HomeMy WebLinkAbout15. 12-361 Of HKOIH ON THE WATER MEMORANDUM TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Director of Community Development Christopher Strong, P.E., Director of Transportation DATE: July 5, 2012 RE: Agenda Items for Proposed CVS Pharmacy The Council is being asked to review several agenda items with respect to a proposal by CVS to construct a pharmacy as a Planned Development at the intersection of Koeller Street and 9th Avenue. Planned Development requests are typically submitted to the Planning Services Division and receive a multi-departmental review to address issues related to code compliance in order to provide the Plan Commission and the Common Council with recommendations. The proposed CVS pharmacy went through this process as well. The most recent staff review identified the recommended conditions for an approval for the CVS Planned Development. Staff recommends approval of the pharmacy use for the site since it is the best use of the site, given other possible commercial land uses. Because of the nature of the proposed CVS Planned Development in combination with 7th Avenue options, there have been a variety of staff recommendations from different technical and professional perspectives which may, in some cases, appear to be at odds with one other. Staff made these recommendations with the intent of bringing the full weight of the varied perspectives to the table. Council members are within their rights to weigh these various perspectives according to their individual and collective policy interests and goals. Any Council decision will be made in light of the totality of not only staff recommendations, but in the best interests of the City. Staff's recommendation is for a two phase decision: approve the appropriate 7th Avenue design and then approve the appropriate conditions for the CVS Planned Development. In order to facilitate that discussion, staff prepared the following outline which may assist the Council in their discussions of this issue on Tuesday evening. Listed across the top line of the table are the possible outcomes that have been brought to staff's attention. Along the side are the actions required corresponding to the outcomes. A RI indicates a positive or "yes" vote to the item, a 0 indicates a negative or "no" vote upon the item. The revised Ordinance would then read: SECTION 27A-10.3 STREETS CLOSED TO THROUGH TRAFFIC The following streets shall be closed to through vehicular traffic: 7th Avenue, from the intersection with Lilac Street 107 feet west Vehicular traffic shall include automobiles trucks, motorcycles, mopeds, and the like, but shall not include bicycles, skateboards, and similar transportation devices. The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. Vehicular traffic, excepting emergency vehicles, shall not th cross the above-described obstruction(s) on 7 Avenue. Rohloff, City Manager FROM: Christopher Strong, Transportation Director DATE: June 20, 2012 RE: Item Defeated by the Traffic Review Board at their June 12, 2012 Meeting A REQUEST TO CLOSE 7TH AVENUE BETWEEN A PROPOSED PRIVATE DEVELOPMENT DRIVEWAY, EAST OF KOELLER STREET, AND LILAC STREET. This is a developer request. 7th Avenue is a local street with relatively low daily traffic volumes. According to their application,the developer made this request in order to protect the residential neighbors from commercial traffic that may result from the proposed development. The Traffic Review Advisory Board has previously considered requests to close streets, most recently a request to convert a portion of Elmwood Avenue to a pedestrian mall in December 2010. Street closures can be appropriate for a variety of reasons, such as helping reduce vehicle conflicts, consolidating traffic more efficiently in the roadway network, or improving pedestrian mobility. None of these reasons are present in this case. As a local street, 7th Avenue carries a relatively light volume of traffic. No safety or congestion-related problems have been identified on this street for which a street closure would be considered or necessary. Closing the street could potentially introduce challenges for emergency response and street maintenance, as well as reducing accessibility for local residents. It gives local traffic fewer alternate routes, which could significantly increase delay in the event of lane closures due to traffic accidents, construction, or similar activities. It also conflicts with the City's 2011 bicycle and pedestrian circulation plan, which calls for a bicycle route to run on 7th Avenue from Koeller Street to Lilac Street, from where it continues to the north. A traffic impact analysis report prepared by the developer, and analyzed by staff for the Plan Commission, currently shows 41 vehicles in the peak hour on this section of 7th Avenue. This is projected to increase to 53 vehicles in the peak hour with the presence of the proposed development. DEFEATED BY TRAFFIC REVIEW BOARD (1-5)
