, pursuant to the recommendations contained in the Sawyer Creek Stormwater Management Plan. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the Common Council determines that it is necessary and a public purpose for the City to accept/acquire a temporary limited easement for construction access to the James Road storm water detention area, as described in the attached. BE IT FURTHER RESOLVED by the Common Council that this resolution constitutes a Revised Relocation Order for acceptance/acquisition of an easement described in the attached in accordance with the title acquisition procedure set forth in Wisconsin Statutes, section 32.05, said property being in the area of State Road 91 at James Road. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to execute any and all documents necessary for implementation of this revised order and that a certified copy of this Resolution shall be filed with the Winnebago County Clerk within twenty (20) days of its adoption. BE IT FURTHER RESOLVED that this Resolution shall be effective immediately upon its passage and publication.
