That Section 13-2(A)(1)(a), (b), (c), & (d) of the Oshkosh Municipal Code pertaining to Adoption of Fire Prevention Codes is hereby repealed and recreated to read as follows: (1) (a) International Fire Code (IFC) 2009 Chapter 1, but excluding Section 108 and 109.3 and including only those sections of 105.6 and 105.7 as enumerated below: Required Operational Permits 105.6.2 Amusement Buildings 105.6.4 Carnivals and fairs 105.6.13 Exhibits and trade shows 105.6.15 Fire hydrants and valves 105.6.30 Open burning 105.6.35 Private fire hydrants 105.6.36 Pyrotechnic special effects material 105.6.43 Temporary membrane structures, tents and canopies Required Construction Permits 105.7.1 Automatic fire-extinguishing systems 105.7.5 Fire alarm and detection systems and related equipment 105.7.6 Fire pumps and related equipment 105.7.11 Private fire hydrants 105.7.13 Standpipe systems 105.7.14 Temporary membrane structures, tents and canopies MAY 9, 2012 MAY 22, 2012 12-249 12-291 ORDINANCE FIRST READING SECOND READING CONT'D (b) International Fire Code (IFC) 2009 Chapters 2-45 (c) International Fire Code (IFC) 2009 —Appendix B, C, & D (d) The Geographic limits referred to in certain sections of the 2009 International Fire Code are hereby established as follows: Section 3506.2 The storage of flammable cryogenic fluids in stationary containers is prohibited on properties zoned residential or within one thousand (1,000) feet of a property line of property zoned residential area unless allowed by the Fire Chief or his/her designee. Section 3404.2.9.6.1 The storage of Class I and Class II liquids in above- ground tanks outside of buildings is prohibited on properties zoned residential or within one thousand (1,000) feet of a property line of property zoned residential area unless allowed by the Fire Chief or his/her designee. Section 3406.2.4.4 The storage of Class I and Class II liquids in above- ground tanks is prohibited on properties zoned residential or within one thousand (1,000)feet of a property line of property zoned residential area unless allowed by the Fire Chief or his/her designee. SECTION 2 That Section 13-2(A)(3) of the Oshkosh Municipal Code pertaining to Adoption of Fire Prevention Codes is hereby repealed and recreated to read as follows: (3) Wisconsin Administrative Codes Flammable and Combustible Liquids Code, SPS 310, Wis. Admin. Code Fire Prevention Code, SPS 314, Wis. Admin. Code Smoke Detectors and Carbon Monoxide Detectors, SBS 328 SECTION 3 That Section 13-3(A) of the Oshkosh Municipal Code pertaining to Smoke Detectors and Carbon Monoxide Detectors is hereby repealed and recreated to read as follows: SECTION 13-3 SMOKE DETECTORS AND CARBON MONOXIDE DETECTORS (A) All dwelling units, vacant or occupied, shall be provided with working, approved, listed, and labeled smoke detectors and carbon monoxide detectors. Smoke detectors and carbon monoxide detectors shall be installed in accordance with the appropriate Department of Safety and Professional Services (DSPS) code that governs the dwelling building, and in accordance with the manufacturer's instructions. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #12-291 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 13-2(A)(1)(a), (b), (c), & (d); AND SECTION 13-2(A)(3) ADOPTION OF FIRE PREVENTION CODES / AMENDING SECTION 13-3(A) SMOKE DETECTORS, on May 22, 2012. The ordinance amends and updates language to comply with current codes and adopts new state requirements related to carbon monoxide detectors. Franz TO: Honorable Mayor and Members of the Common Council QIHKQ/H FROM: Tim Franz, Fire Chief ON THE WATER DATE: May 1, 2012 RE: Request To Amend City Ordinance Related to Fire Prevention BACKGROUND The City of Oshkosh Fire Prevention Ordinance (Section 13) adopts by reference the International Fire Code and applicable Codes from the State of Wisconsin. The Intentional Fire Code has been updated along with the State of Wisconsin Codes which requires that we update our local ordinance to reflect these changes. ANALYSIS The State of Wisconsin has reorganized the Department of Commerce and subsequently re-assigned these duties to the new Department of Safety and Professional Services. This has caused a renumbering of all related codes from Comm. 14 to SBS 14. This update also includes the adoption of the 2009 International Fire Code and updates to smoke and carbon monoxide detector placement and maintenance. In order to enforce these codes we must update and adopt them at the local level. FISCAL IMPACT There is no budgetary or fee impact by the changes we are proposing. RECCOMENDATION I recommend that the City amend the Fire Prevention Ordinance Section 13 as presented to reflect the changes in updates in State of Wisconsin and International Fire Codes. This will ensure our ability to enforce the Fire Prevention Codes for the continued safety of our residents and property owners. Please direct any question regarding this matter to the Fire Chief.
