HomeMy WebLinkAbout50. 12-295 MAY 22, 2012 12-295 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVAL OF CHANGES IN TRAFFIC OFFICER DESIGNATIONS FOR SELECT STREETS THROUGH UW-O CAMPUS INITIATED BY: TRANSPORTATION DEPARTMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 27-20 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO AUTHORIZING "TRAFFIC OFFICERS". The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27-20 of the Oshkosh Municipal Code pertaining to authorization of"traffic officers" is hereby amended as follows: Remove Therefrom: A) For purposes of enforcing Section 27(A-3)(E)(F)(G) of this Code, specifically 15-minute parking meter regulations on Algoma Boulevard, 30-minute parking meters on Elmwood Avenue and Irving Avenue, the Pay and Display zones, duly appointed Campus Police and Security Officers are designated as "traffic officers" within the meaning of Sections 340.01(70) and 349.13 of the Wisconsin Statutes and are authorized to issue UW-O citations for all non-moving violations related to Section 27(A-3)(E)(F)(G) as heretofore outlined. Add Thereto: A) Duly appointed Campus Police and Security Officers are designated as "traffic officers" within the meaning of Sections 340.01(70) and 349.13 of the Wisconsin Statutes and are authorized to issue UW-O citations for all non-moving violations for purposes of enforcing the following sections of this Code: 1) Designated 15-minute parking areas, east side of Algoma Boulevard, as designated between Elmwood Avenue and Woodland Avenue, under Section 27-23(A-11) of this Code. 2) Designated 15-minute parking areas, west side of Elmwood Avenue, as designated between Amherst Avenue and Irving Avenue, under Section 27-23(A-11) of this Code. MAY 22, 2012 12-295 ORDINANCE FIRST READING CONT'D 3) Designated handicapped parking, south side of Pearl Avenue, between Rockwell Avenue and Osceola Street, under Section 27-23(A-11) of this Code. 4) Pay and Display parking areas, as designated under Section 27-23(A-3)(G) of this Code. SECTION 2. This ordinance shall be in full force and effect from and after its passage and publication. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #12-XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 27-20 PERTAINING TO AUTHORIZING "TRAFFIC OFFICERS") on June 12, 2012. The ordinance authorizes University of Wisconsin-Oshkosh officers to enforce certain parking restrictions for select streets through or near the university campus. Greuel, Chief of Police DATE: May 15, 2012 RE: APPROVAL OF CHANGES IN TRAFFIC OFFICER DESIGNATIONS FOR SELECT STREETS THROUGH UW-O CAMPUS Background Section 27-20 allows University of Wisconsin-Oshkosh parking officers to issue tickets for non-moving violations on a couple of public streets in campus: in parking bays on Algoma Boulevard through campus, and for spaces governed by the pay and display multi-space parking payment systems. The University has requested the ability for its officers to issue tickets for non-moving violations in two additional areas: on Elmwood Avenue in front of the new dormitory(Horizon Village), and in the handicapped parking spaces on Pearl Avenue, located in front of the University's Student Rec and Wellness Center. This ordinance amends the current language to accommodate the University's request. Analysis The ordinance is an extension of code language that has worked satisfactorily for both the City and the University. The ordinance does not cede any Police Department responsibility to the University. The Police Depaitment has internally reviewed this request and finds it consistent with its requirements for traffic and parking enforcement in the campus area. Fiscal Impact The Police Department does not anticipate any loss in enforcement revenues due to this ordinance. Recommendation We recommend the Common Council approve this ordinance change.
