PURPOSE: REPEAL CHAPTER 24 ARTICLE II PERTAINING TO STORM
DRAINAGE REGULATIONS (Now contained in Chapter 14 –
Storm Water Management)

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING ARTICLE II OF
CHAPTER 24 PERTAINING TO STORM DRAINAGE REGULATIONS, NOW CONTAINED
IN CHAPTER 14 – STORM WATER MANAGEMENT
WHEREAS, the Common Council adopted new Storm Water Management
Ordinances by Ordinance 12-345 on June 26, 2012, which updated and replaced the
provisions contained in Article II of Chapter 24.
The Common Council of the City of Oshkosh does ordain as follows:
SECTION 1. That Article II of Chapter 24 of the Oshkosh Municipal Code pertaining
to Storm Drainage Regulations is hereby repealed.
SECTION 2. That Chapter 24 is retitled Wastewater Systems.
SECTION 3. This ordinance shall be in full force and effect from and after its
passage and publication.
SECTION 4. Publication Notice.
Please take notice that the City of Oshkosh enacted ordinance #12-XXX REPEAL
CHAPTER 24 ARTICLE II PERTAINING TO STORM DRAINAGE REGULATIONS (Now
contained in Chapter 14—Storm Water Management), on August 28, 2012. The ordinance
repeals the prior regulations related to storm drainage which have been updated and
replaced by new regulations in Chapter 14 of the Municipal Code entitled Storm Water
Management. The ordinance also removes the reference to storm water from the title of
Chapter 24 which will now pertain only to Wastewater Systems.

RE: Ordinance to Repeal Article II of Chapter 24 pertaining to Storm Drainage
Regulations
BACKGROUND
The Common Council approved new storm water management ordinances at its meeting on
June 26, 2012.
ANALYSIS
Formerly the storm water regulations were contained in an article in Chapter 24 following
the wastewater regulations. During the revision process it was decided to separate the
wastewater regulations and storm water regulations into separate chapters. Chapter 14
was created pertaining to the updated and revised storm water management ordinances,
however the former regulations contained in Chapter 24 were inadvertently not repealed.
This ordinance would repeal the former regulations contained in Chapter 24 and rename
that Chapter to clarify that Chapter 24 will now only pertain to wastewater regulations.
FISCAL IMPACT
There is no fiscal impact to this proposed change.
RECOMMENDATION
It is recommended that the Council adopt the ordinance.
