BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts easements from
a) Charles & Marilyn Perry Living Trust at Brookside Apartments,
667 North Westfield Street (tax #916-0871-0000)
b) Charles & Marilyn Perry Living Trust at Maple Court Apartments,
1770 Taft Avenue (tax #916-0870-0100)
c) Victor & Elizabeth Cortez at Sangria’s Mexican Grill, 700 North Koeller Street
(tax #916-0870-0102)
per the attached map, for a dredging project and long term maintenance of Sawyer
Creek, and the proper City officials are authorized and directed to execute any and all
documents necessary for purposes of same.

Westfield Street(Plan Commission recommends approval)
BACKGROUND
The subject site involves the section of Sawyer Creek which flows from N. Koeller Street to N.
Westfield Street between Robin and Taft Avenues. The three properties the City is proposing to accept
easements from include two apartment complexes (Maple Court Apartments and Brookside
Apartments) and one restaurant (Sangria's Mexican Grill). The surrounding area is a mix of high-
density residential to the north and south, commercial uses to the west and Red Arrow Park to the east.
ANALYSIS
The three easements include portions of Sawyer Creek, the creek bank and adjoining areas. The
proposed easements will allow the City to perform maintenance on Sawyer Creek as part of the City's
storm water management system to alleviate flooding problems in the immediate area and the entire
Sawyer Creek Watershed. Currently the properties adjacent to the creek are responsible for
maintenance; however, the creek has accumulated sediment and debris requiring removal. The City is
conducting a dredging project to increase the ability of Sawyer Creek to convey runoff and reduce
flooding in the surrounding area. In addition, the City will be restoring and reinforcing the creek banks
where severe erosion has occurred. These improvements were identified in the Sawyer Creek Storm
Water Management Plan and is scheduled for and included in the 2012 Capital Improvement Program.
The Department of Public Works and the City Attorney will work with the property owners to have
appropriate easement documents signed and recorded at the Winnebago County Register of Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its September 18, 2012 meeting.

CREEK FROM N. WESTFIELD STREET TO N. KOELLER STREET

GENERAL INFORMATION

Action Requested:
The City of Oshkosh Department of Public Works is requesting the City to accept three easements
in relation to a dredging project and long-term maintenance of Sawyer Creek from N. Koeller Street
to N. Westfield Street.
Applicable Ordinance Provisions: N/A
Property Location and Type:

Easement 1, Brookside Apartments, 667 N. Westfield Street—The first easement varies in width
from 75 feet wide, more or less centered along the north-south and east-west portions of the creek to
40 feet wide along the south bank near the west side of the property. Sawyer Creek makes two near
90° bends as it flows northeast causing severe erosion and spillage at the bends.
Easement 2, Maple Court Apartments, 1770 Taft Avenue—The second easement request is 40 feet
wide and approximately 366 feet long, located along the southern bank of Sawyer Creek(north side
of the property) which flows northeast towards the Brookside Apartment property.
Easement 3, Sangria's Mexican Grill, 700 N. Koeller Street—The third easement request is 40 feet
wide, approximately 215 feet long located along the southern bank of Sawyer Creek (north side of
the property) which flows northeast towards the Maple Court Apartment property.
The easements and work associated with improving Sawyer Creek were identified in the Sawyer
Creek Storm Water Management Plan. Dredging and improvements to the banks is scheduled for
2012 and is included in the 2012 Capital Improvement Program.
The Department of Public Works and City Attorney will work with the property owners to have
appropriate easement documents signed and recorded at the Winnebago County Register of Deeds.
Staff supports these easement requests as this is one of many either proposed or completed projects
which will help alleviate flooding problems in the immediate area and the whole Sawyer Creek
Watershed.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the acceptance of the proposed easements as requested.
The Plan Commission approved of the acceptance of the proposed easements as requested. The
following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and
zoning classifications in said area. He explained that the easement request is in conjunction with a
dredging project conducted by the City to remove accumulated sediment and debris to increase the
ability of Sawyer Creek to convey runoff. He reviewed maps of each of the three easement requests
and stated that these easements were identified in the Sawyer Creek Storm Water Management Plan
and included in the 2012 Capital Improvement Program. The Department of Public Works and City
Attorney will work with the property owners to have the appropriate easement documents signed
and recorded at the Winnebago County Register of Deeds.
Ms. Propp questioned if these easements would be permanent.
Mr.Nau responded affirmatively.
Mr. Thorns inquired if the City would be responsible to maintain these areas after the easements are
approved rather than the property owners.
Mr.Nau again responded affirmatively.
Mr. Hinz commented that alleviating the flooding issues in the community was one thing that the
citizens were strongly supporting.
Motion by Nollenberger to approve the acceptance of easements south of Robin Avenue
along Sawyer Creek from N. Westfield Street to N. Koeller Street.
Seconded by Vajgrt. Motion carried 9-0.
