HomeMy WebLinkAbout04. 12-429 SEPTEMBER 11, 2012 12-429 RESOLUTION (CARRIED___6-0____LOST_______LAID OVER________WITHDRAWN_______) PURPOSE: APPROVE SETTING PUBLIC HEARING DATE TO VACATE PORTION OF CEAPE AVENUE AT CEAPE/COMMERCE INTERSECTION INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, it appears that the public interest requires that that portion of the following described street or alley within the City of Oshkosh be vacated and discontinued: Partial Street Vacation / Ceape Avenue As described in the attached “Exhibit A” NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that a hearing on the passage of the following resolution shall be held before the Common Council in the Council Chambers in the City Hall, City of Oshkosh, Winnebago County, Wisconsin, on Tuesday, October 23, 2012 at 6:00 PM of said day and the proper City officials are hereby authorized and directed to give notice of said hearing by personal service and publication of said hearing as provided by law. Ir= z { / •/ oo ` / / / V)I- / / / / / / / / / / ,-b6.00Z'L 3„1. ,g LOOS CO O.IHKOJH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: September 6, 2012 RE: Approve Setting Public Hearing Date to Vacate Portion of Ceape Avenue at Ceape/Commerce Intersection (Plan Commission recommends approval) BACKGROUND Council is being asked to set a public hearing date for a proposed right-of-way (ROW) vacation for a small section of Ceape Ave ROW adjacent to the City Center hotel property. The land to be vacated is to be utilized as part of proposed improvements to the former City Center Hotel. State Statutes require that the public hearing be held no less than 40 days after the introductory resolution which would set the public hearing date for this request no earlier than the Council's October 23rd meeting. ANALYSIS The new hotel owners approached the City to vacate the subject piece of Ceape Avenue right-of-way as part of their renovation of the former City Center Hotel. Plans provided show construction of a decorative sidewalk along an oversized area of Ceape Avenue which, as designed, would encroach through this section of Ceape Avenue. Since the Department of Public Works does not permit the use of decorative paving features within the ROW, and since this area of Ceape Avenue is not necessary for right-of-way purposes, staff is recommending to vacate this portion of ROW but to retain utility easements in the vacated area. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its September 4, 2012 meeting. Approved, City Manager ITEM: PARTIAL STREET VACATION OF CEAPE AVENUE LOCATED ADJACENT TO 1 N. MAIN STREET Plan Commission meeting of September 4, 2012 GENERAL INFORMATION Applicant/Owner: City of Oshkosh Actions Requested: The applicant requests the vacation of a portion of Ceape Avenue public right-of-way. Applicable Ordinance Provisions: WI State Stats. 66.1003 regulate the discontinuance of a public right-of-way. Property Location and Background Information: The area in this request involves a triangular section, approximately 444 square feet of the southwestern portion of Ceape Avenue right-of-way. The land to be vacated is to be utilized as part of proposed improvements to the former City Center Hotel by Oshkosh Investors, LLC and the University of Wisconsin Oshkosh Foundation. Plans provided show construction of private decorative sidewalk along Ceape Avenue which, as designed, would encroach into the right-of-way of Ceape Avenue. Upon review, staff determined that this section of right-of-way is no longer needed and supports this vacation request. Whenever the City vacates a portion of right-of-way, typically half of the vacated land goes to one adjoining property and the other half goes to the opposite adjoining property. In this case, Oshkosh Investors, LLC will receive the "southeastern half of the land in this vacation and the City will receive the northwestern half, as the City is the other adjoining land owner to this vacation. Since the City has no use for their portion of the vacation and is land needed for the proposed private sidewalk for the hotel, the City has agreed to dispose the City's portion of the vacation to the hotel property (Item B). The Department of Public Works has reviewed the proposed vacation and does not see any issues or concerns with the request as the right-of-way is not needed, but requires retention of full utility easements within the former right-of-way. RECOMMENDATION/CONDITIONS Staff recommends approval of the partial vacation of Ceape Avenue as requested with the following condition: 1) The City retains full utility easements within the vacated right-of-way. The Plan Commission approved of the partial street vacation of Ceape Avenue as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area. He explained that the right-of-way serves no purpose to the City and the City has no issues with the vacation request. Typically half of the vacated land goes to each adjoining property owner however, in this case, the City has no use for their portion of the vacation and the land is needed for the proposed private sidewalk for the hotel. Therefore the City has agreed to dispose of the City's portion of the vacation to the hotel property with the condition that the City retains full utility easements within the vacated right-of-way. Motion by Vajgrt to approve the partial street vacation of Ceape Avenue located adjacent to 1 N. Main Street and to approve the land disposition of a portion of vacated Ceape Avenue with the following conditions: 1) The City retains full utility easements within the vacated right-of-way. Seconded by Bowen. Motion carried 8-0.
