HomeMy WebLinkAbout21. 12-237 MAY 9, 2012 12-237 RESOLUTION (CARRIED__7-0___LOST _______LAID OVER ______WITHDRAWN _______) PURPOSE: APPROVAL OF AGREEMENT WITH WISCONSIN DEPARTMENT OF TRANSPORTATION FOR LIGHTING JACKSON STREET / OREGON STREET BRIDGE INITIATED BY: DEPARTMENT OF TRANSPORTATION BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Agreement between the City of Oshkosh and Wisconsin Department of Transportation for lighting the Jackson Street/Oregon Street Bridge is hereby approved. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto any changes in the execution copy being deemed approved by their respective signatures and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. City of Oshkosh - Transportation Department O - (H ty P P ON THE WATER 926 Dempsey Trail, Oshkosh, WI 54902 (920) 232-5342 (920)232-5343 fax MEMORANDUM TO: Honorable Mayor and Members of the Common Council FROM: Christopher Strong, P.E., Director of Transportation DATE: May 3, 2012 RE: Resolution to Approve Agreement with Wisconsin Department of Transportation for Lighting Jackson Street/Oregon Street Bridge Background Under the previous resolution, the Common Council was asked to consider accepting a gift of a decorative bridge lighting system for the Jackson Street/Oregon Street Bridge. In order for the gift to be installed and used, the City must also enter into a municipal agreement with the Wisconsin Department of Transportation (WisDOT). Analysis The City entered into a similar agreement with WisDOT in 2008 for decorative bridge lighting installed on the Main Street Bridge. The agreement has several conditions on operations and installation, none of which are objectionable to City staff. Fiscal Impact There is no fiscal impact in entering into this agreement. Recommendation Staff recommends approval on the condition that the Council voted to accept the bridge lighting gift considered under the previous agenda item. Rohloff Director of Transportation City Manager City of Oshkosh—Transportation Department 1 DATE: May 9 2012 STATE / MUNICIPAL AGREEMENT 1•D•: FOR A HIGHWAY: LENGTH: HIGHWAY IMPROVEMENT PROJECT LIMITS: Jackson/Oregon Street Bridge COUNTY: Winnebago The signatory City of Oshkosh hereinafter called the Municipality, through its undersigned duly authorized officers or officials, hereby requests the State of Wisconsin Department of Transportation, hereinafter called the State, to initiate and effect the highway or street improvement hereinafter described. The authority for the Municipality to enter into this agreement with the State is provided by Section 86.25(1), (2), and (3) of the Statutes. NEEDS AND ESTIMATE SUMMARY: Existing Facility (describe and give reason for request): The Municipality in cooperation with Progress Oshkosh, a non profit organization,wish to install profile lighting on the side of the Main St.bridge. Proposed Improvement (nature of work): The proposal is to install 16 LED color changing lights, 6 on each side of the bridge to illuminate the structure. The work will include controllers and conduit. Describe non-participating work included in the project contract: The City will pay for all installation, electric, maintenance and removal costs. This request is subject to the terms and conditions that follow and is made by the undersigned under proper authority to make such a request for the designated Municipality and upon acceptance by the State shall constitute agreement between the Municipality and the State. The Municipality understands the lights can not interfere with the Bridge Operators ability to operate the bridge. The City will adjust/remove the lights to avoid conflicts with the operators cameras or vision. 2. The Municipality will remove and replace the lights as needed for State bridge maintenance. The State shall provide the City with at least 2 week notice unless under emergency. 3. The Municipality will be responsible for all costs associated with the installation and maintenance. 4. All brackets and mounting methods are pre-approved by DOT.
