PURPOSE: APPROVAL OF AGREEMENT WITH WASTE MANAGEMENT
WISCONSIN FOR DISPOSAL OF CONTAMINATED SOIL FROM
2012 STREET PAVING – UTILITY RECONSTRUCTION PROJECTS

BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized to enter into and take those steps necessary to
implement an appropriate agreement for professional services associated with
environmental contamination with Waste Management for tipping fees for the disposal of
contaminated soil from 2012 Street Paving and Utility Reconstruction Projects in the
amount of twenty-six dollars ($26.00) per ton for an estimated total cost of two hundred
thousand dollars ($200,000.00).

RE: Approval of Agreement with Waste Management-Wisconsin for Disposal of Contaminated
Soil from 2012 Street Paving-Utility Reconstruction Projects
(Estimated Total Cost$200,000)
During the preliminary design work for this year's street reconstruction contracts, AECOM was hired to
perform an environmental review for contaminated soils within scheduled project limits. Several locations
within the right of way were identified as areas of concern due to previous industrial activities that
occurred in those areas. Other smaller areas were also identified. Samples of soils containing
contamination were analyzed. The soil samples were determined to contained petroleum, heavy metals,
and other hazardous chemicals. It was determined the contaminated soil, excavated as part of the
projects, would need to be disposed of in a landfill. The closest landfill licensed to handle these materials
is the Waste Management Landfill located in Berlin, Wisconsin. AECOM worked with Waste
Management to secure the City a standard tipping fee for all of the contaminated soil of $26.00 per ton.
Each contract contains a bid price for hauling this type of material to the landfill.
It is estimated that the total estimated disposal cost for the contaminated soils in the 2012 Street Paving-
Utility projects is $200,000.
Funds for these services are available in the Street, Storm Sewer, Sanitary Sewer and Water Main
sections of the CIP.
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature may be procured without the use of formal, sealed quotes. I have reviewed the Waste
Management-Wisconsin agreement and in accordance with Section 12-16 of the Code, I am hereby
recommending that the Common Council approve the award of this agreement.
