PURPOSE: ESTABLISH 2012 AND 2013 FEES FOR THE COLLECTION OF
EXCESS REFUSE AND GARBAGE WITH AUTOMATED
COLLECTION PROGRAM
INITIATED BY: PUBLIC WORKS DEPARTMENT
WHEREAS, the Common Council on February 28, 2012 through Resolution 12-
94 directed and authorized City staff to implement a program for the automated
collection of refuse and garbage materials within the City of Oshkosh; and
WHEREAS, the Common Council on April 10, 2012 through Ordinance 12-170
amended Section 23-7(A)(1) of the Municipal Code by setting the maximum volume of
refuse/garbage collected per residential dwelling unit at 96 gallons per week; and
WHEREAS, Municipal Code Section 23-7(A)(1), as amended through Ordinance
12-170, also provides that the owner of each residential dwelling will be charged fees
for the collection refuse/garbage per residential dwelling unit in amounts exceeding 96
gallons per week; and
WHEREAS, Municipal Code Section 23-7(A)(1), as amended through Ordinance
12-170, also provides that fees for excess refuse/garbage collected per residential
dwelling unit shall be established through a Resolution by the Common Council on an
annual basis.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the City’s fee for collecting excess refuse/garbage at residential dwelling
unit for the calendar years 2012 and 2013 shall be $10.00 per sticker for disposal of
each additional plastic bag or small item, and that the plastic bag for excess
refuse/garbage shall otherwise conform to the criteria of Chapter 23 of the Municipal
Code, and that any excess small item not in a plastic bag shall be of a size not larger
than will otherwise fit in the solid waste cart with the lid closed.
BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh
that the City’s fee for collecting excess refuse/garbage by having more than one Solid
Waste Cart at a residential dwelling unit for the calendar years 2012 and 2013 shall be
$180.00 per calendar year, per additional Solid Waste Cart, with the excess Solid
Waste Cart fee to be prorated based upon the date of the fee is authorized, the date
such excess Solid Waste Cart service is commenced, or the date such excess Solid
Waste Cart service is discontinued.

BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh
that pursuant to Section 66.0627, Wisconsin Statutes, and other applicable laws, the
excess Solid Waste Cart fees shall constitute a special charge for current services
provided against the real property containing the residential dwelling unit and shall be
added to that property's real estate tax bill without further notice.
BE IT FURTHER RESOLVED that the appropriate City officials are authorized
and directed to take those steps necessary to implement these fees for collection of
excess refuse/garbage to become effective with the commencement of automated
refuse/garbage collection in the City of Oshkosh.

Program
BACKGROUND
Per Ordinance 12-170, the Common Council established the maximum volume of refuse/garbage collected per
dwelling unit as 96 gallons per week. This ordinance also required that fees be established by resolution for the
collection of excess refuse/garbage.
ANALYSIS
The 64-gallon cart was established as the standard size for the automated collection program. Per the responses to
our mailer, approximately 6,000 properties selected an upgrade to the 96-gallon size and approximately 14,700
properties will be getting the standard 64-gallon size. We have approximately 25 properties that have requested
service with an additional cart at their dwelling unit. For those properties, we have calculated a collection cost as
follows:
200 pounds per week @ $35/ton tipping fee = $180/year
We would propose that a full year charge for 2013 and a prorated charge for 2012 be allocated as a special charge
on the tax bills for these properties.
In addition, we want to establish a $10 charge per sticker for disposal of each additional bag or small item that
would normally have been placed in the automated cart. We plan on distributing three free stickers with each cart
so that residents have the ability to gauge automated cart use for any special event (i.e. family reunions, holidays,
graduations, etc.). We set the individual sticker price to discourage regular sticker usage. If a resident uses one
sticker per week, it will be more cost effective for them to buy another cart and pay the additional $182 yearly
collection fee versus using the sticker program. We want to maximize the usage of the automated garbage cart to
enhance worker safety and program productivity. We will continue to collect all extra recycling carts for no charge
to promote recycling.
FISCAL IMPACT
We would estimate the additional 2013 revenue for excess refuse/garbage collection fees as follows:
25 properties @$180/unit= $4500
We are not anticipating revenue from the sale of stickers. We anticipate that residents will determine how to
process their garbage with no extra expense by coordinating with neighbors, holding material for the next week, or
upgrading to a 96-gallon container.
RECOMMENDATIONS
I recommend approval of this resolution.
