12 -330 RESOLUTION
(CARRIED 7 -0 LOST LAID OVER WITHDRAWN )
PURPOSE: APPROVE ACCEPTING EASEMENT FROM OSHKOSH
INVESTORS LLC TO STABILIZE THE SEAWALL ADJACENT TO
THE FORMER CITY CENTER HOTEL FOR CONSTRUCTION OF
THE CITY CENTER RIVERWALK IMPROVEMENTS
INITIATED BY: COMMUNITY DEVELOPMENT
PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts an easement from Oshkosh Investors LLC to stabilize the seawall
adjacent to the former City Center Hotel for construction of the City Center riverwalk
improvements, per the attached, and the proper City officials are authorized and
directed to execute any and all documents necessary for purposes of same.

Adjacent to the Former City Center Hotel for Construction of the City
Center Riverwalk
BACKGROUND
In the course of beginning the demolition work on the hotel segment of the Riverwalk,
AECOM, the City's engineers on the project, discovered that there are tie-rods that
connect the seawall into the foundation of the hotel. There appear to be 13 tie-rods, 2
have broken and 2 have deteriorated significantly. The condition of all the tie-rods is
unknown because removing the hotel's concrete patio to examine all the tie-rods may
endanger the remaining structural support for the seawall. The City was not aware of the
tie-rods until after the design and bidding work was done and the new hotel owners found
drawings of the tie-rods in the hotel's storage.
ANALYSIS
The tie-rods serve as a structural connection between the seawall and the hotel
foundation. This is a concern because the tie-rods are deteriorating, the long-term
maintenance of the tie-rods will be difficult and the tie rods will need to be replaced in
about 25 years. In addition, changes to the hotel's foundation could affect the seawall
and vice versa. City staff asked that a better, longer term solution be explored taking into
consideration that the revised design must also adhere to the Riverwalk project schedule
and budget.
AECOM explored a number of options in concert with City staff and Lunda
Construction, the contractor on the project. The best solution at this point in time appears
to be drilling new sockets into the bedrock 30 feet under the hotel and fastening new tie-
rods into the new sockets in the bedrock. In addition, large rocks (rip-rap) would be
placed along the bottom of the seawall within the Fox River which WisDNR has now
permitted. After the new tie-rods are installed, the existing tie-rods connected to the hotel
foundation could be removed and the concrete patio replaced.
The easement is required for the City to place new tie-rods in the bedrock below the
hotel. The tie-rods would then anchor the seawall to the bedrock for a long-term
solution.
RECOMMENDATION
The City Council accepts the easement for the Riverwalk seawall tie-rod anchor.

CENTER PROPERTY (1 N. MAIN STREET)

GENERAL INFORMATION

Background/Analysis:
The City has commenced work on the riverwalk in the City Center and hotel zone between Main
Street on the east and Jackson Street on the west. In the course of beginning the demolition work
on the hotel segment of the Riverwalk, AECOM, the City's engineers on the project, discovered
that there are tie-rods that connect the seawall into the foundation of the hotel. There appear to be
13 tie-rods, 2 have broken and 2 have deteriorated significantly. The condition of all the tie-rods is

The proposed solution is to attach new tie-rods into the bedrock beneath the hotel and place large
rocks (rip-rap) along the bottom of the seawall within the Fox River, pending WisDNR permitting.
After the new tie-rods are installed,the existing tie-rods connected to the hotel foundation could be
removed and the concrete patio replaced. To do this an easement is required of the hotel's owners to
allow attachment of the tie-rods into the bedrock underneath the hotel, which is supported by the
hotel owners.
RECOMMENDATION
Staff recommends acceptance of the easement for riverwalk purposes.
The Plan Commission approved of the easement as requested. The following is the Plan
Commission's discussion on this item.
Mr. Burich presented the item and explained the reasoning for the easement request which involves
attaching new tie-rods into the bedrock beneath the hotel and placing large rocks along the bottom
of the seawall within the river as the current tie-rods are deteriorating. He further explained that
this issue was discovered now as the riverwalk is currently under construction in this area.

Mr. Thorns questioned if the Wisconsin Department of Natural Resources (WisDNR) had any
issues with this.
Allen Davis, Director of Community Development, responded that WisDNR had permitted the
proposed rip rap earlier last week and permission has been obtained from the property owner as
well.
Mr. Thorns also questioned if these additional costs would be at the City's expense and if there were
any concerns with the foundation of the hotel.
Mr. Davis responded that the additional costs would be at the City's expense and it will be
disconnected from the hotel's foundation.
Mr. Thorns also inquired if the City had insurance to cover this.
Mr. Davis responded affirmatively.
Motion by Vajgrt to accept an easement for Riverwalk development along City Center
property (1 N. Main Street).
Seconded by Borsuk. Motion carried 8-0.
