The City of Oshkosh, hereinafter referred to as CITY, and Kobussen Buses Ltd,
hereinafter referred to as the CONTRACTOR, entered into a contract for bus
transportation services on May 3, 2012.
The Scope of Work described in the existing contract included the provision of bus
service routes between Oshkosh and Neenah, with such service being described as
"intercity" service.
The CONTRACTOR and CITY agree that the population of both Oshkosh and
Neenah are included within the same Metropolitan Statistical Area as defined by the
ederal Government.
The CONTRACTOR has advised the CITY that pursuant to applicable rules and
:gulations governing the activities subject to the parties' contract, trips performed within
e same Metropolitan Statistical Area are defined as "intracity" bus service routes. The
CITY has reviewed the information provided by the CONTRACTOR and agrees.
In an effort to maintain consistent language with the rules and regulations governing
these transit activities, which include but are not necessarily limited to fuel tax refund
definitions, the parties agree to amend the terminology in their contract through this
amendment.
The parties agree that they each receive a business benefit through this
;7mendment, although there is no actual change in the services provided as a result of this
2mendment.
THEREFORE, the CITY and the CONTRACTOR agree to remove the first
paragraph, Article III Scope of Work, in their existing contract and replace it with the
paragraph that follows. All other terms in the May 3, 2012 contract remain unchanged and
effect.
ARTICLE III. SCOPE OF WORK
The Contractor shall provide intracity bus transportation services between
the City of Oshkosh and the City of Neenah. The scope of services is described in
more detail in the Request for Proposals (RFP) document, and in the Contractor's
proposal. Where these documents may conflict, this agreement and the RFP shall
control.
