($760,000.00) INITIATED BY: PURCHASING DEPARTMENT WHEREAS, the Transportation Department is replacing two 35’ Transit buses through a cooperative purchase program administered by the State of Minnesota; and WHEREAS, by participating with the State of Minnesota’s bus purchase agreement, staff was able to obtain a more competitive bus price; and WHEREAS, the State of Minnesota’s cooperative purchase procurement was awarded to New Flyer of America, Inc. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed pursuant to Section 12-15 of the Oshkosh Municipal Code to purchase two 35’ buses from: NEW FLYER OF AMERICA, INC. 711 Kernaghan Avenue Winnipeg, Manitoba Canada R2C 3TC Total: $760,000.00 BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to enter into an appropriate agreement for the purpose of same. Money for this purpose is hereby appropriated from: Acct. No. 511-1728-1756-00000 Transit Fund – Motor Buses CITY HALL 215 Church Avenue P.O.Box 1130 Oshkosh 903-1 30 City of Oshkosh 54903-1130 OIHKOIH TO: Honorable Mayor and Members of the Common Council FROM: Jon Urben, General Services Bureau Manager DATE: June 28, 2012 RE: Approve Purchase Pursuant to State of Minnesota Cooperative Transit Purchase for Two Buses- Transportation Department BACKGROUND The Common Council approved and allocated $760,000 in the 2012 CIP to purchase two 35' transit buses for the Transportation Department. These new buses will replace two 1997 40' New Flyer buses that are approaching significant maintenance/repair issues. The new units will be used in mass transit service for the Oshkosh Transit System. The new units will be more fuel efficient, significantly reduce emissions, and will come with a 2-year basic warranty covering major vehicle components. ANALYSIS With City Manager approval, the Transit Department joined a cooperative purchase program administered by the State of Minnesota. By participating with the State of Minnesota's bus purchase agreement, staff was able to obtain a more competitive bus price and save time versus conducting a new RFB process in-house. The State of Minnesota's cooperative purchase procurement was awarded to New Flyer of America, Inc. New Flyer is also the manufacturer of Oshkosh Transit System's existing bus fleet. The State of Minnesota's procurement process is compliant with Federal Transit Administration regulations, which is required by the federal source used for this project. FISCAL IMPACT These units will have a maximum total cost of$760,000. Federal funding will cover 57% of the cost ($436,000) with the remaining 43% covered by City funds ($324,000). The total fiscal impact will be $324,000. Funding for this item would be charged to CIP account: 511-1728-1756-00000. RECOMMENDATION Section 12-15 of the Municipal Code provides that subject to approval of the City Manager, cooperative purchases pursuant to a contract with any other local, state or 0 federal governmental unit or agency may be made without following a competitive bidding or quotation process. In accordance with Section 12-15 of the Municipal Code and with approval by the City Manager, Purchasing recommends the Common Council approve this purchase pursuant to the State of Minnesota Cooperative Transit Purchase for two buses for the Transportation Department to New Flyer America, Inc. for $760,000.
